Gonzalez \.A~ City Manager 0"'- 0 SUBJECT: SIDEWALK CAFE ORDINANCE - COMPLIANCE WITH UMBRELLA AND PLANTER CRITERIA (OCTOBER 18, 2000 CITY COMMISSION DISCUSSION) In an effort to ensure compliance and minimize hardships, I have instructed the Code Compliance Department to grant time extensions to all sidewalk cafe operators cited for violations related to umbrellas and planters. The Code Compliance Department will initiate enforcement action if these violations are not corrected by April I, 200 I which is 12 months from the date of the original Ordinance revision. (The Department has indicated that five locations on Lincoln Road remain in violation of this section of the Ordinance, and six locations on Ocean Drive). This extension ohime should enable each operator ample time to correct the violations associated with their planters and umbrellas which do not meet the current code. I have attached a time line reviewing the codification and implementation of the Sidewalk Cafe Ordinance. April, 2000 - Code Compliance hand delivered copy of Adopted Ordinance to every cafe operator, advised that inspections would begin one month later. Further advised that if! violations are found, a 30 day "Warning Notice" would be issued. : 1 May 12-23, 2000 - Every sidewalk cafe visited and every business advised that if additional: time was needed to comply with the Ordinance, it would be granted. i June 23, 2000 - The Department began to issue fines to those cafes who had NOT complied! and had not requested additional time.
