SUBJECT: MIAMI BEACH MARINA/SEWER MAIN BREAK
Attached hereto are copies of my correspondence to the State Attorney and Miami Dade County
Inspector General with regard to the Sewer Main Break at the Miami Beach Marina. In addition to
the documents enclosed herewith, we have provided the State Attorney and the Inspector General,
with copies of the plans for the 54 inch force main and the "as built" drawings for the breakwater
at the Miami Beach Marina.
If you have any questions about any of these documents, please do not hesitate to call upon me.

Dear Mr. Mazzella:
This letter in response to the Subpoena Duces Tecum which was delivered to me by Mr. Alan
Solowitz, Deputy Inspector General, on June 23, 2000. Please note that items number one and five
of the Subpoena are redundant as the Marina is leased to Miami Beach Marina Associates, and there
is no separate contract for the management, administration or improvement of the Marina. The
Lease Agreement, dated June 24,1983, between the City and the operator of the Marina is enclosed
herewith, together with all amendments thereto.
Attached hereto in response to items number two and three of the Subpoena is a Table of Contents
and all of the documentation with regard to Phases 1 and 2 of the improvements pertaining to the
improvements to be installed at Pier M of the Miami Beach Marina. With regard to item 4 of the
Subpoena, we do not make copies of the checks in payment of permits, and, therefore, cannot
provide copies to you.
please be advised that it is the intention of the City of Miami Beach to cooperate fully with all
investigations in this matter, including the investigation by your office. If there is any further
information or documentation that we can provide to you, please contact me at your convenience and
we will be pleased to provide it.

As it appears that there will be an investigation into the circumstances surrounding the permining
process with respect to the piling that breached the 54" sewer force main at the Miami Beach ~larina
last week, I am enclosing a list of all of the documentation of the City oCvliami Beach in connection
with the permitting of the construction of boat lifts at the Miami Beach {-"larina. Also enclosed is
a copy of the Lease Agreement, dated June 24, 1983, between the City of Miami Beach and the
operator of the Marina, and the four amendments thereto.
Please be assured that the City of Miami Beach welcomes a full investigation and stands fully
prepared to provide whatever cooperation your office or any other agency involved in the
investigation may need.
