99-23424 RESO RESOLUTION NO. 99-23424 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY APPROVING THE ISSUANCE OF A CHANGE ORDER, IN THE AMOUNT OF $24,840.45, AND AUTHORIZING THE ISSUANCE OF A SECOND CHANGE ORDER, IN THE AMOUNT OF $38,475, TO VILA & SON LANDSCAPING CORPORATION, PURSUANT TO STANDING ORDER NO. 12866 FOR THE COMPLETION OF THE IMPROVEMENTS TO LUMMUS PARK. WHEREAS, the Mayor and City Commission approved the award of a contract with Vila and Son Landscaping Corporation for the rehabilitation of Lummus Park (the Project) on September 22, 1999; and WHEREAS, an appropriation and standing order was established for this purpose; and WHEREAS, the Project is proceeding on schedule and is estimated to be completed in December 1999; and WHEREAS, the approval of the attached Change Orders in the amount of $24,840.45 and $38,475 respectively, will allow the City to timely complete the construction ofthe Project; and WHEREAS, funding to pay for the attached Change Orders are available in the appropriated Park Bond Budget Account No. 370.2169.069358. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby retroactively approve the issuance of a Change Order, in the amount of $24,840.45, and authorize the issuance of a second Change Order, in the amount of$38,475, to Vila & Son Landscaping Corporation for the completion ofthe improvements to Lummus Park. FROM: SUBJECT: ADMINISTRATION RECOMMENDATION: Adopt the Resolution. FUNDING: $63,315.45: Funds are available from the Park Bond Budget Account No. 370.2169.069358 ANAL YSIS: On September 22, 1999, the Mayor and City Commission authorized the award of a contract in the amount of $390,045.70 to Vila and Son Landscaping Corporation for the rehabilitation of Lummus Park. In July of 1999, a Construction Permit Application, regarding the proposed improvements to the park was filed before the Florida Department of Environmental Protection. In mid September 1999, the Florida Department of Environmental Protection (FDEP) imposed certain conditions for the issuance of the permit. Among those, 83 square yards of ADA compliant paver-block walkway proposed seaward of the erosion control line had to be deleted, and 405 concrete square yards of concrete walk as well as 694 square yards of concrete base for the playground safety surfacing tiles needed to be replaced with frangible materials. AGENDA ITEM elM.... 12-\ s-ct9 These mandatory FDEP revisions were made to the construction documents by the City's consultant and the cost to do the same negotiated with the contractor by City Staff and the City's consultants. As a result, the City received a credit of$6,897.30 for the deleted work required by FDEP. At the same time, a Change Order increase in the amount of $24,840.45 was issued for the additional work. The Administration, in order to avoid a delay in the construction of this project, allowed the contractor to continue with the revised scope of the work while seeking a retroactive approval from the Commission. Change Order No.2 is to plant an additional 45 Maypan Coconut Palms each with 5' gray wood, 20 Maypan Coconut Palms each with 10' gray wood and to install the additional irrigation necessary to water the new palms. The installation of these new elements will further highlight the current design composed of 389 trees of the aforementioned species, seagrape trees, sod, irrigation and playground area. The total cost for this Change Order is $38,475. The City's consultants have evaluated those Change Orders and agree with the cost estimates submitted. Funding is available from the saving resulted, due to the fact that the lowest bidder, Vila and Son Landscaping Corporation's lump sum proposal came below the City's allocated construction budget estimate.
