MIAMI BEACH MARINA I SEWER MAIN BREAK

On Friday, June 23, 2000, we received the attached Subpoena Duces Tecum from the Miami-Dade
County Office of the Inspector General. Please be advised that we were already in the process of
preparing items number two and three for submission, not only to the Inspector General's Office,
but also to the Office of the State Attorney, Katherine Fernandez Rundle, in anticipation of a
criminal investigation into the events surrounding the above-referenced sewer main break. We will
be submitting the documentation in connection with items number two and three in compliance with
the Subpoena on the date hereof. Items number one and five are redundant, and we will be preparing
those items for submission on either Tuesday or Wednesday. Items number one and five refer to the
sublease of the wetlands area of the Marina and the lease of the uplands area of the Marina to Miami
Beach Marina Associates. The remaining item, item number four, has been referred to Phil Azan
in the Building Department to be researched.
It is our intention to have complied fully with the Subpoena by no later than the close of business
on Wednesday, June 28. If you have any questions regarding the Subpoena or any other aspect of
the sewer main break, please do not hesitate to contact me.

.. YOU ARE COMMANDED to appear at the Office of the Inspector General, 19
W. Flagler Street, Suite 220, in Miami, Florida, (305) 579-2594, forthwith on Julv 3'd .
2000. at 10:00 a.m./p.m. and to have with you at that time and place the following:
1) Copy of current contract(s) between the City of Miami Beach, including any of its
agencies, for the facilities management, administration, and improvement of the
Miami Beach Marina.
2) Copy of any and all permit applications (including design drawings, surveys,
specifications, and details) on file with the City of Miami Beach, including any of
its agencies, pertaining to improvements to be installed at Pier M of the Miami
Beach Marina (Phase 1 and Phase 2 of construction).
3) Copy of any permits issued (in whole or in part) by the City of Miami Beach,
including any of its agencies, for any improvements to be installed at Pier M of
the Miami Beach Marina (Phase 1 and Phase 2 of construction).
4) Copy of check or other form of payment evidencing payment by the contractor to
the City of Miami Beach, including any of its agencies, for issuance of a permit
for improvements to be installed at Pier M of the Miami Beach Marina.
5) Copy of any lease and/or sublease between the City of Miami Beach and any
other entity, including the State of Florida. for use and enjoyment of the
submerged lands known as the Miami Beach Marina.
These items will be inspected and may be copied at that time. You will not be required to
surrender the original items. You may comply with the subpoena by providing the items

directly to the Office of the Inspector General prior to the date cited above and thereby
eliminate your appearance at the time and place specified above.
If you fail to (1) appear as specified; or (2) furnish the records instead of appearing as

subpoenaed to appear by the Inspector General and unless excused by the Inspector
General, you shall respond to the subpoena as directed.
