RESOLUTION NO. 95-21785 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, FIXING A TIME AND PLACE AT WHICH THE OWNERS OF THE PROPERTIES SPECIALLY BENEFITTED BY THE CREATION OF A SPECIAL ASSESSMENT DISTRICT TO BE KNOWN AS THE SOUTH BEACH HOTEL MANAGEMENT DISTRICT NUMBER 1, FOR THE PURPOSE OF FUNDING SECURITY, AND ADDITIONAL MAINTENANCE AND RELATED SERVICES ALONG THE EAST SIDE OF COLLINS AVENUE FROM LINCOLN ROAD THROUGH 24TH STREET, ALL LYING WITHIN THE CORPORATE LIMITS OF THE CITY OF MIAMI BEACH, OR ANY OTHER PERSONS INTERESTED THEREIN, MAY APPEAR BEFORE THE CITY COMMISSION OF SAID CITY TO BE HEARD AS TO THE PROPRIETY, ADVISABILITY AND COST OF PROVIDING SUCH SERVICES, AGAINST EACH PROPERTY SO BENEFITTED, SUCH HEARING TO BE HELD IN ACCORDANCE WITH SECTIONS 170.07-170.08 OF THE FLORIDA STATUTES. WHEREAS, Sections 170.01-170.21, Florida Statutes, allow for "the levy and collection of special assessments against property benefitted for the purpose of stabilizing and improving retail or wholesale business districts and/or nationally recognized historic districts for promotion, management, marketing and other similar services in business districts of the municipality"; and WHEREAS, by Resolution No. 95-21784 adopted on October 11,1995, the Mayor and City Commission determined that it is necessary for the welfare of the citizens of Miami Beach to provide certain security and additional maintenance and related services (Services) and created the South Beach Hotel Management District Number 1 for the purpose of funding the Services along the east side of Collins Avenue, from Lincoln Road through 24th Street; and WHEREAS, Section 170.07, Florida Statutes, requires that a public hearing be held to hear testimony of all property owners to be assessed and any other interested parties pertaining to the propriety and advisability of providing such Services, the cost thereof, the manner of payment therefore, and the amount thereof to be assessed against each property so benefitted within the South Beach Hotel Management District Number 1; and WHEREAS, Section 170.08, Florida Statutes, provides that fmal consideration of the special assessment will be given after hearing testimony from the affected property owners as to providing the Services and funding them with special assessments, and further provides that following testimony, the Mayor and City Commission of the City of Miami Beach shall make a final decision on whether to levy the special assessment, and thereafter, the Mayor and City Commission shall convene as an equalizing board to hear and consider all complaints that may be made as to the .. amount of any particular special assessment and shall adjust and equalize the assessment on the basis of justice and right, and when so equalized and approved, a final assessment roll shall be filed with the City Clerk's Office and such assessment shall stand confirmed; and WHEREAS, a preliminary assessment roll has been completed and filed of record with the Clerk of the City of Miami Beach. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1. All findings and recitals contained in this Resolution are hereby adopted and incorporated herein. Section 2. A public hearing is hereby scheduled to take place before the Mayor and City Commission in the City Commission Chamber, 1700 Convention Center Drive, Miami Beach, Florida October 25,1995 at 11:30. o'clock a. m . The Mayor and City Commission shall hear testimony of all affected property owners and those persons interested in the South Beach Hotel Management District Number 1. A second resolution to set the required public hearing is also included in this agenda. In compliance with Chapter 170, Florida Statutes, final notification of the District shall be subject to majority approval of the property owners within the District at a special election to be held within the District, prior to the final public hearing. BACKGROUND: The success of the Ocean Drive, Washington Avenue and Lincoln Road Special Services Districts has encouraged property owners along the east side of Collins Avenue to desire similar improvements on their street. These property owners have expressed support for creating a special assessment district to provide for security, maintenance and related services. Furthermore, as with the Ocean Drive, Washington Avenue and Lincoln Road Management Districts, an election to be held at a future date will determine if the required majority of the owners within the District support the special assessment. This matter was reviewed by the Finance Committee at the June 16, 1995 meeting at which time the Committee recommended that the Administration review the budget to determine savings and to identify alternate funding sources for these services. The improvements to be provided through this special assessment district are described below as follows: 1) Security - $310,000 The Miami Beach Police Department will provide three regular police officers plus one sergeant which will be a specialized unit for the District. Private security will also be added to the security for 134 hours per week. This total also includes equipment, radios and phones needed. AGENDA ITEM R:l-F 10-\ \-0,5 DATE 2) Sanitation - $345,000 The Speciallrnprovement District will provide increased streetsweeping services in addition to the current hand and mechanical streetsweeping services provided by the City. Additionally, the district will provide for regular pressure cleaning of sidewalks. The City will provide the storage containers and will also be responsible for disposing of the litter and trash from this additional streetsweeping effort. 3) Start-Up Costs - $45,000 This cost includes management during the first six months of service and also includes planning, coordinating and development of the services described above. ANALYSIS: Emm..tM Annual Cost Security $310,000 Sanitation 345,000 Start-Up 45.000 Total $700,000 Estimated Fundini Allocation Special Assessment $350,000 City - Resort Taxes 350.000 Total $700,000 Method of Assessment The total amount of the special assessment to fund these services is $350,000. This portion of the cost of providing these services will be prorated according to the front footage of the respective properties specially benefited by these improvements. The estimated annual cost of providing this benefit is $125.76 per front foot. The amount assessed for commercial usage in a condominium building will be the front footage of the lot less the total amount paid by the individual condominium units. Other Funding The City will fund the balance of the costs for these services from the proceeds of resort tax. CONCLUSION: The City Commission should adopt the attached resolution, creating a special assessment district to be known as the South Beach Hotel Management District Number One (District), encompassing the area along the east side of Collins Avenue from Lincoln Road through 24th Street.
