In light of the interest that has been and is expected to be generated from this competitive process, this Letter to Commission is intended to advise you that we have informed the five entities that submitted responses to this RFP of the application of the Cone of Silence ordinance to this process. As per the attached correspondence with the entities, we have advised them that any direct communication with City Commission or City administration until such time as the City Commission takes an action on the recommendations is not permitted. The City Manager's recommendation will be presented to our Mayor and City Commission at its September 6, 2006 meeting. Please be advised that any person employed or retained, whether paid or not, by a principal who seeks to encourage the passage, defeat or modification of any action or decision of the Mayor or City Commission, or City Manager, must register as a Lobbyist and disclose his/her fees. The term "Lobbyist" specifically includes the principal as well as any employee engaged in lobbying activities. All lobbyists shall, before engaging in any lobbying activities, register with the City Clerk's Office. Every person required to register shall register on forms prepared by the City Clerk, pay a registration fee of $25.00, and state under oath: (1) His IHer name; (2) His IHer business address; (3) The name and business address of each person or entity which has employed the registrant to lobby; (4) The elected official or personnel sought to be lobbied; (5) The specific issue on which he Ishe has been employed to lobby; and (6) The terms and amount of compensation to be paid by each principal to the lobbyist with regard to the specific issue on which the lobbyist has been engaged to lobby . Please be advised that the City's Cone of Silence Ordinance is still in effect and will remain in effect until such time that the City Manager's recommendation is accepted by the Mayor and City Commission. Therefore, all oral communications between your companies or your representatives (including lobbyists or attorneys) and the Mayor or City Commissioners and their respective staff, or members of the City's administrative staff to include the City Manager and his staff, and the Evaluation Committee members is prohibited. Therefore, any lobbying activity prior to the September 6, 2006 City Commission meeting must be in writing with a copy to our City Clerk.
