Mr. Kent Harrison Robbins, Attorney for the Petitioner, Miami Beach Hotel Investors, LLC,
has submitted a Notice of Petitioner's Voluntary Dismissal with Prejudice, see attached.
Because the item is an advertised public hearing it will be listed on the July 6, 2005 City
Commission Meeting Agenda and will be noted as withdrawn at the request of Miami
Beach Hotel Investors, LLC.
Background:
On June 8, 2005, the City Commission approved Resolution No. 2005-25926, setting a
public hearing for July 6, 2005 pursuant to City Code Section 118-262 to review an appeal
by Miami Beach Hotel Investors, LLC, petitioner, of an Order of the Design Review Board
requested by Hotelerama Associates, L TD, pertaining to ORB File No. 17369, which
extended the time to obtain a building permit for a previously approved project.
The legal brief, prepared by Kent Harrison Robbins, Esq., attorney for Miami Beach Hotel
Investors, and the transcript of the April 19, 2005 DRB meeting were transmitted to the City
Commission on June 10,2005 via L.T.C. 158-2005.
