2008-26778 ResoRESOLUTION NO. 2008-26778 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE DONATION OF ONE (1) MOTORCAR TINT METER FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION, WITH A TOTAL VALUE OF $170.00, TO BE UTILIZED BY THE MIAMI BEACH POLICE DEPARTMENT TO ENFORCE STATE WINDOW SUNSCREENING/TINTING TRAFFIC STATUTES ON THE ROADWAYS OF THE CITY OF MIAMI BEACH. WHEREAS, the Miami Beach Police Department is responsible for enforcing traffic laws, including window sunscreening/tinting traffic violations in the City of Miami Beach; and WHEREAS, tint meters are a tool utilized to measure unlawful window sunscreen/ tinting violations and is recognized by the Miami-Dade County traffic courts as a true indicator of light transmittance; and WHEREAS, the Florida Department of Transportation (FDOT) coordinates with local law enforcement agencies in statewide traffic enforcement initiatives, including the Driving Under the Influence (DUI) Sustained Enforcement Program; and WHEREAS, the Miami Beach Police Department is an active participant in FDOT's DUI Sustained Enforcement Program which has incentives for agencies who participate in high visibility DUI enforcement operations; and WHEREAS, the Miami Beach Police Department conducts saturation patrols and DUI checkpoints in the City on a regular basis and, as a result, is entitled to qualify to receive the donation from FDOT of one tint meter, to be utilized for the enforcement of window sunscreening/tinting violations. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the donation of one tint meter from the Florida Department of Transportation, with a total value of $170.00, to be utilized by Miami Beach Police Officers to enforce unlawful window sunscreening/tinting violations on the roadways of the City of Miami Beach, is hereby accepted. The goal of this program is to reduce the number of alcohol related crashes, and fatalities that occur in Florida, by conducting high visibility DUI enforcement operations and increasing public awareness of alcohol related crash problem. The Miami Beach Police Department has conducted saturation patrols and DUI checkpoints on a regular basis. As part of this program, there are incentives which include the donation of equipment utilized in traffic enforcement to participating agencies. In this instance the Miami Beach Police Department qualified for one tint meter to be utilized to enforce State Window sunscreening/tinting traffic statutes on the roadway of the City of Miami Beach.
