SUBJECT: Corrective action regarding a Department of Code Compliance lien on the
property located at 337 Lincoln Road.
LIEN AMT: $294,181.94 CORRECTED AMT: $5,000.00
On November 27, 2000 the City and the Department of Code Compliance entered into an agreement
with Mr. Hertry Bergman (Agent for the Owner) on behalf of Molly Stein (Owner) concerning a lien
on the property located at 337 Lincoln Road.
The fines associated with this case currently total $294,181.94. A daily fine of $75.00 was imposed
per day on September 11, 1996 by the Special Master and stopped accruing on October 24, 1996,
The fine at that time totalled $3,225.00. In addition, a daily fine of $175.00 began accruing on April
1, 1997. The owner presented evidence which indicated that there may have been compliance on
April 14, 1997. This was based on a copy of a contract for tile and painting work at the property and
a final inspection on a renovation permit which referenced the tile work.
The Department of Code Compliance and the Agent for the Owner have agreed on a compliance date
of April 14, 1997. The Code Compliance Department has no evidence to contradict this matter.
This would equal a fine of $2,450.00, since compliance was required by April 1, 1997 (14 days at
$175.00 per day). Based on a compliance date of April 14, 1997 this fine added to the existing fine
of $3,225.00 totals $5,675.00. Of the $5,675.00, the property owner agreed to pay $5,000,00.
Accordingly, the Special Master has corrected records to reflect the compliance date of April 14,
1997 and as such the Special Master has accepted payment of $5,000.00.
