96-22002 RESO RESOLUTION NO. 96-22002 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DECLARING THAT A VALID PUBLIC EMERGENCY EXISTS, WAIVING THE COMPETITIVE BIDDING PROCESS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE EXISTING AGREEMENT WITH RAMP ASSOCIATES TO INCLUDE PHASE II PREPARATION OF DETAILED CONSTRUCTION DRAWINGS AND ALL CONTRACT AND BID DOCUMENTS FOR THOSE ITEMS IDENTIFIED IN THE PHASE I STUDY THAT ARE AUTHORIZED FOR CONSTRUCTION BY THE CITY OF MIAMI BEACH, FOR THE AMOUNT OF SIX PERCENT OF CONSTRUCTION VALUE OF WORK, FOR THE CITY OWNED PARKING GARAGE LOCATED ON 42ND STREET. WHEREAS, on February 20, 1996, the City entered into an agreement with Ramp Associates, a division of Urbitran Associates(consultant), for a Phase I structural survey to be performed at the 42nd Street Parking Garage (Agreement); and WHEREAS, the Phase I survey has been completed and indicates the need for immediate structural repairs to the Garage in order to preserve and protect its structural integrity; and WHEREAS, based upon the information provided in the Phase I survey, the Mayor and City Commission herein declare that a valid public emergency exists, thereby necessitating a waiver of the competitive bidding process so that the consultant may proceed immediately with preparation of construction drawings and contract and bid documents for the structural repair of the garage; and WHEREAS, the Administration has negotiated the attached existing Agreement with Ramp Associates to include Phase II preparation of detailed drawings and contract and bid documents for the amount of six percent (6%) of construction value. . NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission herein declare that a valid public emergency exists with regard to the continued preservation and protection of the structural integrity of the 42nd Street Garage and, based upon information provided in the Phase I study by Ramp Associates, herein waive the competitive bidding process and authorize the Mayor and City Clerk to execute the attached amendment. BACKGROUND: Phase I study was performed at the request of the Parking Department in February 20, 1996. As stated in the report, this facility needs to be addressed immediately to preserve the structural integrity of the garage. Phase I condition survey report was completed for the amount of$15,000.00. ANALYSIS: The cost of services is as follows: A) Phase I - a detailed condition survey of the physical condition of the garage to include basic structure, expansion joints, control joints, lighting and electrical systems, elevators, interior and exterior painting, paint striping and markings, signage and graphics, drainage and other mechanical systems, security and man proofing. A detailed condition survey and preparation report that will present all findings and cost estimates for each category. $15,000.00 (COMPLETED) AGENDA ITEM C-1F (=-s -qL , CONTP19UED DATE Comm Memo (42nd Street Garage) June 5, 1996 Page II B) Phase II - preparation of detailed construction drawings, contract and bidding documents and technical specifications for those items identified in the Phase I study that are authorized for construction by the City of Miami Beach. Phase II cost of service will be 6% of construction value of the work. CONCLUSION: Based on the Phase I report by Ramp Associates, and the current condition of the facility, it has been determined that a valid public emergency exists, and the Administration recommends that the City Commission approve by resolution the request for an amendment to the existing contract between the City of Miami Beach and Ramp Associates for Phase II, to include the preparation of drawings and bidding documents for repairs and upgrading, for the amount of six(6) percent of construction value. The Agreement is amended on this 5th day of June, 1996 to include the Renovation of a parking Garage located at 42nd Street between Sheridan Avenue and Royal Palm Avenue, Miami Beach, Florida. 2. The following listed schedules in the Agreement shall apply to this amendment: Schedule A, paragraphs 11. 01 to 12.0 inclusive Schedule B, Entire Schedule schedule D, phase II payments only. 3. It is agreed that the fee set forth in schedule D, referenced above, be equal to six percent (6%) of the cost of the construction work, but shall not exceed the lump sum amount of One Hundred Eighteen Thousand Dollars ($118,000.00) . 4. A revised schedule C entitled SCHEDULE - TIME PERFORMANCE for the 42nd Street Garage is hereby added to this amendment. 5. All other terms and conditions of the Agreement shall apply to this amendment.
