SUBJECT: MARCH 8, 2005 COMMISSION MEETING - PLANNING BOARD
APPOINTMENTS
On December 31, 2005, the term of four (4) of the seven (7) appointees to the Planning
Board expired. Pursuant to City Code Section 2-24(a) "Expiration of terms: All persons
serving on city agencies, boards or committees shall cease to hold office when a successor
is duly appointed, or 60 days after expiration of the term of their office, as such term is
specified in the ordinance, resolution or other law creating such office, whether or not a
successor has been appointed, which ever occurs first, and such persons shall at that time
cease to exercise any rights, power or prerogatives of office."
Effective March 1 or the 60th day, Marlo Courtney (Developer), Theodore Berman (General
Business), Roberto Sanchez (General Business), and Joy Malakoff (Historic Preservation)
will cease being members of the Planning Board.
A discussion was held at the February 8, 2006 Commission Meeting, and it was determined
that the Planning Board is scheduled to meet on Tuesday, February 28 and again on
Tuesday, March 28. See Attachment "A".
In order to have a Planning Board for the March 28th Planning Board meeting, appoints will
need to be made at the March 8, 2006 Commission Meeting or at a Special Commission
held before March 28th.
Pursuant to City Code Section 118-53, two of the appointees shall have considerable
experience in general business, land development, land development practices, or land use
issues. One of the appointees shall be a "developer", and one of the appointees shall be "a
person who has education, and/or experience in historic preservation issues."
The Administration will place an item on the March 8th Commission agenda for Commission
consideration.
