2000-24116 RESO RESOLUTION NO. 2000-24116 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A FIRST READING PUBLIC HEARING TO CONSIDER A PROPOSED AMENDMENT TO THE THE OFFICIAL ZONING MAP CONSISTING OF: Designation of Proposed Collins Waterfront Historic District An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending Subpart B of the Land Development Regulations of the City Code; Amending Article X, Entitled "Historic Preservation"; Amending Division 4, Entitled "Designation"; Amending Section 118-593, Entitled "Historic Preservation Designation"; Amending Subsection I 18-593(e), Entitled "Delineation on Zoning Map" by Designating the Collins Waterfront Historic District, Consisting of a Certain Area Which Is Bounded on the East by the Erosion Control Line of the Atlantic Ocean Between 22nd Street and the Approved Relocation of 44th Street; on the North by the Approved Relocation of 44th Street from the Erosion Control Line of the Atlantic Ocean to the West Bank of Indian Creek; on the West by the West Bank ofIndian Creek from the Approved Relocation of 44th Street to the Extended Centerline of 25th Street; Then the Boundary Runs Westward along the Extended Centerline of 25th Street from the West Bank of Lake Pancoast to Pinetree Drive; Then Extends along the Centerline of Pine tree Drive from 25th Street to 23rd Street (Excluding the 23rd Street Bridge over the Collins Canal); and Then Eastward along the Northeastern Boundary of the National Register Architectural District from 23rd Street and Partly 22nd Street to the Erosion Control Line of the Atlantic Ocean, as More Particularly Described Herein; Providing That the City's Zoning Map Shall Be Amended to Include the Collins Waterfront Historic District; Adopting the Designation Report Attached Hereto as Appendix "A"; Providing for Inclusion in the Land Development Regulations of the City Code, Repealer, Severability, and an Effective Date. WHEREAS, the above amending ordinance to the City's Official Zoning Map designating the Collins Waterfront Historic District was referred to the Miami Beach Planning Board by the Historic Preservation Board, and the Planning Board having considered the ordinance at its September 26, 2000 meeting; and WHEREAS, pursuant to Section 118-164 of the Code of the City of Miami Beach, Florida, in cases in which the actual list of permitted, conditional or prohibited uses within a zoning category, or a change to the actual zoning map designation for a parcel or parcels ofland is proposed, the City Commission shall provide for public notice and hearings by holding two advertised public hearings on the proposed ordinance, at least one hearing held after 5:00 p.m. on a weekday; and WHEREAS, in order to enable the City Commission to hold the required public hearing in a timely manner on first reading at its November 8, 2000 meeting, the Administration is requesting that the public hearing be set at this time; NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a first reading public hearing to consider an amendment to the City's Official Zoning Map designating the proposed Collins Waterfront Historic District, is hereby scheduled on Wednesday, November 8, 2000 at 5:20 p.m., in the City Commission Chambers at 1700 Convention Center Drive, Miami Beach, Florida, and the City Clerk is hereby authorized and directed to publish and distribute the appropriate public notice of said public hearing at which time all interested parties will be heard. WHEREAS, on August 10, 2000, the City's Historic Preservation Board held a public hearing and voted unanimously (5-0; 2 absences) in favor of recommending that the City Commission designate the Collins Waterfront Historic District; and WHEREAS, on August 22, public hearing and voted designation; and 2000, the City's Planning Board held a (__ __) in favor of the proposed WHEREAS, the City of Miami Beach Planning Department has recommended this amendment to the Land Development Regulations of the City Code; and WHEREAS, these recommendations of approval for the designation of the Collins Waterfront Historic District were based upon the information documented in the Designation Report prepared by the City of Miami Beach Planning Department attached hereto as Appendix "A. II NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. DESIGNATION OF THE COLLINS WATERFRONT HISTORIC DISTRICT. Those certain areas which are bounded on the east by the erosion control line of the Atlantic Ocean between 22nd Street and 44th Street; on the north by 44th Street from the erosion control line of the Atlantic Ocean to the west bank of Indian Creek: on the west by the west bank of Indian Creek from 44th Street to the extended centerline of 25th Street: then the boundary runs westward along the extended centerline of 25th Street from the west bank of Lake Pancoast to Pinetree Drive: then extends along the centerline of Pinetree Drive from 25th Street to 23rd Street (excluding the 23rd Street Bridge over the Collins Canal); and then eastward along the northeastern boundary of the National Register Architectural District from 23rd Street and partly 22nd Street to the erosion control line of the Atlantic Ocean; and having the legal description as described herein, are hereby designated as an Historic District of the City of Miami Beach and shall be known as the "Collins Waterfront Historic District." That the Designation 2 Report attached hereto as Appendix "A" is hereby adopted. SECTION 2. AMENDMENT OF SUBSECTION 11S-593(E). That Subsection (e), entitled "Delineation on Zoning Map," of Section 118-593, entitled "Historic Preservation Designation," of Division 4, entitled "Designation," of Article X, entitled "Historic Preservation," of Chapter 118, entitled "Administration and Review Procedures," of Subpart B of the Land Development Regulations of the City Code is hereby amended to read as follows: * * * Subpart B. It is the intention of the City Commission, and it is hereby ordained that the provisions of this ordinance shall become and be made part of the Land Development Regulations of the Code of the City of Miami Beach as amended: and that the sections of this Ordinance may be renumbered or relettered to accomplish such intention. SECTION 4. AMENDMENT OF ZONING MAP. That the Mayor and City Commission hereby amend the Zoning Map of the City of Miami Beach as contained in the Land Development Regulations of the City Code by identifying the area described herein as HPD-9, Historic Preservation District Nine. SECTION 5. REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 6. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. 7 SECTION 7. EFFECTIVE DATE. This Ordinance shall take effect on the , 2000. ADMINISTRATION RECOMMENDATION The Administration recommends that the City Commission set the required public hearing for a time certain on November 8, 2000 at 5:20 p.m. for this proposed amendment to the Official Zoning Map. ANALYSIS At its May 4,1998, meeting, the City of Miami Beach Historic Preservation Board directed staff to proceed with research and prepare a preliminary evaluation and recommendation relative to identifying and proposing historic designation protection to areas, sites, and structures along the Collins Avenue corridor north of the National Register Historic District. Following public input, on August 10,2000 and September 8, 2000 the Historic Preservation Board determined that the proposed district meets the required criteria and transmitted the recommendation for historic designation to the Planning Board. The Planning Board reviewed the designation report and voted to recommend approval with the condition that a companion ordinance be prepared addressing development regulations in the proposed district. That companion ordinance is being prepared and will be presented to the Commission concurrently with the public hearing for the designation. The subject amendment requires an advertised notice of public hearing. Therefore, to enable the City Commission to hold the public hearing on the proposed amendment in a timely manner at its November 8, 2000 meeting, the Administration is requesting that the public hearing be set at this time.
