99-23317 RESO RESOLUTION No. 99-23317 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING AND APPROPRIATING FUNDS FOR THE POLICE CONFISCATION TRUST FUND BUDGET FOR FISCAL YEAR 1999/00 IN THE AMOUNT OF $177,800, SAID BUDGET TO BE FUNDED FROM THE PROCEEDS OF STATE CONFISCATED FUNDS. WHEREAS, Section 932.705, Florida Statutes, addresses the purposes and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for the appropriation and expenditures exist, and the appropriation and expenditure of forfeiture funds is in compliance with Section 932.705, Florida Statutes and within Federal guidelines. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby appropriate the funds for the 99/00 Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $177,800, as reflected in Exhibit "A". Ii ~ 0\>'l~ Richard Barreto Chief of Police Miami Beach Police Department 9-1-91 Date POLICE CONFISCATION TRUST FUND EXPENDITURES FISCAL YEAR 99/00 BUDGET STATE FUNDS: COSTS CONNECTED WITH THE PROSECUTION AND PROCESSING OF FORFEITURE CASES TRAINING AND SUBSCRIPTION FOR THE LEGAL UNIT PERTAINING TO CONFISCATIONS AND FORFEITURES ACCREDITATION - To continue the process to to make the MBPD an accredited police agency. This will allow the Department to meet the standards set by the Commission on Accreditation of Law Enforcement Agencies (C.A.L.E.A.). D. A. R. E. The curriculum has changed for DARE requiring the Department to purchase new and additional items in order to continue the program (including training for assigned officers) CRIME PREVENTION UNIT: To coordinate costs of community programs such as Neighborhood and Business Crimewatch, Police Community Relations Team, Citizens on Patrol, Security Communications Assistance Network (SCAN) and the Citizens' Police Academy. There is no other funding for these programs ASSISTANCE TO TOURIST/VICTIMS OF CRIME This project will assist tourist/victims of crime during the hours/days after they have been victimized. Funds will be used on "an as needed basis" for tourist victims, to cover transportation (cabs, airline ticket re- issuance), hotel/motel rooms, food, clothing, medicine, etc. Each tourist/victim will be screened to determine if any other resources can be used. Tourist/ victims will be asked to pay back any funds they are furnished. STRATEGIC PLANNING SESSION FOR MBPD STAFF EXHIBIT "A" $7,000 $1,000 $16,000 $10,000 $10,000 $3,500 $7,500 SOUTH FLORIDA INNER-CITY GAMES $10,000 To assist this organization in providing cultural, education and recreation programs to middle school aged youth in the important non-school hours. This program will be offering Miami Beach students an exciting program involving computers, visual and performing arts, life skills and recreation as an after school activity throughout the 1999-2000 school year. Y2K CONTINGENCY FUND $20,000 The Police Department anticipates that the new millennium and Y2K issues will present unidentified problems within the department and within the community at large. As a result of these problems the Police Department anticipates that special resources may be needed to effectively respond to Y2K and new millennium issues. ADDITIONAL FUNDING FOR TRAINING for the Police Department to supplement the Fiscal Year 99/00 Budget Training Fund $25,000 REIMBURSEMENT TO THE GENERAL FUND FOR OVERTIME $30,000 generated by the Florida Impact Task Force (to cover overage not reimbursed previously). MATCH GRANTS: VOCA (Victims of Crime Act-Domestic Violence) $8,522 BULLETPROOF VEST PARTNERSHIP PROGRAM Purchase of 325 bulletproof vests a year over the next three years. The U. S. Department of Justice will reimburse the city 50% of the purchase price. ADMINISTRATION RECOMMEND A TION Adopt the Resolution. BACKGROUND Florida Statute 932.705 provides for expenditure of forfeiture funds for law enforcement purposes. The Chief of Police of the City of Miami Beach has reviewed and identified the need for the appropriation and the expenditure of forfeiture funds and confirmed that it is in compliance with Section 932.705, Florida Statutes. AN AL YSIS The Administration requests authorization to adopt an operating budget for the Police Confiscation Trust Fund for FY 99/00 to appropriate $177,800 from State funds to be used to provide for the expenditures listed in Exhibit "A". In accordance with Florida Statute 932.705, forfeiture funds have been deposited in the Police Confiscation Trust Fund and all other statutory procedures have been complied with. CONCLUSION The attached Resolution provides for the Fiscal Year 1999/00 Budget of the Police Confiscation Trust Fund in the amount of $177,800 to be used for the expenditures listed in Exhibit" A".
