(Wherever used herein, the terms "Grantor" and "Grantee" include all the parties to this instrument and the heirs, legal representatives and assigns of individuaL% and the successors and assigns of corporations.) The real property may be used only for the following public purposes unless otherwise agreed to by the Grantee and The Courts at South Beach Condominium Association, Inc.: (a) Police sub-station or administrative fire or police office facilities; (b) Office space for cultural organizations and/or organizations which serve as arts incubators; (c) A library facility. 2. Real estate taxes for the year 2004 and subsequent years. 3. Terms and conditions set forth in the Declaration of Condominium of THE COURTS AT SOUTH BEACH, a Condominium, as amended. 4. Zoning restrictions, prohibitions and other requirements imposed by governmental authority. 5. Easements, restrictions and conditions of record but this provision shall not operate to reimpose same. TOGETHER with all tenements, hereditaments and appurtenances thereto belonging or in any way appertaining. TO HAVE AND TO HOLD the same in fee simple forever. The benefits and obligations hereunder shall inure to and be binding upon the heirs, executors, administrators, successors and assigns of the respective parties hereto. The Grantor does hereby fully warrant the title to all the premises hereby conveyed, and will defend the same against the lawful claims of Grantor, and Grantor's heirs and each and every person or persons whomsoever lawfully claiming the same by, through and under Grantor herein.
