2000-24096 RESO RESOLUTION NO. 2000-24096 A RESOLUTION OF THE MAYOR AND CITY COMMISSION SETTING A PUBLIC HEARING ON OCTOBER 18, 2000, TO CONSIDER A LEASE AGREEMENT WITH MIAMI-DADE COUNTY PUBLIC SCHOOLS FOR THE LEASE OF 75 PARKING SPACES ADJACENT TO NORTH BEACH ELEMENTARY, LOCATED AT 4100 PRAIRIE AVENUE, INCLUDING THE PROPOSED WAIVER OF THE COMPETITIVE BIDDING AND APPRAISAL REQUIREMENTS, AS SET FORTH IN SECTION 82-39 OF THE MIAMI BEACH CITY CODE. WHEREAS, North Beach Elementary is an elementary school within the Miami-Dade County Public School System, located at 4100 Prairie Avenue; and WHEREAS, in accordance with North Beach Elementary's expansion plans, Miami-Dade County Public Schools is requesting to enter into a long-term lease with the City, for the use of: . twenty four (24) dedicated metered parking spaces along 42nd Street; and . twenty four (24) dedicated parking spaces in the last row of the surface lot on 42nd Street; and . twenty seven (27) parking spaces in the 42nd Street parking garage; and WHEREAS, Section 82-39 of the Miami Beach City Code, governing the sale/lease of public property, provides for the waiver ofthe competitive bidding and appraisal requirement, by 517ths vote of the Mayor and City Commission, for leases of City land of more than five years, upon a finding by the Mayor and City Commission that the public interest would be served by waiving such conditions; and WHEREAS, the proposed Lease Agreement is for a term of five (5) years; and WHEREAS, the subject public hearing requires a fifteen (15) day advertised notice of public hearing, and to enable the Mayor and City Cornmission to hold the public hearing in a timely manner at its October 18, 2000 meeting, the Administration is requesting that the public hearing be set at this time. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission set a public hearing on October 18, 2000 to consider a Lease Agreement for the lease of75 parking spaces adjacent to North Beach Elementary, located at 4100 Prairie Avenue between the City of Miami Beach and Miami-Dade County Public Schools, including the proposed waiver of the competitive bidding and appraisal requirements set forth in Section 82-39 of the Miami Beach City Code. ADMINISTRATION RECOMMENDATION The Administration recornmends that the City Commission set the required public hearing for a time certain on October 18, 2000 for the proposed waiver of competitive bidding and appraisal requirement set forth in Section 82-39 ofthe Miami Beach City Code. ANALYSIS North Beach Elementary is an elementary school within the Miami-Dade County Public School System, located at 4100 Prarie Avenue.
