96-21968 RESO RESOLUTION No. 96-21968 A RESOLUTION OF THE KAYOR AND CITY COMMISSION OF THE CITY OF KIAMI BEACH, FLORIDA, ADOPTING THE FIFTH AMENDKENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1995/96, IN THE AMOUNT OF $197,555, TO BE FUNDED FROK THE PROCEEDS OF CONFISCATED FUNDS ($30,127 FROK STATE FUNDS AND $167,428 FROK FEDERAL FUNDS) WHEREAS, section 932.705, Florida Statutes, addresses the purposes and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for expenditures and appropriation exists and the expenditure or appropriation of forfeiture funds is in compliance with Section 932.705, Florida Statutes, and with Federal guidelines; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE KAYOR AND CITY COMMISSION OF THE CITY OF KIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopt the Fifth Amendment to the 95/96 Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $197,555, as reflected in the attached Exhibit "A". These young adults are known as "Police Explorers". The Explorers get a "hands on" experience concerning law enforcement through their many functions, some of which include traffic control, accident investigation, crime prevention, security, field interrogation and arrest procedures. Explorers also participate actively in routine police patrol. The Explorers assist the City of Miami Beach and the Police Department in many ways. They work in the Detective Bureau, Crime Scene, Communication Bureau, Records Bureau, Crime Prevention and Patrol Division. In addition they are involved in anti-auto theft crime prevention programs, clean-a-thons that helped to keep Miami Beach beautiful. ENVIRO-COP AND MENTORS 8,577 This is a program that not only deals with keeping the environment clean but teaches the students safety in other areas such as drug prevention, graffiti, gun and personal safety and self-esteem programs, etc.(A Pilot program at Biscayne Elementary School taught by the School Resource Officer assigned to Biscayne Elementary to grades one through four). BUS SHELTER ADVERTISEMENTS $1,200 These general advertisements are a first phase in alerting the general public of Miami Beach of the services of the Domestic Violence Unit (The advertising agency is donating the shelters. This fee will pay for artwork and installation at the bus shelters). DONATION TO THE MIAMI BEACH SENIOR mGH SCHOOL $350 for a YearBook ad promoting Police and High School Students relationship SUB-TOTAL FOR STATE FUNDS $30,127 FEDERAL FUNDS: AUDIT TO FEDERALLY FORFEITED FUNDS $1,828 Independent audit performed by the Internal Audit Unit of the CMB required by the U. SUBJECT: The Administration requests authorization to adopt the Fifth Amendment to the operating Budget for the Police Confiscation Trust Fund for FY95/96 in the amount of $197,555 ($30,127 from state Confiscated funds and $167,428 from Federal confiscated funds) to be used to provide funds for the law enforcement expenditures listed in Exhibit "A". ADMI:HI:STRATION RECOYdENDATION Approval of the Resolution. BACKGROUND Expenditure of forfeiture funds for law enforcement purposes under the federal guidelines is a proper expenditure. Florida Statute 932.705 provides for, but is not limited to, expenditure of forfeiture funds for crime prevention and other law enforcement purposes. The Chief of Police of the City of Miami Beach has determined that the need for expenditures and appropriation exist and the expenditure or appropriation of forfeiture funds is in compliance with Section 932.705, Florida statutes. CONCLUSION The proper procedure has been complied with in accordance with Florida state Statute 932.705. In accordance with Florida statute 932.705, forfeiture funds have been deposited in the Police Confiscation Trust Fund and all other statutory procedures have been complied with. Forfeiture funds have been collected pursuant to Asset Sharing Agreements with various Federal agencies pursuant to 18 USCA 981(e)2; 21 USCA ~81(e) (1) (A) and (e) (3); and/or 19 USCA 1616a and have been deposited in the Police confiscation Trust Account.
