2001-24293 RESO RESOLUTION No. 2001-24293 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO.8 TO THE ARCHITECTURAL / ENGINEERING SERVICES AGREEMENT WITH BERMELLO, AJAMIL & PARTNERS, INC., IN THE AMOUNT OF $31,182, TO PROVIDE THE ADDITIONAL DESIGN AND CONSTRUCTION MANAGEMENT SERVICES REQUIRED FOR COMPLETION OF THAT PORTION OF THE NORTH BEACH RECREATIONAL CORRIDOR WHICH WILL BE BUILT WITHIN THE LIMITS OF THE NORTH SHORE OPEN SPACE PARK WHEREAS, on July 16, 1997, the City Commission approved a Professional Services Agreement with the firm of Bermello, Ajamil & Partners for design, engineering and construction management services for the renovation of South Pointe Park, North Shore Park, Lummus Park, North Shore Open Space Park, Pinetree Park, and the Parks Maintenance Facility; and WHEREAS, Section 2.11.16 of the Agreement provides that additional services may be provided at the same percentage fee established for the basic services, if additional funding becomes available from the Miami-Dade County Safe Neighborhood Parks Bond, Federal or State grants or other sources; and WHEREAS, the City is also in the process of developing a bicycle/pedestrian trail for the North Beach District, called the North Beach Recreational Corridor Project (NBRC); and WHEREAS, the NBRC will be an on-grade, bicycle/pedestrian trail built within a public easement corridor, which runs along the western edge (upland side) ofthe sand dunes, immediately east of the beachfront properties; and WHEREAS, the NBRC will provide a continuous, multi-purpose public access corridor, which will interconnect area business districts, cultural & tourism centers, residential neighborhoods, parking facilities, parks, schools and the beaches. The NBRC will be developed in a "Greenway" or linear park setting to accentuate the area's natural resources, historical architecture and cultural heritage; and WHEREAS, the master plan is for the NBRC trail to extend from Beach View Park at 53'd Street and Collins Avenue, north along the dunes, to the northern City limit at 87th Street and Collins Avenue, with a series of "east-west connector nodes" linking the trail to the residential areas to the west; and WHEREAS, on January 14, 2000, Request for Qualifications (RFQ) No. 41-99/00 was issued for the architectural and engineering services required for the development of Phase I of the NBRC project; and WHEREAS, two qualified responses were received pursuant to the RFQ and the Mayor and City Commission approved the Selection Committee's recommendation and authorized the Administration to negotiate a contract with the top ranked firm ofKimley-Horn & Associates, Inc., at its meeting on May 24, 2000, and WHEREAS, subsequent to the issuance of the RFQ and approval of the selection committee recommendation, the scope of services for the proposed NBRC significantly expanded beyond what was described in the RFQ, and WHEREAS, due to the significant changes in the scope of work and increase in the proposed project budget, the Mayor and City Commission rejected the responses received pursuant to the original RFQ and authorized the issuance of a revised RFQ, at its meeting on January 31, 2001, and WHEREAS, the start of construction for the NBRC project will be delayed approximately four months by the new RFQ selection process; and WHEREAS, the City must spend the funds allocated to the NBRC from the Miami- Dade County Safe Neighborhood Parks (SNP) Bond Program by January 2002, or the funding will be revoked; and WHEREAS, to ensure that the SNP funds are expended prior to the deadline, and to expedite the construction of a portion of the NBRC, the Administration recommends that the portion of the NBRC that will be built within the limits of the North Shore Open Space Park, be incorporated into Phase I of the North Shore Open Space Park renovation project which is schedule to go out for construction bids within the next 60 days; and WHEREAS, Bermello, Ajamil & Partners is the City's consultant for the design, engineering and construction management services for the renovation of North Shore Open Space Park, their Agreement will be amended to include the additional services required for the incorporation of this portion of the NBRC into the park renovation plans; and WHEREAS, in order to fund the additional design, engineering and construction costs, $500,000 ofthe SNP proceeds that were budgeted for the development of that portion of the NBRC will be reallocated to the North Shore Open Space Park renovation project; and WHEREAS, the $500,000 will be allocated as follows: $450,455 $ 31,182 $ 13,363 $ 5.000 Project Construction Additional A&E services (B&A Amendment) City construction management Reimbursables allowance $500,000 Total Budget Allocation Therefore, the Mayor and City Commission should authorize the execution of an amendment to the Professional Services Agreement with the firm of Bermello, Ajamil & Partners, to provide for the expedited completion of that portion of the NBRC that will be built within the limits of the North Shore Open Space Park. The entire NBRC project has been subdivided into five phases of work. Phase I is the segment of the trail which will extend from 64th Street north to 75th Street. Phase II is the segment that will continue north from 75th Street to 79th Street. Phase III is the proposed extension of the trail from 64th Street south to 53'd Street. Phase IV will be the series of east-west connector nodes or sub-trails connecting to the residential areas to the west. Phase V is the portion of the trail that will extend from 79th Street, through North Shore Open Space Park, to the City's northern limit at 87th Street. Through a series of Federal appropriations requests and grant applications, as well as allocation of County and Local bond proceeds, the City has acquired sufficient funding for the design and construction of Phases I, II & V of the NBRC project. Two qualified responses were received pursuant to the RFQ and the Mayor and City Commission approved the Selection Committee's recommendation and authorized the Administration to negotiate a contract with the top ranked firm of Kimley-Horn & Associates, Inc., at its meeting on May 24, 2000. Subsequent to the issuance of the RFQ and approval of the City Manager recommendation, the scope of services for the proposed NBRC significantly expanded beyond what was described in the RFQ. The scope of work was expanded to include the design and construction of Phase II of the NBRC, restoration of the dunes in the North Beach District, renovation of Band Shell Park, development of new beachfront restroom/concession facilities and considerable value-engineering of the existing concept plans. Similarly, the total project budget increased from $2,600,000 at the time the RFQ was issued, to the current total of more than $5,000,000. The additional funding includes, $900,000 from the Federal Transportation Enhancement Act of2001, $575,000 in Economic Development Initiative Grants from the U.S. Department of Housing and Urban Development, $325,000 in dune restoration funds from the GO Bond Program, $425,000 in dune restoration funds from the Miami- Dade County Safe Neighborhood Parks (SNP) Bond Program, $125,000 from the Miami-Dade County Metropolitan Planning Organization, and $150,000 which was reallocated from the SNP bond program for beachfront restroom/concession facility renovations. Due to the significant changes in the scope of work and increase in the proposed project budget, the Mayor and City Commission rejected the responses received pursuant to the original RFQ and authorized the issuance of a revised RFQ, at its meeting on January 31, 2001. The start of construction for the NBRC project will be delayed approximately four months by the new RFQ evaluation process. The City must spend the funds allocated to the NBRC from the SNP bond program by January 2002, or the funding may be revoked. To ensure that the SNP funds are expended prior to the deadline, and to expedite the construction of a portion of the NBRC, the Administration recommends that Phase V of the NBRC (that portion of the NBRC that will be built within the limits of the North Shore Open Space Park) be incorporated into the North Shore Open Space Park renovation project which is schedule to go out for construction bids within the next 30 days. In order to fund the additional design, engineering and construction costs, $500,000 of the SNP proceeds that were budgeted for the development of Phase V of the NBRC will be reallocated to the North Shore Open Space Park renovation project.
