A RESOLUTION OF THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,
AWARDING A CONTRACT, IN THE AMOUNT OF $2,639,780,
TO REGOSA ENGINEERING, INC., PURSUANT TO
INVITATION TO BID NO. 146-99/00, FOR THE
CONSTRUCTION OF THE FLAMINGO PARK POOL
FACILITY; COMPRISED OF THE PREVIOUSLY
APPROPRIATED $1,161,669 FROM THE $15 MILLION PARKS
GENERAL OBLIGATION (G.O.) BOND FUND NO. 370; $94,731,
FROM THE INTEREST EARNED FROM THE $15 MILLION

MANAGEMENT COSTS FROM THE $92 MILLION G. O.
BOND, SERIES 2000, FUND NO. 374.
WHEREAS, on October 2, 2000, Invitation to Bid No. 146-99/00 for the Flamingo Park
Pool Facility was issued; one-hundred and ninety-nine (199) vendors were notified, and eighteen (18)
requests for plans and specifications were received; and
WHEREAS, a pre-bid conference was conducted on October 12,2000; and
WHEREAS, on December 14, 2000, three (3) responsive bids were received by the City;
and
WHEREAS, the City's consultant, Carr Smith Corradino, evaluated the bids; and
WHEREAS, Regosa Engineering, Inc. was determined to be the lowest responsive and
responsible bidder; and
WHEREAS, funding, in the total amount of$2, 639,780, is available from the $15 Million
Park General Ob1igation(G.O.) Bond Fund No. 370; the $15 Million Parks G. O. Bond Interest Fund
No 370; the Miami-Dade County Safe Neighborhood Parks Bond Fund No. 371, the $92 Million
G. O. Bond Fund No. 374; and the Capital Projects Bond Fund No 366; and
WHEREAS, the Administration herein requests that the Mayor and City Commission
approve the award of the bid, and authorize the Mayor and City Clerk to execute a contract with
Regosa Engineering, Inc., in the amount of $2,639,780, for the construction of the Flamingo Park
Pool Facility.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Commission hereby authorize the Mayor and City Clerk to execute an Agreement between the City
and Regosa Engineering, Inc., in the amount of $2,639,780, pursuant to Invitation to Bid No. 146-
99/00, for the construction of the Flamingo Park Pool Facility; comprised of the previously appropriated
$1,161,669 from the $15 Million Parks General Obligation (G.O.) Bond Fund No. 370; $94,731, from
the interest eamed from the $15 Million Parks G. O. Bond Fund No. 370; $988,382 from the Miami-
Dade County Safe Neighborhood Parks Bond Fund No. 371; and $65,812 from the Capital Projects
Bond Fund No. 366; further appropriating a total of$341,902, comprised of$329,186 for construction
and $ 12,716 for Arts in Public Places and Public Works Construction Management costs from the $92
Million G. O. Bond, Series 2000 Fund No 374.

Dear Mr. Ellis,
Corradino has completed the bid review for the Flamingo Park Pool Facility Project. Upon our
review, the lowest qualified bidder is Regosa Engineering Inc. (Regosa), with a base bid of
$2,399,800.00 plus a contingency sum of $239,980.00. Therefore, the grand total adds up to
$2,637,780.00 (see-attached spreadsheet). The grand tolal sum given by Regosa is within the
initial constrUction budget assigned to this project.
Regosa has complied with all the requirements stated in the Bid documents. The key
subcontractor listed to perform the construCtion of the pools is Edwin M. Green (Green Pools).
Green Pools has completed several similar proj ects in the South Florida area. We believe that
Green Pools has the qualifications and experience to perform the scope of work show'Il on the
plans and specifications. Therefore, we are recommending award of contract to Regosa
Engineering Inc. for the Flanlingo Park Pool Facility projec!.

FLAMINGO PARK POOL
HISTORY OF SIGNIFICANT ACTION STEPS
. September 8, 1994, the City Commission approved Resolution 94-21284 calling for a
special election to be held on November 8, 1994, for the purpose of seeking the approval of
the electorate to issue General Obligation Bonds in a principal amount not to exceed $15
million to construct, renovate and rebuild parks and recreation facilities within the City's
park system. Included in this approval was $1,250,000 for the Flamingo Park pool
renovation.
. November 8,1994, the citizens of Miami Beach approved the issuance of$15 million in
general obligation bonds for park improvement including the Flamingo Park pool funding.
. March 3, 1995, a notice of Request for Letters of Interest (RFLI) was issued to 101
architectural firms seeking professional services for the Master Planning of Miscellaneous
Improvements at Various Sites included in the City's Parks and Recreation Bond Program.
As a result 39 specifications were mailed, resulting in five (5) responses at the bid opening
on March 30, 1995.
. May 8, 1995, all five (5) firms were invited to make oral presentations before a selection
committee which ultimately recommended Bermello, Ajamil & Partners, Inc.
. May 17, 1995, the City Commission authorized the Administration to enter into negotiations
for award of contract with Bermello, Ajamil & Partners, Inc.
. July 12, 1995, the Commission approved an agreement with Bermello, Ajamil & Partners,
Inc. to complete the Parks Master Plan.
. May, 1995 - June, 1996, the Administration and Bermello, Ajamil & Partners, Inc.,
conducted no less than seventy (70) public meetings with the community, various boards and
committees and the Commission intended to gain the information needed to develop the
Parks Master Plan. Included in this number were a minimum of 7 documented meetings
related to Flamingo Park and the pool specifically intended to gain community input as to
final facility designs.
. June 19, 1996, the Mayor and City Commission adopted the General Obligation Master Plan
for Improvements to the City's Parks and Recreation Facilities, including a new swimming
pool facility for Flamingo Park.
. October 1996 - July 1997, the City implemented the process to recruit, interview and select
architectural firms to design the parks projects included and approved in the Parks Bond
Program.
. July 16, 1997, the Commission approved a resolution approving and authorizing the
execution of agreements with the firms of Bermello, Ajamil & Partners, Inc., Carr Smith
Associates, and REG Architects, Inc. to provide professional architectural/engineering
services for the Parks Master Plan.
. July, 1997 - January, 1998, the three (3) selected architectural firms began the planning
and schematic design phases for the various projects and submitted preliminary design
development documents.
. January 21, 1998, the City Commission ratified the submission of four (4) grant
applications, in a total amount of $5,166,000, from the Miami-Dade County Safe
Neighborhood Parks Bond Program for the purpose of further improving parks as designated
in the Parks Master Plan. This included an additional $1 million for the Flamingo, Scott
Rakow Youth Center and Normandy Pools.
. May 20,1998, the City Commission accepted the Report of the Joint Meeting of the Finance
and Citywide Projectsl Neighborhoods Committees of May 8, 1998, including the approval
of the schematic designs and base bids estimates for the parks projects in the $15 Million
General Obligation Parks Improvements Program and the Miami-Dade County Safe
Neighborhood Parks Bond Program. This approval included an approved base bid
construction budget of $2,177 ,688 for the Flamingo Park and pool complex.
. May 25, 1998, Carr Smith Corradino, the project architects for the Flamingo Park Project,
submitted the required documents to the Planning Department to begin the design review
process as with the Design Review and Historic Preservation Boards.
. October 13, 1998, after presenting revisions as requested by the DRBIHP Boards at the 7/15
and 9/15 meetings, the Flamingo Park project was given approval by the joint Boards and
authorization to proceed.
. October 1998 - August 1999, the Flamingo Park architects completed the 100 %
construction documents for the pool, began to route the drawings through the permitting
process and were proceeding towards the bidding of the project.
. September 14,1999, the Mayor and Commission requested that discussion ofrenovations
of the swimming pools at Flamingo and Normandy Parks be discussed at the Commission
meeting, and that estimates of additional costs and recommendations for the widening of the
pools be presented for Commission consideration.
. September 17, 1999, per Commission Item R91 & 1., a discussion of the issue of the Issue
of the Renovations of the Swimming Pools at Flamingo and Normandy Parks took place. As
a result of this discussion the City Commission directed the Administration to take the
following actions: (I) Review the current proposal for Flamingo Park pool to include an
additional four swim lanes, (2) Include the cost of this enhancement, approximately
$400,000, in the proposed General Obligation Bond to be presented to the voting residents
on November 2, 1999, (3) Submit a proposal to the Miami-Dade County Safe Neighborhood
Parks Bond Program requesting an additional $400,000 for the Flamingo Park pool project
and develop a third alternative to finance the cost of the swimming pool expansion, (4)
Suggested that in the interim time period, the planning and design process for the additional
four lanes be started and (5) Proceed with the Normandy Isle Park pool as originally
presented.
. October 6, 1999, Status Report to City Commission via LTC 198.1999 reported on
additional swimming lanes for Flamingo Pool. The City Administration initiated the
following actions: (I) suspended work on the pool project until funding sources were
identified, (2) included $400,000 in the proposed General Obligation Bond to be presented
to voters on November 2, 1999, and (3) submitted a request for $400,000 to the Safe
Neighborhood Parks Oversight Committee on September 12, 1999. Subsequently, the Safe
Neighborhood Parks Oversight Committee stated that the City of Miami Beach should
request a matching grant for $200,000. The City applied for $200,000 on November 15,
1999 and was awarded $100,000 on December 6,1999.
. October 20, 1999, the City Commission Approved a Resolution Authorizing the City
Manager to Submit a Grant Application for Funding in the Amount of $400,000 from the
Miami-Dade County's Safe Neighborhood Parks Bond Program Interest Earnings for the
Purpose of Renovating Flamingo Pool; Appropriating the grant, if Approved and Accepted
by the City, in the Work Order for the Flamingo Park Renovation Projects; and Authorizing
the Mayor and City Clerk to Execute All Necessary Documents Related to this Application.
The City was awarded $100,000 from the Safe Neighborhood Parks Bond Program.
. November 2, 1999, the citizens of Miami Beach approved the issuance of $91,755,000
million in General Obligation Bonds which included $400,000 for the additional four (4)
swim lanes in the Flamingo Pool.
. February 25, 2000, the City Manager issues a Letter to Commission Announcing a
Community Workshop to Receive Input on Active/Passive Recreational Uses for Flamingo
Park and gain additional information from the community as to how the additional $2.9
million allocated to Flamingo Park and pool should be expended.
. March 7,2000, Flamingo Park Community Workshop is held and approximately 45
individuals signed the attendance sheet. A clear need expressed by a segment of those in
attendance was the need to increase the pool size to eight lanes.
. April 6, 2000, the City Manager Issued a Letter to Commission Regarding Community
Workshop to Receive Input and Plan for Renovations and/or Construction of Facilities,
Programs and Uses for Flamingo Park and Tennis Center with the intention of validating the
information gathered from the community at the March 7,2000 meeting.
. April 26, 2000, the second Flamingo Park Community Workshop is held. Approximately
21 individuals signed the attendance sheet. Again a discussion as to the need for the
additional four (4) lanes in the pool transpired.
. May - October, 2000, the Flamingo Pool project architects revised the construction
documents to include the additional four (4) swim lanes, obtained the permitting approval
and prepared the specifications for bid.
. October 2, 2000, the Invitation to Bid was issued. One-hundred and ninety-nine (199)
vendors were notified. Eighteen (18) requests for plans and specifications were received. A
Pre-Bid Conference was held on October 12, 2000. During the bidding phase, the prospective
bidders issued a number of requests for information. As a result, there were four (4)
Amendments to the bid documents.
. December 14,2000, three (3) responsive bids were received by the City.
. December 20, 2000, the City Commission approved a resolution authorizing the City
Manager or his designee to submit a grant application in the amount of $68,088 to the Safe
Neighborhood Park Bond Oversight Committee, and said funds to be appropriated in the
Flamingo Park pool project.
. January 16, 2001, the grant application submitted in the amount of $68,088 to the Safe
Neighborhood Park Bond Oversight Committee to be appropriated in the Flamingo Park
pool project was awarded to the City. The documents necessary to receive the funding was
executed and returned to Miami- Dade County the same week.
. January 22, 2001, Administration made a presentation at a special meeting of the G.O.
Bond Oversight Committee to provide a project status update and inform the Committee that
the Administration was placing an item on the January 31, 2001 Commission agenda to
award a contract to Regosa Engineering, Inc., in the amount of$2,639, 780 and appropriating
$341,902 from the 1999 $92 million General Obligation Bond, Series 2000, for the
construction of the Flamingo Park Pool Project. This request was approved unanimously.

It should be noted that the City's total construction budget allocation for the Flamingo Park Pool Project
is $2,663,918 and the recommended bid is $2,639,780, which includes a construction contingency of
ten percent (10%).

ANALYSIS
The Flamingo Park Pool project has been an ongoing and expanded vision of the community, the Mayor
and Members ofthe Commission and the Administration since early 1994 when a referral to a joint
meeting of the Finance and Capital Improvements Committees initially discussed the issuance of general
obligation bonds, in the amount of $40 million for parks improvements. At the time of the referral a
renovation program estimated at $1 million was envisioned for the Flamingo pool. Since the time of this
initial discussion several significant action steps relative to the Flamingo Pool project have transpired.
A history of these steps, which included no less than eleven (11) Commission level actions and nine (9)
community meetings and workshops is attached for review. Additionally, this project received the
unanimous approval of the G.O. Bond Program Oversight Committee at its January 22,2001 meeting.
On October 2, 2000 the Invitation to Bid was issued. One-hundred and ninety-nine (199) vendors were
notified. Eighteen (18) requests for plans and specifications were received. A Pre-Bid Conference was
held on October 12, 2000. During the bidding phase; the prospective bidders issued a number of
requests for information. As a result, there were (4) Amendments to the bid documents. In addition,
the bid opening date was extended to December 14, 2000. Three responsive bids were received by the
City. They are as follows:
. Regosa Engineering, Inc.
. Carivon Construction Company
. Megan South, Inc.
The bidders' proposals included all labor, materials, equipment and supervision necessary to complete
the Flamingo Park Pool Facility in accordance with the technical specifica1ions and drawings. The
contract document stipulates that substantial completion must be attained within two-hundred and
ninety-two (292) calendar days after the issuance of the Notice to Proceed. Additionally, the project must
be completed and ready for final payment thirty (30) calendar days following the substantial completion
date.
The project is located at 1245 Michigan Avenue. The Scope of Work encompasses the demolition of
the existing pool facility, and the construction of a new two (2) pool complex including an interactive
water playground (please see the attached schematic drawing of the proposed pools complex),
landscaping, irrigation, concrete, masonry walls, reinforced concrete, stucco, hollow metal doors and
frames, hardware, glazing, tiles, exterior finishes interior finishes, restrooms, plumbing, ventilation, air
conditioning, electrical systems and lighting, and related park improvements. All work along with
mechanical and electrical installations are required to be performed in accordance with the technical
specifications and contract documents.
In addition, the documents included a number of Additive Alternates. They are as follows:
Alternate No.1:
Provision of impact resistant glazed steel framed doors and windows in lieu of aluminum and glass
doors and windows protected by removable hurricane panels.
Alternate No 2. :
Provision of aluminum sunburst fence with steel wire tension cables in lieu of aluminum picket fence.
Alternate No 3:
Provision of "Kool-Deck" finish on pool deck in lieu of concrete finish.
Alternate No.4:
Provision of "Plio flex" pool finish in lieu of "Diamond Brite" finish at interior finish of pools.
Alternate No 5 :
Provision of quarry tile American Olean 6nx 6n Q51 at base building's exterior in lieu of smooth stucco
painted finish.
Alternate No 6:
Provision of appliances as specified in Section 11450.
Alternate No 7. :
Provision of wind driven, clear anodize finished, extruded aluminum stationary wall louvers, Model
"EME6625D" by Ruskin, in lieu of concrete louvers.
Alternate No 8:
Provision of five (5) 20ft. diameter Permabrellas, frame and ground sleeve at locations shown on
drawings, by Waterloo Tent & Tarp Co., Inc., or approved equal.
Alternate No.9:
Provision of "garnet conversion" with "effluent turbidity monitors" to convert EPD sand filter system
to drinking water. Specifications provided by Commercial Energy Specialists, Inc.
Alternate No 10 :
Provision of painted steel picket fence with rust inhibitors in lieu of aluminum picket.
The Bid Tabulation attached, (Exhibit nAn), indicates the bidders quotes for Base Bid, and Additive
Alternates.
The Administration and the City's consultant, Carr Smith Corradino have evaluated the bids, and the
bidders' references. Regosa Engineering, Inc., was determined to be the lowest responsive and
responsible bidder. Regosa Engineering, Inc's Bid is $2,639,780 including a ten percent (10%)
construction contingency. Based on a Design Review Board requirement established at the time of the
project's approval the Administration also recommends the award of Additive Alternate No.2, the
provision of a sunburs1 fence with wire tension cables in lieu of an aluminum picket fence, at an
additional cost of $62,800 which can be funded from the ten percent (10%) allocated contingency which
will reduce the contingency amount to approximately 7.2%. The Administration will continue to seek
alternative funding sources to augment the cost of the sunburst fence and intends to approach the Arts
In Public Places Committee with the request that, due to its highly unique and artistic nature, the fence
be considered as fulfilling project's Arts In Public Places requirement. Additionally, if during the course
of the project, funding becomes available from the contingency fund, the City will evaluate the
remaining Additive Alternates that may be incorporated into the project.
The recommended contractor, Regosa Engineering, Inc., has completed projects for the City including
the PAL Building and Tatum, Fisher and Island View Parks and is using a reputable pools sub-consultant
who has also completed work for the City. Additionally, taking into consideration the extensive
documentation evidencing a comprehensive community input process, the Administration's ability to
augment the cost of this project by securing over $1.1 million in grant funding and the evaluation of the
three (3) bids conducted by City staff and the City's Consultant, Carr Smith Corradino (Exhibit "B"),
the Administration recommends the adoption of the Resolution by the Mayor and City Commission,
approving the award of the contract to Regosa Engineering, Inc., in the amount of $2,639,780, for the
construction of the Flamingo Park Pool Facility including Additive Alternate No.2.
