94-21432 Reso ~ '" RESOLUTION NO. 94-21432 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RATIFYING THE RESOLUTION OF THE MIAMI BEACH REDEVELOPMENT AGENCY DECLARING ACQUISITION OF THE PROPERTY KNO\VN AS THE SHORECREST HOTEL LOCATED AT 1535 COLLINS AVENUE AND LEGALLY DESCRIBED AS THE NORTH 1/2 OF LOT 4 AND THE SOUTH 40 FEET OF LOT 5; AND SOUTH 40 FEET OF LOT 16 AND THE NORTH 1/2 OF LOT 17, BLOCK 56, FISHER'S FIRST SUBDIVISION OF ALTON BEACH, MIAMI BEACH, FLORIDA, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 2, PAGE 77, OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA; THAT PARCEL OF LAND ADJACENT TO AND IMMEDIATELY EAST OF THE ABOVE-MENTIONED AND FOREGOING DESCRIPTION OF PROPERTY, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT WHICH IS THE INTERSECTION OF THE CENTER LINE OF LOT 4, BLOCK56, AS SHOWN ON A PLAT RECORDED IN PLAT BOOK 2, PAGE 77, OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA, AND THE EAST LINE OF SAID LOT 4, BLOCK 56, RUN NORTHERLY ALONG THE EAST LINE OF BLOCK 56 A DISTANCE OF 65.91 FEET TO A POINT; THENCE RUN EASTERLY ALONG THE NORTHERLY LINE OF THE SOUTH 40 FEET OF LOT 5 OF BLOCK 56, PRODUCED EASTERLY A DISTANCE OF 60 FEET MORE OR LESS, TO THE MEAN HIGH WATER LINE OF THE ATLANTIC OCEAN; THENCE SOUTHERLY, l\1EANDERlNG THE SAID MEAN HIGH WATER LINE A DISTANCE OF 66 FEET, MORE OR LESS TO A POINT; THENCE \VESTERLY ALONG THE CENTER LINE OF SAID LOT 4, BLOCK 56, PRODUCED EASTERLY A DISTANCE OF 60 FEET, MORE OR LESS TO THE POINT OF BEGINNING, 0.10 ACRES, PLUS OR MINUS SHOWN TO BE A PUBLIC NECESSITY FOR THE PROJECT KNOWN AS CITY CENTER/CONVENTION VILLAGE PROJECT, AUTHORIZING THE ACQUISmON OF THE SHORECREST BY PURCHASE, DONATION, OR THE FILING OF EMINENT DOMAIN PROCEEDINGS AND DECLARATION OF TAKING, AS NECESSARY AS A POTENTIAL SITE FOR A HOTEL DEVELOPMENT; AUTHORIZING THE CHAJRMAN OF THE MIAMI BEACH REDEVELOPMENT AGENCY AND SECRETARY TO EXECUTE THE REQUlRED DOCUMENTA nON TO INITIATE EMINENT DOMAIN PROCEEDINGS. WHEREAS, the City of Miami Beach is proceeding with its goal for economic stimulation and development by constructing convention quality hotels and an appropriate Request for Proposals Append i x II A II .' addressing and further detailing same has been issued, with bids received, and negotiations underway; and WHEREAS, for the purpose of realizing the type of hotel developments contemplated by Request for Proposals, the City must acquire the property known as the Shorecrest Hotel located at 1535 Collins Avenue, Miami Beach, Florida, (the "Shorecrest Site"); and WHEREAS, the Mayor and the City of Miami Beach Commission by Resolution No. 92- 20646 and the Dade County Conunission by Resolution No. R-14-93 declared the area known as the City Center/Convention Village which includes the Shorecrest Hotel to be a Redevelopment Area in which conditions of slum and blight have been demonstrated; and WHEREAS, the Mayor and the City of Miami Beach Commission acting as the Miami Beach Redevelopment Agency have adopted a redevelopment plan for the area known as the City Center/Convention Village; and WHEREAS, acquisition is a remedy to eliminate slum and blight and preserve historic properties by undertaking the necessary efforts to redevelop them according to approved plans; and WHEREAS, the Shorecrest has been designated by the City of Miami Beach in the City's Historic Properties Data Base as a contributing building in the Ocean Drive/Collins Avenue Local Historic District; and . WHEREAS, the Summary of Findings Pertaining to Proposed Convention Headquarter Hotels in Miami Beach, Florida, dated March, 1990, prepared by Laventhol & Horv.:ath and the Miami Beach Convention Village, Phase One: Convention Hotel Compatibility Study dated September, 1992, prepared by Wallace, Roberts & Todd, Zyscovich, Inc., Kenneth Leventhal & Co., Hardy, Holzman Pfeiffer Associates and other studies determined that in order for the Miami Beach Convention Center to survive, convention hotels supporting the Convention Center were necessary in the immediate area; and WHEREAS, the Miami Beach Redevelopment Agency found, determined and declared that the acquisition of the Shorecrest is a public necessity and is necessary, practical and in the best interest of the City of Miami Beach; and WHEREAS, the Executive Director of the Agency recommended that the Miami Beach Redevelopment Agency authorize the Agency attorney to institute eminent domain proceedings on the aforementioned property; and WHEREAS, the Miami Beach Redevelopment Agency found. determined and declared that it is necessary to acquire fee simple title to the Shorecrest property for use in the City Center/Convention Village Redevelopment Project; and 2 WHEREAS, the Miami Beach Redevelopment Agency found, determined and declared that the acquisition of the Shorecrest by purchase, donation, or eminent domain proceedings including declaration of taking is for the public use and benefit~ and WHEREAS, the Mayor and City Commission concur with all of the above findings of the Miami Beach Redevelopment Agency. AVENUE, MIAMI BEACH, FLORIDA ADMINISTRATION RECOMMENDATIONt It is re~ommended that the Mayor and City Commission ratify the Resolution of the Miami Beach Redevelopment Agency authorizing the General Counsel of the Redevelopment Agency to institute condemnation proceedings in order to acquire the property known as the Shorecrest Hotel, located at 1535 Collins Avenue, Miami Beach, for the City Center/Convention Village Hotel Development Project. Further, the Mayor and City Commission is requested to approve on first reading an ordinance ratifying Resolutions of the City of Miami Beach and the Miami Beach Redevelopment Agency regarding the Shorecrest Hotel acquisition and set the public hearing/second reading for January 4, 1995. ~ACKGROUND: The City of Miami/Redevelopment Agency (llAgency") is proceeding with its goal for economic stimulation and development in the City Center/Historic Convention Village Redevelopment Area (llCity Center") and is currently in the negotiation phase for the development of two convention-quality hotels. In order to accomplish this goal the Agency has determined that the acquisitidn of the above referenced property is necessary.
