99-23362 RESO RESOLUTION NO. 99-23362 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE CERTIFICATES OF THE RESULTS OF THE NOVEMBER 2, 1999 SPECIAL ELECTION FOR THE CITY OF MIAMI BEACH, ADJOURNING THE CITY OF MIAMI BEACH CANVASSING BOARD FOR THE NOVEMBER 2, 1999 SPECIAL ELECTION AND DECLARING RESULTS THEREOF. WHEREAS, on September 22, 1999, City Manager designee Mayra Diaz Buttacavoli, Commissioner Nancy Liebman and Commissioner Jose Smith were designated by the Miami Beach City Commission to act as its Canvassing Board representatives regarding the conduct of the November 2, 1999 Special Election for the City of Miami Beach; and WHEREAS, City Manager designee Mayra Diaz Buttacavoli, Commissioner Nancy Liebman and Commissioner Jose Smith acted as the commission representatives/Canvassing Board for the November 2, 1999 Special Election; and WHEREAS, the Certification of the results of the City of Miami Beach Special Election have been received and are attached hereto as Composite Exhibit "A" and are incorporated herein; and WHEREAS, said Certification reflects that: Question "A" as set forth below was approved by the electorate of the City of Miami Beachl; Question "B" as set forth below was approved by the electorate of the City of Miami Beach; Question "C" as set forth below was approved by the electorate of the City of Miami Beach; Question "D" as set forth below was approved by the electorate of the City of Miami Beach; Question "E" as set forth below was approved by the electorate ofthe City of Miami Beach; Question "F" as set forth below was rejected by the electorate of the City of Miami Beach; Question "G" as set forth below was approved by the electorate of the City of Miami Beach; and Question "H" as set forth below was approved by the electorate of the City of Miami Beach. 1 The eight ballot questions have been lettered "A"; "B"; "e"; "D"; "E"; "F"; "G"; and "H" for ease of reference herein only and were not so lettered on the ballot. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that having canvassed the returns of the November 2, 1999 Special Election of the City of Miami Beach, it hereby adopts the certificates as to the results of said Special Election and it is hereby ordered that the Certificates of Election and this Resolution be recorded in the minutes of the meeting as a permanent record of the results of said election; be it further resolved that by adoption of this Resolution the City Commission-appointed Committee acting as Canvassing Board for the City of Miami Beach composed of City Manager designee Mayra Diaz Buttacavoli, Commissioner Nancy Liebman and Commissioner Jose Smith has discharged its duties for the November 2, 1999 City of Miami Beach Special Election and said Committee is hereby adjourned; and be it further resolved that as a result of the City of Miami Beach November 2, 1999 Special Election, the votes upon the questions presented reflect the following results: Question "A": RENAMING "OCEAN BEACH PARK" TO "MARJORY STONEMAN DOUGLAS OCEAN BEACH PARK" SHALL "OCEAN BEACH P ARK" (LOCATED GENERALLY TO THE EAST OF OCEAN DRIVE BETWEEN THE SOUTH RIGHT OF WAY OF 2ND STREET EXTENDED, AND THE NORTH RIGHT OF WAY OF 3RD STREET EXTENDED) BE RENAMED "MARJORY STONEMAN DOUGLAS OCEAN BEACH PARK"? On November 1, 1999, commencing at approximately 2:30 p.m., the Supervisor of Elections had the tabulating equipment based in the Elections Department at the Stephen P. Clark Center tested to ascertain that the equipment will correctly count the precinct and absentee ballot votes cast for all candidates and questions. 2. The unde'rsigned compared the test results with the predetermined totals for each choice and pursuant to the requirements established in Section 101.5612, Florida Statutes, observed the performance and results of all required tests and verified the correctness of the program, precinct header cards and test ballots, as well as any replacement of said materials required by said tests, subject to said tests. 3. On November 2, 1999, commencing at approximately 6:00 p.m., the Supervisor of Elections had the tabulating equipment based in the Elections Department at the Stephen P. Clark Center tested to ascertain that the equipment will correctly count the precinct and absentee ballot votes cast for all candidates and questions.
