96-21994 RESO RESOLUTION NO. 96-21994 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ADMINISTRATION TO REJECT ALL BIDS RECEIVED IN RESPONSE TO BID NO. 85-95/96, FOR THE PURCHASE OF FIFTY (50) SIG-SAUER P226 - 9MM COMBAT PISTOLS; ADDITIONALLY, APPROVING A WAIVER OF A SECOND COMPETITIVE BIDDING PROCESS WITH REGARD TO TillS BID AND AUTHORIZING THE ADMINISTRATION TO ACCEPT THE OFFER FROM THE MANUFACTURER TO PURCHASE SAID COMBAT PISTOLS AT A DISCOUNTED PRICE, TOTALLING $25,071.50. WHEREAS, pursuant to Invitation to Bid No. 85-95/96, six responses were received for the purchase of fifty (50) Sig-Sauer 9MM combat pistols ranging in price from $597.27 each, to $727.00 each; and WHEREAS, the manufacturer, Sig-Saue!; has offered the City the significantly lower purchase price of $501.43 each, for fifty (50) Sig-Sauer P226-9MM combat pistols which are also currently on loan to the City from the manufacturer; and WHEREAS, the Police Department has expanded its personnel to another fifty officers and weapons for these officers are needed immediately; and WHEREAS, the Administration would herein recommend that a waiver of the competitive bidding process by a five-sevenths vote would be in the best interest of the City given the significantly lower price offered by the manufacturer; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein authorize the administration to reject all bids received in response to Bid No. 85-95/96, for the purchase of 50 Sig-Sauer P226 - 9MM combat pistols; anq, additionally, also approve a waiver of a second competitive bidding process with regard to this bid, and authorizing the Administration to accept the offer from the manufacturer to purchase the combat pistols currently on loan to the City at a discounted price, totalling $25,071.50. u I Ut~M r~PPROvIu LEGAL DEP~d h By 1f/~ ~ !!?tc -I/2-?/2.L.. ADMINISTRATION RECOMMENDATION: To authorize the Administration to reject all bids received, approve the waiver of the formal bidding process in accordance with City Code 31A-l O( e), and accept the Manufacturer's offer. FUNDING: $25,071.50 Funding is available from Police Account No. 011.1120.000674 BACKGROUND: Invitation To Bid No. 85-95/96 was advertised on April 18, 1996, with an opening date of May 16, 1996. Thirty-one notices and eight specification packages were mailed. Seven replies were received, one of which was a "no bid" response.. The bids received range from $597.27 each to $727.00 each. (Bid Tabulation attached) In October 1995, the Police Department advised Sig-Sauer that weapons that were purchased in 1990, were starting to rust. Sig-Sauer offered to refinish all of our guns with a new finish called K- Coat at no charge to the City, and also advised that they would loan us 50 guns to accomplish this task so that we could ship them 50 weapons at a time. In December 1995, 50 new weapons (loaners) were mailed to the Police Department. The Police Department has refinished about 250 weapons at this time, and have about 130 more to be done. The Police Department has expanded its personnel to another fifty Officers and weapons for these Officers are needed, which justified the above subject bid. Sig-Sauer has advised the City that we could purchase the loaner weapons at a discount price of $501.43 each. This would be a cost savings of approximately $5,000.00. Miami Beach City Code 31 A-I O( e) states; The City Commission, upon written recommendation of the City Manager, may by resolution adopted by a five-sevenths vote of the City Commission waive competitive bidding when the City Commission finds such waiver to be in the best interest of the City. CONCLUSION: The Administration should be authorized to waive the formal bidding process, reject the bids received and accept the offer from Sig-Sauer.
