2000-24095 RESO RESOLUTION NO. 2000-24095 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE CURRENT PROFESSIONAL SERVICES AGREEMENT WITH THE FIRM OF BERMELLO, AJAMIL AND PARTNERS, INC., IN THE AMOUNT OF $37,000 FOR THE PROVISION OF ADDITIONAL ARCHITECTURAL, ENGINEERING AND LANDSCAPE ARCHITECTURAL SERVICES TO COMPLETE THE DESIGN, CONSTRUCTION DOCUMENTATION, CONSTRUCTION ADMINISTRATION, AND TO DEVELOP SPECIFICATIONS FOR THE NORTH SHORE PARK AND YOUTH CENTER PROJECT; AND AUTHORIZING THE ALLOCATION OF FUNDS IN THE TOTAL AMOUNT OF $37,000 INCLUDED IN THE FOLLOWING PREVIOUSLY APPROPRIATED FUNDS: $7,000 FROM THE FLORIDA RECREATION DEVELOPMENT ASSISTANCE PROGRAM (FRDAP) GRANT, AND $30,000 FROM THE $15 MILLION GENERAL OBLIGATION PARK BOND FOR THE IMPROVEMENTS OF THE NORTH SHORE PARK AND YOUTH CENTER, FUND NO. 370-2158-069358. WHEREAS, on January 16, 1997, the City entered into a Professional Services Agreement with the architectural firm of Bermello, Ajamil and Partners, Inc., to develop design, construction documentation, specifications, and to provide construction administration for the North Shore Park and Youth Center project; and WHEREAS, on November 2,1999, the citizens of Miami Beach voted $1,350,000 from the 1999 General Obligation Bond as supplementary funds for proposed construction at North Shore Park and Youth Center; and moreover, on June 21, 2000, a grant award notification, in the amount of $100,000, was received by the City from the Florida Recreation Development Assistance Program (FRDAP), for the additional improvements to the aforementioned project; and WHEREAS, as the result of the infusion of these new funds, the users' inputs were sought and substantial changes to the existing drawings were requested; and WHEREAS, these users' request for programmatic changes was reviewed and validated by City staff and the consultant; and WHEREAS, the Parks and Recreational Facilities Advisory Board voted unanimously, on September 6, 2000 to support such changes as well as the request for additional services that it generated; and WHEREAS, these facts were verbally reported to the General Obligation Bond Oversight Committee on September 11, 2000; and NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Commission approve and authorize the Mayor and City Clerk to execute an Amendment to the current Professional Services Agreement with the firm ofBermello, Ajamil and Partners, Inc., in the amount of $37,000 for the provision of additional services to complete the design, construction documentation and to develop specifications for the North Shore Park and Youth Center project; and authorizing the allocation of funds in the total amount of $37,000 included in the following previously appropriated funds: $7,000 from the Florida Recreation Development Assistance Program (FRDAP) Grant,; and $30,000 from the $15 Million General Obligation Park Bond for the improvements of the North Shore Park and Youth Center, Fund No. 370-2158-069358. ADMINISTRATION RECOMMEND A TION: Adopt the Resolution. FUNDING: Total funding of $37,000 is available as follows: $7,000 from the previously appropriated $100,000 Florida Recreation Development Assistance Program (FRDAP) Grant; and $30,000 from the $15 Million General Obligation Park Bond for the improvements of the North Shore Park and Youth Center, Fund No.370-2158-069358. ANALYSIS: On July 16, 1997, the City entered into a Professional Services Agreement with the architectural firm AGENDA ITEM Cl K DATE.9- 2-7-00 of Bermello, Ajamil and Partners, Inc., to develop design, construction documentation, specifications, and to provide construction administration for five (5) projects of the Park Bond Master Plan, including the North Shore Park and Youth Center. The North Shore Park project was extensively reviewed by the public, throughout the design process. To accomplish this goal, several public workshops, presentations, and Committees' meetings were held throughout the planning, programming and design phases. Subsequently, the construction documentation reached a 95% level of completion. 1. On November 2,1999, the public voted an additional $1,350,000 to supplement the original Park General Obligation Bond fund for the North Shore Park and Youth Center project. The infusion of this and other funding to the project's original budget would result in revisions and additions to the previously approved architectural program. Therefore, the users' inputs were sought, and a series of meetings were held: . On February 29 and April 13, 2000, community workshops were held at the North Shore Park. . On March 30, April 5 and May 11, 2000, presentations were made to the North Beach Youth Center Oversight Committee. . On May 4, 2000, a presentation was made to the Parks and Recreational Facilities Advisory Board. The public requested several modifications to the existing site plan. These requests were examined by both the Administration and the consultant, and the following enhancements resulted: a. Replacement of two (2) clay (Hydro) courts with hard surface courts. No additional construction cost is associated with this change. b. Elimination of existing on-site parking spaces and introduction of one (1) outdoor fenced basketball court on the southwest end of the park. The estimated differential construction cost for this addition is $25,000. c. The relocation of the proposed playground and the consolidation of the concession building, the field house, and the restroom building as one detached facility in the southwest portion of the park were also requested. The estimated differential construction cost for this modification is $225,000. The accommodation of these revisions will require modification to several drawings and an equal amount of coordination between all disciplines. As a result, the Administration believes the consultant's request for additional services to be reasonable, and is hereby requesting authorization from the Commission to increase Bermello, Ajamil and Partners' contract for an additional $30,000 (Attachment). The Parks and Recreational Facilities Advisory Board voted unanimously, on September 6, 2000 to support the aforementioned modifications. The differential costs for the additional construction, and the required A&E additional services fee associated with these changes will both be financed from the current construction contingency fund which represents 20% of the actual construction budget. 2. On June 21, 2000, notification of a grant award from the Florida Recreation Development Assistance Program (FRDAP) in the amount of $100,000, was received by the City, for the improvement of the North Shore Park and Youth Center project. In light of the availability of this new fund, Bermello, Ajamil and Partners will now design for the added construction dollars. Therefore, the consultant's contract must be amended to reflect an extra $7,000 in additional fees for professional services. This amount represents the previously approved design fee of 7% of construction cost. . Construction Documentation is scheduled to be completed in October 2000 and Bid Award is estimated to be made in December 2000. The Administration recommends the adoption of the attached Resolution.
