WHEREAS, the City Council of the City of Miami Beach,
Florida, deems it to be in the best interest of the City of Miami
Beach, its residents, citizens and tax payers that the title to
and the responsibility for the installation, care, maintenance,
supervision and cost of operation of certain street lights on
certain arterial streets and highways within the City of Miami
Beach be transferred to Metropolitan Dade County, and
WHEREAS, an agreement has been prepared entitled,
"Agreement for Transfer of Street Lights on Arterial Streets",
having attached thereto and made a part thereof a schedule of
said lights so transferred and conveyed, and the terms and provi-
sions of said proposed agreement being familiar to the City
Council of the City of Miami Beach, Florida, and
WHEREAS, the City Manager has duly recommended to the
City Council of the City of Miami Beach, Florida, the said agree-
ment be entered into, and the City Attorney having approved said
agreement as to legal form and validity,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that said agreement be en-
tered into and that the Mayor and the City Clerk be and they are
hereby authorized and directed to execute and deliver the same for
and in the name of the City of Miami Beach, Florida.
PASSED and ADOPTED this 21st day of March, 1973.

SUBJECT: TRANSFER OF ADDITIONAL ARTERIAL STREET LIGHTS TO DADE COUNTY
Attached is a proposed agreement between the City of Miami Beach
and Dade County for the transfer of additional street lights on
arterial streets.
It is the recommendation of the Public Works Director and the
Administration that Council approve this transfer at this time
inasmuch as it is intended that the Dade County Commission will
consider this request on April 3, 1973.

AGREEMENT FOR TRANSFER OF
STREET LIGHTS ON ARTERIAL STREETS
THIS AGREEMENT made and entered into on this
day of
, by and between DADE COUNTY, a political subdivision of the
State of Florida, hereinafter referred to as the "COUNTY" and the CITY OF MIAMI
BEACH hereinafter referred to as the CITY,
WIT N E SSE T H :
WHEREAS, the County has, from time to time, accepted the responsibility
for maintaining various arterial roads which are located within the corporate
limits of municipalities; and
WHEREAS, municipalities from time to time request the County to assume
the cost of the operation and maintenance of roadway lighting facilities which may
exist along arterial roads within corporate limits; and
WHEREAS, it is consistent with the roadway maintenance policy for the
County to assume the roadway lighting costs.
NOW, THEREFORE, in consideration of the premises and of the mutual
covenants and conditions contained herein, the COUNTY and the CITY agree as follows:
COUNTY AGREES:
1. To accept responsibility for the annual power costs of CITY owned
street lights on the arterial streets shown on Exhibit "A" which lie within the
CITY limits, effective April 1, 1973.
2. To accept title to those CITY owned street lights on arterial streets
within the CITY as shown on Exhibit "A" and to provide for their operation and
maintenance with the understanding that the COUNTY may at its discretion remove,
relocate, replace or modify the street lighting facilities on any of these roadways
when necessary in its judgment to provide better lighting conditions.
CITY AGREES:
1. To convey to the COUNTY title to those CITY owned street lights
together with all poles, electrical connections, and appurtenances thereto on
those arterial streets within the CITY as shown on Exhibit "A".
2. To provide the COUNTY a No-Lien Affidavit for those CITY owned street
lights as shown on Exhibit "A".

IT IS MUTUALLY AGREED:
That should any of the roads presently designated arterial on
Exhibit "A" cease to be designated arterial roadways by the COUNTY for any

reason, that all operation and maintenance cost of all lighting on such roads
will again be accepted by the CITY as the responsibility of the CITY, and title
to previously owned city lights shall revert to City.
That this Agreement supersedes all previous agreements or repre-
sentations, either written or oral, heretofore in effect between the COUNTY
and the City made with respect to matters contained herein, and when duly ex-
ecuted constitutes the Agreement between the parties hereto.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed by their respective proper officers duly authorized, the day
and year first written above.

RESOLUTION NO. 12815
BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA:
WHEREAS, Metropolitan Dade County has agreed to
accept responsibility for the annual rental costs of
existing Florida Power and Light Company owned and the annual
power costs of City owned street lights on certain arterial
streets within the City of Miami Beach, and
WHEREAS, an Agreement has been prepared setting forth
the terms and conditions under which said County agreed to
accept such responsibility and setting forth the arterial
streets agreed upon, and
WlIEREAS, the City Council being familiar with the
terms and conditions of said Agreement and the City Council
having found that -it is in the best interests of the City
of Miami Beach and its citizens,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Clerk be, and they are hereby authorized to execute and
deliver the said Agreement for and in the name of the City
of Miami Beach, Florida.
