99-23365 RESO RESOLUTION NO. 99-23365 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE FOURTH AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND SAVINO AND MILLER DESIGN STUDIO TO PROVIDE CONSTRUCTION ADMINISTRATION SERVICES FOR THE WASHINGTON AVENUE STREETS CAPE MASTER PLAN; SAID AMENDMENT IN AN AMOUNT NOT TO EXCEED $8,100 TO PROVIDE CONSTRUCTION ADMINISTRATION SERVICES FOR PHASE THREE MEDIAN IMPROVEMENTS. WHEREAS, pursuant to RFLI No. 138-93/94 for Professional Landscape Architectural/Engineering Services for Master Planning for the Washington Avenue Streetscape, on July 3, 1996, the Mayor and City Commission authorized the execution of an Agreement with Savino and Miller Design Studio (Consultant), as the top ranked proposer, for the preparation of a Master Plan for improvements on Washington Avenue, from 5th Street to 16th Street (Project); and WHEREAS, the Master Plan has been completed, and a revised plan and budget were developed based on available funding; and WHEREAS, the Administration would recommend that the Consultant proceed to prepare construction documents for median plantings and irrigation improvements for the Project; and WHEREAS, the Consultant will perform additional electrical engineering services associated with the median lighting improvements; and WHEREAS, the Consultant will perform construction administration services associated with the Phase Three median improvements; and WHEREAS, the cost for performing this work is in an amount not to exceed $8,100; and WHEREAS, funding is available from Work Order No. 2143, and, accordingly, the Administration would recommend that the Mayor and City Commission approve the attached Fourth Amendment to the Agreement. NOW, THEREFORE, BE IT FULLY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk are herein authorized to execute the attached Fourth Amendment to the Agreement between the City of Miami Beach and Savino and Miller Design Studio to provide construction administration services for the Washington Avenue Streetscape Master Plan; said Amendment in an amount not to exceed $8,100, to provide construction administration services associated with the Phase Three median improvements for the Project. ADMINISTRA TION RECOMMENDATION Adopt the Resolution. BACKGROUND On July 3, 1996, the City Commission authorized an agreement with Savino & Miller Design Studio for the preparation of a master plan for Washington Avenue. In January 1998, following several neighborhood meetings with the community, Savino & Miller completed a master plan for recommended improvements on Washington Avenue. Subsequently, a revised plan with a phased approach was developed and presented to the Finance and Citywide Projects Committee on November 19, 1998. The Committee recommended that architecturaVengineering fees be negotiated to implement the revised plan and that this amount be included in the budget and funding plan for the project. The project budget has been amended to include architectural/engineering fees, the cost of project administration and an appropriate contingency. This revised budget amount is estimated to be $3,588,220. AGENDA ITEM~ DATE \b-W-99 Commission Memorandum October 20, 1999 Page 2 On December 16, 1998, the City Commission authorized Amendment No. 1 to this Agreement in the amount of $9,500 to prepare a study and plan to illustrate landscaping and engineering improvements which conform to the budget developed for this project. On January 6, 1999, the City Commission authorized Amendment No.2 to this agreement in the amount of$18,135 to prepare construction documents for median plantings and irrigation improvements. On March 3, 1999, the City Commission authorized Amendment No.3 to this agreement in the amount of $9,800 to prepare construction documents for median lighting improvements. ANALYSIS The Administration is now seeking approval for construction administration services associated with the Phase Three median improvements. The cost to perform the work is $8,100. Funding is available from previously appropriated funds in Work Order No. 2143. WHEREAS, the Agreement provides for the preparation of a Master Plan for improvements on Washington Avenue, from 5th Street to 16th Street (Project); and WHEREAS, the Master Plan has been completed and a revised plan and budget were developed based on available funding; and WHEREAS, the preparation of construction documents for median plantings and irrigation improvements were completed; and WHEREAS, additional electrical engineering services for median lighting were completed; and WHEREAS, construction administration services for the Phase Three median improvements are necessary to complete the improvements. 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Fourth Amendment. 2. MODIFICATIONS The Agreement is amended as follows: a. Exhibit "A" is amended to revise the following at the end of the "Scope of Services": Part 6 - Construction Administration Services for the Phase Three median improvements: The Consultant will provide construction administration services for the Phase Three median plantings. irrigation and lighting improvements for the Project. b. OTHER PROVISIONS All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION The City and Consultant ratify the terms of the Agreement, as amended, as modified by this Fourth Amendment. We will eliminate this work from our proposed services for Washington Avenue Phase 2, 4. and 5 which was previously submitted. PROPOSAL for CONSTRUCTION PHASE SERVICES The irrtent of these services is to provide regular, periodic input to the City regarding interpretations of the plans. The fee budget associated with this task is based upon a 16 week construction duration. lfthe final acceptance of the project ex"iends to a period beyond 16 weeks, additional fees shall be required. A. Shop Drawing Review - We will provide services to review shop drawings as submitted by the contractor for materials to be utilized for construction of the project. Shop drawings will be copied to the City for filing. (4 hrs. total) B Progress Meetings - We will provide representation at weekly construction progress meetings (2 hrs. per meeting). The intent of our attendance is to resolve questions that may arise regarding the plans. C.
