RESOLUTION NO. 99-23405
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE A SUPPLEMENTAL
JOINT PARTICIPATION AGREEMENT #3 WITH THE FLORIDA
DEPARTMENT OF TRANSPORTATION (FDOT), FOR THE $30,000 THAT
FDOT IS ADDING TO ITS PREVIOUS $1.6 MILLION THREE-YEAR
CONTRIBUTION TOWARD THE ELECTROW A VE BUDGET; THIS
$30,000 BEING SPECIFICALLY ALLOCATED FOR THE PROVISION OF
COACH USA SHUTTLE SERVICES DURING THE MILLENNIUM
CELEBRATIONS IN MIAMI BEACH.
WHEREAS, over 300,000 guests and visitors are expected in Miami Beach for the
Millennium celebrations; and
WHEREAS, the City has devised a traffic circulation plan to help manage the large influx
of vehicles, which plan includes a park-and-ride and local circulator service using twenty (20)
Coach USA and Electrowave shuttle buses; and
WHEREAS, it has been determined that the Coach USA component alone would cost
$30,000, for twenty hours of service, beginning on December 31,1999 at 3:00 p.m" and ending on
January 1, 2000 at 12:00 p.m.; and
WHEREAS, at the City's request, FOOT has agreed to fund the above mentioned special
service at $30,000, with no matching obligations by the City, as long as the attached Supplemental
Joint Participation Agreement #3 is properly executed by the parties in question,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA, that the Mayor and City
Commission hereby approve and authorize the Mayor and City Clerk to execute the attached
Supplemental Joint Participation Agreement #3 with the Florida Department of Transportation
(FOOT), for the $30,000 that FOOT is adding to its previous $1.6 million three-year contribution
toward the Electrowave Budget; this $30,000 being specifically allocated for the provision of Coach
USA Shuttle services during the Millennium celebrations in Miami Beach.

The JPA contributing $30,000 to the Millennium Park & Ride service
was never executed by FDOT, therefore, it is null and void. FDOT
claims that the document was received at FDOT after the deadline
date of December 28, 1999.
The actual cost of the park & ride ($24,885) was reimbursed to the
City, instead, as part of the Electrowave funding program.
Therefore, Reso. 99-23405, dated 12/1/99, approving a JPA for
$30,000 is null and void.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution,
ANALYSIS
The Administration devised an aggressive traffic circulation plan to help manage the large influx
of people expected in Miami Beach for the Millennium celebrations, As part of this plan, the City
requested that the Florida Department of Transportation (FOOT) contribute toward the costs of
contracting for the services of 20 Coach USA buses, which will operate the park-and-ride and local
circulation components of the plan.
FOOT is willing to pay $30,000 or the full cost of 20 buses operating 20-hours of services,
beginning at 3:00 p,m. on December 31st and ending at 12:00 noon on January 1st. In order to make
this contribution effective, FOOT requires that a Supplemental Joint Participation Agreement (IPA)
#3 be executed by the City and the State of Florida, as soon as possible, For this particular
Millennium project, FOOT requires no matching funds from the City.
Attached is Supplemental JPA #3, in the amount of $1.63 million. This amount includes the
previously approved $1.6 million FOOT contribution to the Electrowave Service (from 1996 to
1999) plus the $30,000 contributed herein, The Administration recommends approval of the
Supplemental JPA and its enabling Resolution,

1.00 Project Description: The project description is not amended, This supplemental agreement provides funding for
transit services in the South Beach area as part of Miami Beach's traffic operation efforts for Millenium Celebration activities. The
City's Millenium Transportation Plan is incorporated by reference. All Electrowave transit service and related services within the
approved project budget for this supplemental are eligible for reimbursement at 100% during the Millenium weekend beginning
December 31, 1999 at 3PM and ending January I, 2000 at 12PM,

Safety Requirements
X Bus Transit System - In accordance with Florida Statute 341.061, and Rule Chapter 14-90, Florida
Administrative 'Code, the Agency shall submit, and the Department shall have on file, an annual safety
certification that the Agency has adopted and is complying with its adopted System Safety Program Plan
pursuant to Rule Chapter 14-90 and has performed annual safety inspections of all buses operated.
Fixed Guideway System - (established) In accordance with Florida Statute 341.061, the Agency shall
submit, and the Department shall have on file, annual certification by the Agency of compliance with its
System Safety Program Plan, pursuant to Rule Chapter 14-55.
Fixed Guideway System - (new) In accordance with Florida Statute 341.061, the Agency shall submit a
certification attesting to the adoption of a System Safety Program Plan pursuant to Rule Chapter 14-55,
Prior to beginning passenger service operations, the Agency shall submit a certification to the Department
that the system is safe for passenger service,
