95-21455 RESO Incomplete RESOLUTION NO, 95-21455 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING A DONATION FROM REEBOK CORPORATION FOR THE RENOVATION OF THREE (3) BASKETBALL COURTS AT FLAMINGO PARK, VALUED AT AN ESTIMATED $10,000, SUBJECT TO THE NEGOTIATION OF AN AGREEMENT BETWEEN THE PARTIES GOVERNING THE TERMS AND CONDITIONS OF THE DONATION, WHEREAS, The Reebok Corporation (Reebok), via the Bureau of Children's Affairs, has expressed an interest in supporting the youth of the Miami Beach Community by renovating three(3) basketball courts at Flamingo Park; and WHEREAS, this service will be donated to the City of Miami Beach free of charge; and WHEREAS, acceptance of this donation is subject to the negotiation of an agreement between the parties for the terms and conditions of the donation. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, as follows: 1. The Donation from Reebok Corporation for the renovation of three (3) basketball courts at Flamingo Park, valued at an estimated $10,000, is hereby accepted subject to the negotiation of an agreement between the City and Reebok governing the terms and conditions of the donation. 2. The Mayor and City Clerk are herein authorized to execute the Agreement between the parties for the terms and conditions of the donation when negotiated. ADMINISTRATION RECOMMENDATION: The Administration recommends that the Mayor and City commission adopt the attached resolution accepting a donation from Reebok Corporation for the renovation of three (3) basketball courts at Flamingo Park. This acceptance is subject to the negotiation of an agreement between the parties governing the terms and conditions of the donation, BACKGROUND: At the December 7, 1994 Commission meeting Mr. Leonard Turkel, on behalf of the Bureau of Children's Affairs, presented a proposal for a joint venture between the City of Miami Beach and Reebok Corporation to initiate a 3 ON 3 Junior Basketball League. The primary objective of the Reebok Corporation was to, at their expense, renovate the two full size courts near the Flamingo Park racquetball facility and one small court adjacent to the PAL building, The proposal was positively received by the Commission and the Administration was instructed to proceed, taking the necessary steps to both accept the generous offer from the Reebok corporation and initiate the Youth League. On December 20, 1994 Mr. Turkel met with Kevin smith to discuss the proposal in greater detail. It was determined that an agreement will be prepared by the City of Miami Beach to be entered in~o between Reebok Corporation and the City to refurbish the two full 416 sized courts near the racquetball facility and one small court adjacent to the PAL building. These courts will be for use by the AGENDA ITEM ~ -1- ~ DATE~ participants of the 3 ON 3 League as well as the entire community, It was the recommendation of the Legal Department that this agreement include all necessary terms and conditions. The agreement, when negotiated, will clearly delineate issues such as liability and courts maintenance responsibilities, logo recognition, period of time the agreement will be in effect, etc. A representative from Reebok is scheduled to be in Miami Beach the week of January 1, 1995 and it is expected this matter will be resolved at that time. It should be noted that Reebok Corporation has assisted other communities throughout the Country in restoring or building new basketball courts. Attached for your information is a copy of a correspondence that the City of Miami's Downtown Development Authority agreed to with Reebok to build a new basketball court in downtown Miami. It was originally the desire of the Reebok Corporation to have a dedication of the refurbished courts during Super Bowl Week, However, if this is not feasible it will be recommended to Reebok that a "ground breaking" ceremony be hosted at Flamingo Park to formally commence the project during Super Bowl week. ANALYSIS: The offer to have the three (3) courts at Flamingo Park renovated, at no cost to the City, is an opportunity that is welcomed. The improved recreational facilities will benefit the youth of the community and better enable the implementation of the 3 ON 3 Basketball League It is important the agreement, when negotiated, clearly define the terms including but not limited to liability issues, maintenance responsibilities, length of the agreement and conditions under which the agreement may be extended or terminated. CONCLUSION: The Administration recommends that the City Commission adopt the attached resolution accepting a donation from Reebok Corporation, subject to the negotiation of an agreement between the parties governing the time and conditions of the donation.
