A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE HOME INVESTMENT PARTNERSHIPS PROGRAM AGREEMENT, DATED OCTOBER 20,1995, FOR THE SINGLE PARENT FAMILY HOUSING AND RESOURCE CENTER, TO BE LOCATED AT 1231-1251 17TH STREET, BETWEEN THE CITY AND THE MIAMI BEACH HOUSING AUTHORITY , PROVIDING FOR REFINEMENT OF THE PROJECT AND A DECREASE IN THE TOTAL NUMBER OF UNITS. 96-22221 WHEREAS, on September 27, 1995, the City Commission adopted Resolution No. 95-21745 authorizing the Mayor and City Clerk to execute an agreement between the City and the Housir 9 Authority; and WHEREAS, the Agreement committed Seven Hundred Sixty-Thousand Dollars ($760,1)0(1) of HOME Investment Partnership Act (HOME) funds towards the construction cost of the plarlned Single Parent Family Housing and Resource Center ("Center"); and WHEREAS, on May 15, 1996, the Commission discussed questions on the proposed Cente"; and WHEREAS, on June 6, 1996, the Housing Authority held a workshop to discuss the propose d plans for the Center; and WHEREAS, on August 12, 1996, the City Administration held a meeting with t~e administration of the Housing Authority, a member of the Housing Authority Board I If Commissioners, and representatives from the architectural firm, to discuss the proposed pro~ ral n to be implemented at the Center as well as design issues, density issues, day-care issues, tran~it issues, parking issues, and easements; and WHEREAS, the Housing Authority prepared two alternate plans for the Center, both of whic h reduced the planned number of units and offered other project refinements in response to City ar d community concerns; and WHEREAS, on September 5, 1996, the Housing Authority provided information to t~e Administration and the City Commission on the two alternate plans; and WHEREAS, a Housing Authority workshop was held on October 2, 1996, after whic~ t~ e Housing Authority Board of Commissioners held a special meeting and adopted Resolution 96.4 modifying the Center to include a maximum of forty units, defining the period of occupancy fOl' t~e units, decreasing the size of the day care component and restricting use to residents of the Cente'; and WHEREAS, the Housing Authority and the Administration now wish to amend the ori!lin 11 Agreement to reflect the decreased number of units and other project refinements. ADMINISTRATION RECOMMENDATION: The Administration recommends that the Mayor and City Commission adopt the attached Resolution, authorizing the Mayor and City Clerk to execute an amendment to the HOME Investment Partnerships (HOME) Program Agreement between the City and the Miami Beach Housing Authority (Housing Authority), dated October 20, 1995, for the Sinnle Parent Family Housing and Resource Center, providing for refinement of the project and a decrease in the total number of units, from 52 units to 40 units. BACKGROUND: Beginning in 1992, the City and the Housing Authority forged a partnership which includ'3d plans for a future affordable housing joint venture that would provide housing for qualifi'i3d individuals. On September 27, 1995, the City Commission adopted Resolution No. ~'5- 21745 authorizing the Mayor and City Clerk to execute an agreement between the City and the Housing Authority. The Agreement committed $760,000 of HOME Program federal entitlement funds towards the construction cost of the planned Single Parent Family Housing and Resource Center. At the City Commission meeting of May 15, 1996, under Agenda Item R-9-F: Report Regarding the Housing Authority Project - West Avenue and 17th Street, the Commission discussed a letter from Charles W. Burkett, IV, a Housing Authority Commissioner, addressed to the Miami Beach Housing Authority. The Letter posed questions on the proposed Center. Following the discussion, the Commissil)n agreed to consider this item further in order to allow time for the Housing Authority to AGENDA ITEM c.. /] ~ / 2-i~ 75 DATE COMMISSION MEMO DECEMBER 4, 199 S PAGE 2 respond to Mr. Burkett's letter and to conduct a planned workshop on this project. The Housing Authority workshop was held June 6, 1996. The Center was discussed il'l detail and the proposed project design was presented by the architects. As a result of thl~ workshop, the Administration and the Executive Director of the Housing Authoritl discussed the possibility of reducing the number of permanent units in the Center. Thll) City Commission requested City staff to prepare a report updating the status of the projl~ct The staff report was reviewed at the July 17, 1995 City Commission meeting. The report concluded that the project had remained consistent in intent, scope and location based OIIl a review of City agenda items about the proposed Center beginning in November, 1992. The Commission approved a motion directing the Administration to work with the Housinn Authority and the neighborhood residents in refining the project and addressing issues raised regarding the Center. On August 12, 1996, City staff met with: the administration of the Miami Beach Hous in'I Authority, a member of their Board of Commissioners, and representatives from thf! architectural firm of Andres Duany and Elizabeth Plater-Zyberk, to discuss the propo:;ed program to be implemented at the Center, as well as design issues related to the building" Specific issues were addressed in detail, including: density reduction, architectural features, number of units - transitional and permanent, the gender issue, ratio betwE!en units and battered residents, continuum of care process, security, playground site and child safety, day-care program, transit impact, parking issues, and easements. At the conclusion of the meeting, the City Administration and the administration of thH Housing Authority agreed that the project needed substantial reworking in order to addn~s:; all the issues that had been raised. It was agreed that a public workshop would bo scheduled by the Housing Authority once the revisions to the proposed Center were read:' to be discussed. On September 5, 1996, the Housing Authority submitted a packagE~ !II the City Commission and the City Administration including detailed information on thl! proposed revisions downsizing the Single-Parent Center. The new proposal included twc I options: Option A, reducing the total units from 52 to 46, and Option B, reducing the total units from 52 to 40. Detailed information was provided on how each of the two opti()n:~; addressed the issues discussed earlier with the City Administration. A third altema1 iVH was suggested by the City Administration which was to de-couple the facilities and services. On September 17, 1996, the Board of Commissioners of the Housing Authority voted to explore the various options and to schedule another workshop on the project to facilitate;l the participation of neighborhood residents. After the workshop, the Housing Author"it) Board of Commissioners held a Special Meeting to consider and adopt changes to the original concept of the Single Parent Center. The decisions reached at this meeting Wl~re communicated to the City Commission on October 23, 1996, agenda item R-9-E1, in c: letter from Howard Galbut, Chairman of the Housing Authority Commission. ANAL YSIS: After considering changes to the Center as a result of concerns of the City Commissior and the community, on October 2, 1996, the Housing Authority Commissioners voted tc modify the size of the Center from 52 units to 40 units and to make other refinements ir the Center. The project modifications, which are summarized below, have beer incorporated into the attached Amendment to Agreement. The project modifications do n01 increase the amount of City HOME funds previously allocated nor change the use of the HOME funds. As proposed, the Center will provide two tiers of transitional housing and social servicl~s: including day care, for low and very-low income single parent families who are victims 01 domestic violence. Tier 1 families will be referred from Safe Space programs (programs which ensure that any immediate danger to the family has passed), the City of Mism Beach Police Department, and local agencies. Tier 1 transitional units shall consist of 1 E one-bedroom units (referred to herein as the HOME units). Victims of domestic violerce will reside in the HOME units for six to eighteen months and be eligible to move into the Tier 2 transitional units for an additional 18 months if they are in need of ongoing supp:>r1 services. The 16 one-bedroom units will be designed to ensure that there is flexible space to accommodate those larger families that may be referred to the Center. There will be twenty-four tier 2 transitional units consisting of seventeen (17) two-bedroom units and seven (7) three-bedroom units. Victims of domestic violence may reside in these' tier 2 units for up to thirty-six months. The Center will include social work offices and a day care center to accommodate' a; maximum of fifty-four (54) children who are residents of the Center. Day care will be limited to infants and pre-school children. After-school care will be provided through programs developed by the social services department. The day care center and the playground area will be appropriately staffed and adequately supervised to ensure a sclfe environment for all children. 77 COMMISSION MEMO DECEMBER 4, 199:) PA<:iE ~ As a result of the agreement reached by the City as a part of the Portofino transaction, th~ Housing Authority will not be required to pay an annual Payment in Lieu of Property Ta< (PILOT) for the Center so long as the Center meets certain criteria, more fully specified il the attached Agreement. The amendment to the Agreement therefore eliminates th~ required PILOT payment. WITNESSETH: WHEREAS, on September 27, 1995, the Mayor and City Commission adopted Resolution 95-21745 authorizing the Mayor and City Clerk to execute an agreerle lt between the City and the Housing Authority, in the amount of $760,000 from HOIVE Investment Partnerships Program funds, for a joint venture affordable rental housir g project to be located at 1231-1251 17th Street, to be known as the Single Parent Fami y Housing and Resource Center (Agreement); and WHEREAS, on October 2, 1996, the Housing Authority Board of Commissiol1e 'S held a Special Meeting and voted to reduce the size and scope of the Single Parent Fami y Housing and Resource Center; and WHEREAS, pursuant to the Agreement to Make Exchange between the City ar d the Housing Authority, which was joined in by West Side Partners, Ltd., a Florida Lirr ited Partnership, Sun & Fun, Inc., a Florida corporation, and Beachwalk Developrle lt Corporation, a Florida corporation, the Housing Authority will no longer be required to pc y an annual Payment in Lieu of Property Taxes (PILOT); and WHEREAS, the City and the Housing Authority now wish to amend the Agreemert. NOW THEREFORE, the Agreement is hereby amended as follows: 1. Paragraph 1, Scope of Services, page 2, is deleted in its entirety and amended c s follows: The City agrees to allocate HOME funds to the Provider in the amount of Se'vE.n Hundred Sixty Thousand Dollars ($760,000), (the Funds), in accordance with t~ e preliminary Budget attached and made a fully binding part of this Agreemenj., c s Appendix 1. Paragraph 4, Set Aside of HOME Units/Rent Restrictions/lncome Targeting, pag'~ 3, sentence 3 is deleted and is replaced by the following sentence: The City and Provider agree that the time period anticipated for the transi'io 1 process is six months to a maximum of eighteen months. 4. _ Paragraph 7, Property Standards, page 5, is amended to add the following neh' sentence at the end of the Paragraph: All HUD imposed Housing Quality Standards and all City required hou~"in ~ standards (and other City code requirements) shall be observed at the Center. Th ~ City shall be responsible for insuring the enforcement of its codes on a regulcf basis. 5. Paragraph 17, Annual Payments in Lieu of Property Taxes, page 8, is amended a3 follows: Subparagraph b. is deleted and replaced as follows: b. The City agrees that, for fifteen (15) years commencing with the project being placed in service (the issuance of a Certificate of Occupancy), that t will not levy or impose any real or personal property taxes upon the Proiel:t or upon the Provider with respect thereto so long as the Project is use j solely for housing for victims of domestic violence. Preference shall b.~ given for residents of Miami Beach. If, at any time, the Center ceases to b.~ used for the purposes stated herein, then the Center shall be subject to 8' II applicable City taxes. THE MIAMI BEACH HOUSING AUTHORITY PROJECT KNOW AS IH~ SINGLE PARENT F AMIL Y HOUSING AND RESOURCE CENTER (THE CENTER) SH ALL BE MODIFIED TO INCLUDE A MAXIMUM OF FORTY (40) UNITS OF HOUSING CONSISTING OF SIXTEEN (16) TRANSITIONAL UNITS AND nvENTY-FOUR (24) EXTENSION HOUSING UNITS FOR VICTIMS OF DOMESTIC VIOLENCE; THAT TH.~ SIXTEEN (16) TRANSITIONAL UNITS WILL BE FOR A PERIOD OF FROM SIX (6) T() .
