WHEREAS, operational expenses have increased over the previous fifteen years
without corresponding increases in revenue; and
WHEREAS, according to the Consumer Price Index for water and sewer maintenance,
operating costs for the period October 1996 through October 2006 have increased 47% ;and
WHEREAS, with ongoing drought restrictions, the City anticipates a continuation of its
current 18% decrease in water consumption and its corresponding decrease in water and sewer
revenue; and
WHEREAS, new fees are being established to offset operational expenses for field
visits, meter tampering, meter rereads, meter tests, turn-on requests, and lien search requests;
and
WHEREAS, the existing fee for service disconnect is being increased to reflect actual
costs being incurred by the City.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, as follows:
SECTION 1.
That Chapter 110 of the Miami Beach City Code is hereby amended as follows:
Chapter 110.
Utilities
Article 11. Water
Division 1. Generally
Sec. 110-39. Metered water supply service.
(e) All meters shall be carefully tested before they are installed, and after their installation
they shall be tested as frequently as circumstances seem to the public works department to
warrant. Should the owner question the accuracy of the meter on his service, the public works
department shall, once per consecutive 12 months upon his written application, accompanied
with a payment e€$~-AA as specified in Appendix A for each meter in question, to defray the
cost of test thereof, remove the meter and test it in the presence of the owner or his authorized
agent, if such presence is desired by the owner. If the test shows that the meter has been over-
registering (positive result) more than two percent, the $~99 pavment as specified in Appendix
A for each meter so paid shall be returned to the owner, and the bill rendered, based on the last
reading of such meter, shall be corrected accordingly. If the test shows that the meter is not
over-registering more than two percent as aforesaid (negative result) the $~98 pavment as
specified in Appendix A paid by the owner shall be retained by the public works department and
in addition thereto, if the test shows that the meter has been under-registering more than two
percent, the bill rendered, based on the last reading of such meter, shall be corrected
accordingly. The public works department reserves the right to remove and test any meter at
any time, and if such meter is found to be inaccurate, to substitute another meter of the same
size in its place, either permanently or temporarily. In the event of such test as last mentioned,
the public works department further reserves the right to make any correction in the bill
rendered based on the last reading of such meter, in accordance with the result of such test. If a
second request for an accuracy test is submitted within a 12-month period there shall be a
$~A:99 pavment as specified in Appendix A application fee, which will be refunded if the test
results are positive. No refunds will be granted where negative test results are found. The test
procedures described in this section shall be followed on all retests with the only variance being
the application fee.
(g) The owner of or consumer at every premises shall pay to the public works department
the sum e~$~~9 as specified in Appendix A for each meter for each time the seal on any
meter or its couplings on or for such premises is found broken or removed, the public works
department hereby reserving the right to put on such seals in or for any premises at any time;

Sec. 110-42. Turning on and shutting off.
(b) A violation of subsection (a) of this section upon the part of the owner, his employees or
agents, shall subject the owner or consumer to a penalty e~$~89 as specified in Appendix A

Sec. 110-43. Leaks and waste.
(c) Whenever the water supply to and for any premises has been shut off because of
leaks or waste, as provided in this section, the same shall not be turned on again until all
causes for shutoff shall have been remedied or removed, and until satisfactory assurance shall
be given to the public works department that the condition causing the shutoff will not again
exist by the owner, his agent or tenant, and the sum s~$~99 as specified in Appendix A shall
have been paid to the city cashier in the utility billing office to cover the cost of again turning on
such water supply.
Article IV, Fees, Charges, Rates and Billing Procedure
Division 2. Rates, Fees and Charges
Sec. 110-166. Schedule of water rates and tapping.
(f) A reauest by the owner or consumer to have the water meter re-read for validation of
the correctness of a meter reading will result in a fee in accordance with the schedule set forth
in Appendix A This fee will be charged only if the re-read validates the accuracy of the reading
in question.
(q) A request by the owner or consumer to have a special water meter read at a time other
than a normally scheduled read date as set by the utility will result in a fee in accordance with
the schedule set forth in Appendix A.
(h) Meter/Meter equipment and City of Miami Beach utility property servicing a premise
found damaged destroyed or missing will be charged to the owner or consumer in accordance
with the schedule set forth in Appendix A.
(i) A request by the owner or consumer to have a field visit by a technician. This fee will
be charged only if the technician finds that the problem/issue is not that of the utility.
Division 3. Billing Procedures
Sec. 110-192. Delinquent accounts; payment of collection costs and attorney fees;
creation of liens.
(b) A delinquent accounts, including metered water supply, sewer and/or stormwater utility
service, shall be discontinued and the water supply shut off from and to the premises of the
owner or consumer from whom such account is in arrears, in accordance with the provisions
contained in section 110-191(g), regardless of the status of the owners' other accounts. A
disconnect charge as specified in Appendix A shall be assessed against such consumer or
customer.

SECTION 3. CODIFICATION
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it
is hereby ordained that the provisions of this ordinance shall become and be made part of the
Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or
re-lettered to accomplish such intention, and the word "ordinance" may be changed to "section",
"article" or other appropriate word.
SECTION 4. REPEALER
All ordinances or parts of ordinances in conflict herewith are and the same are hereby
repealed.
SECTION 5. SEVERABILITY
If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for
any reason, held invalid or unconstitutional, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the validity or constitutional, such
portion shall be deemed a separate, distinct and independent provision and such holding shall
not affect the validity or constitutionality of the remaining portions of this Ordinance.
SECTION 6. EFFECTIVE DATE
This Ordinance shall take effect on the 1St day of October, 2007.

The City's utility rates are structured to collect the necessary amounts to meet operating and maintenance costs, debt
service for water and sewer bonds; and other rates assessed by the County. Increasing the water and sewer rates to
pay the costs listed above will keep the City water and sewer funds balanced.
In reviewing the projected water and sewer revenues and costs for the water and sewer fund, it is necessary to raise
the rates in FY08 to keep the water and sewer funds balanced. More specifically, the proposed water rate will be
$3.23 per thousand gallons, which reflects an increase of $0.44 per thousand gallons, or a 16% increase, which will
result in generating revenue in the amount of $3,052,424. The proposed sewer rate will be $4.93 per thousand
gallons which reflects an increase of $0.68 per thousand gallons or a 16% increase, which will result in generating
revenue in the amount of $3,626,536. The proposed rate increases are needed to cover a decrease in revenue due to
an assumption of a 10% decrease in consumption in FY08 and to cover multi-year operation and maintenance cost
increases over the past fifteen (15) years. Between April 2007 and August 2007 consumption decreases associated
with the drought and water restrictions have varied monthly between 27% and 10% as compared to the prior year.
Water consumption and treatment rates will be monitored and reported to the Commission monthly. If consumption
rates dip to levels experienced this summer, additional rate increases may be necessary. It is important to note that
since FY95/96, the only increase to the water and sewer rates have been increases in either the County's wholesale
rates or for debt service increases -and the prior increase related to operational costs was a 3% increase in 1992.
New fees are also being established to curb the current growth in illegal meter reconnections and meter tampering,
and offset the operational expenses for conducting the follow-up tasks such as field visits for unauthorized turn-ons
and meter tampering, meter tests, etc.

ANALYSIS
In general, the rates for water supply and sanitary sewer services consist of apass-through
of the wholesale rate the City pays to the Miami-Dade for the purchase of potable water
and treatment of sewage; debt service for the Series 2000 Water and Sewer Revenue
bonds and the 2006 Gulf Breeze Loan; operating and maintenance costs forthe water and
sewer utility; and a 7.5% fee paid to the Miami-Dade County Environmental Resource
Management Department (DERM).
The City's utility rates are structured to collect the necessary amounts to meet operating
and maintenance costs, debt service for water and sewer bonds; and other fees assessed
by the County. Increasing the water and sewer rates in the amounts levied by the County
and to pay all other costs listed above will keep the City water and sewer funds balanced.
The City of Miami Beach began experiencing a significant decrease in water consumption
with the implementation of water restrictions in April, 2007. Between April and July 2007,
water purchased from Miami-Dade County decreased an average of 18%, with equivalent
decreases in water and sewer revenues, with decreases varying between 27% and 10%
per month. Given the information available, the Proposed Work Plan and Budget
assumed that the 18% would continue through the entire FY 2007/08, a conservative
approach based on current drought conditions. August data, available since the release
of the proposed budget, showed a decline of only 10% in water purchased from Miami-
Dade County. As a result, the proposed fee increases for water and sewer have been
decreased to reflect a revised assumption that the decrease in water consumption will be
10%.
However, this revision must be monitored closely. While I am being cautious in how
conservative we are in projecting reductions in consumption, the reality is that the
decreases are too recent to allow for any certainty. I am therefore also recommending
that the water consumption and treatment rates be monitored and reported to the
Commission monthly. If consumption rates dip to levels experienced this summer,
additional rate increases may be necessary.
FISCAL IMPACT
The proposed rate increases are needed to cover a decrease in revenue due to the
projected 10% decrease in consumption in FY07 which is expected to continue in FY08
and to cover multi-year operation and maintenance cost increases over the past fifteen
(15) years. It is important to note that since FY95/96, the only increase to the water and
sewer rates have been to pay for either the County's wholesale rates increases or for
debt service increases. The last increase related to operational costs was a 3% increase
in 1992. Since 1996, all operational expenditure increases related to cost of living
adjustments to salaries, increased costs of health insurance and pension, and increases
in other operating costs have been absorbed without rate increases. In comparison,
between October 1996 and October 2006, operational costs forwater and sewer systems

As an operational improvement, new fees are being established to curb the current growth
in illegal meter reconnection and meter tampering and offset the operational expenses for
conducting tasks such as field visits, meter tampering, meter re-reads, meter tests, and
unauthorized turn-ons. The fees are only charged forviolation of utility policies, ordamage
to utility infrastructure (meters and service lines), and are not intended to be a revenue
generator. If the utility is found to be in error in any investigation (ex. re-read) or service
(ex. meter test), no charges will be assessed to the customer. The existing fee for service
disconnection is being increased to reflect actual costs being incurred by the City. The
rationale for the proposed fees is a standard that is well established for public water and
sewer utilities to deter recurring abuse of the utility billing system and/or theft of the public
water supply service. It is essential to the enterprise fund that safeguarding of revenues for
services provided is addressed by establishing these protective measures. The
recommended fees are based on surveys conducted of neighboring cities as well as both
Dade and Broward Counties.
The proposed water and sewer rate increases will add an additional $12.32 per month to a
typical Miami Beach family (11,000 gallons per month) residential bill effective October 1,
2007. The new combined rate will increase the water and sewer bill by approximately
sixteen (16) percent.
CONCLUSION
The Administration recommends approving the amendment to the Ordinance on the
second reading public hearing.
