97-22270 RESO RESOLUTION NO. 97-22270 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA RATIFYING THE CITY MANAGER'S ACTION IN EXTENDING FOR A PERIOD OF TWO (2) MONTHS THE TERM OF THAT CERT AIN RESIDENTIAL SOLID WASTE COLLECTION AND YARD TRASH COLLECTION AGREEMENT BY AND BETWEEN BROWNING-FERRIS INDUSTRIES OF FLORIDA, INC. ("BFI") (AS SUCCESSOR TO INDUSTRIAL WASTE SERVICE, INC.) AND THE CITY OF MIAMI BEACH, FLORIDA AND IN REJECTING AND RETURNING UNOPENED ALL BIDS RECEIVED IN CONNECTION WITH TEMPORARY RESIDENTIAL WASTE COLLECTION. WHEREAS, the City of Miami Beach, Florida (the "City") and Browning-Ferris Indus':ri( s of Florida, Inc. ("BFI") (as successor to Industrial Waste Service, Inc.) are parties to that celtai [l Residential Solid Waste Collection and Yard Trash Collection Agreement (the "Agreement"), dltd as of February I, 1993, generally providing for residential waste collection; and WHEREAS, the Agreement is scheduled to terminate on January 31, 1997; and WHEREAS, on January 23, 1997, the City issued Invitation to Bid No. 53-96/97 ("ITB"!, generally seeking bids for temporary residential waste collection; and WHEREAS, the City never opened the bids submitted in response to the ITB; and WHEREAS, the City and BFI have agreed to extend the term of the Agreement for a peric j of two (2) months; and WHEREAS, the City has rejected and returned unopened all bids submitted in respom.e 1) the ITB. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CJI[Tl COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that: 1. The City Manager's action in extending the term of the Agreement for a period of tv. ) (2) months, with no increase in price, is ratified. 2. In the event of any conflict between the terms of this Resolution and the terms 0:' the Agreement, the terms of this Resolution shall control. 3. The City Manager's actions in rejecting and returning unopened all bids submitte:l in response to the ITB are ratified. 4. This Resolution shall take effect immediately upon its adoption. BACKGROUND: On January 31, 1997, the "Residential Solid Waste Collection And Yard Trash Collectiont\nj Disposal" Contract No. 14-92/97 is scheduled for termination. The City Administration issued en January 23, 1997, Invitation to Bid No. 53-96/97, "Temporary Contract for Residential Solid Wasl e And Yard Trash Collection And Disposal" to eleven prospective bidders. Invitation to Bid No.5: - 96/97 was scheduled to open at 2:00 p.m. on January 27, 1997. Just prior to the opening, tr e Administration and Browning-Ferris Industries of Florida, Inc., agreed to extend the term of tr e existing Contract for "Residential Solid Waste Collection and Yard Trash Collection" for a tWCI (:) month period at the current rate of$13.37.
