2008-3606 OrdinanceORDINANCE NO. 2008-3606 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION 106-55(n) OF THE CITY CODE, ENTITLED "HYBRID/ILEV (INHERENTLY LOW EMISSIONS VEHICLES) VEHICLES INCENTIVE," TO PROVIDE FOR A REDUCTION OF THE COST OF THE HYBRID CITYWIDE DECAL FROM $365.00 TO $100.00 PER YEAR; AN INCREASE IN THE DISCOUNT AFFORDED TO QUALIFYING VEHICLES ON MONTHLY PARKING PERMITS IN CITY PARKING FACILITIES AND FOR RESIDENTIAL PARKING PERMIT HOLDERS FROM 25% TO 50%; AND PROVIDING THAT THE 500 CITYWIDE ON-STREET PARKING DECALS BE REDUCED TO 250 CITYWIDE PARKING DECALS, CURRENTLY AVAILABLE TO REGISTERED HYBRID/ILEV VEHICLES ON A FIRST-COME, FIRST SERVED BASIS, SHALL ALSO BE HONORED AT CITY-OWNED SURFACE PARKING LOTS (IN ADDITION TO ON-STREET METERED SPACES); PROVIDING FOR REPEALER, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, Ordinance No. 2007-3586 which was approved on December 12, 2007, by the Mayor and City Commission establishing incentives for use of Hybrid/ILEV vehicles; and WHEREAS, an amendment to the financial incentives increasing their value to users is necessary in order to further stimulate their participation in the Hybrid/ILEV incentive program; and WHEREAS, the City of Miami Beach Parking recognizes that Hybrid/ILEV (Inherently Low Emissions Vehicles) vehicles conserve energy and are environmentally friendly; and WHEREAS, the State of Florida Department of Highway Safety also recognizes these attributes and provides incentives for Hybrid/ILEV vehicles in the form of allowing recognized and decaled Hybrids/ILEV vehicles to use HOV (High Occupancy Vehicle) lanes for single passenger vehicles. WHEREAS, the City wishes to establish further incentives for Hybrid/ILEV vehicles use in the City; and WHEREAS, the amendments set forth below are necessary to accomplish all of the above objectives. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA. SECTION 1. Chapter 106, "Traffic and Vehicles," Article II, "Metered Parking," Division 1, "Generally," Section 106-55, "Parking Rate Fees, and Penalties," of the Code of the City of Miami Beach, Florida, is hereby amended, creating a new subsection (n) therein as follows: Sec. 106-55. Parking rates, fees, and penalties. (n) Hybrid/ILEV (Inherently Low Emissions Vehicles) Vehicles Incentive: Effective January 1, 2008, the City will establish aHybrid/ILEV Program which will use the State ILEV list of qualifying vehicles for participation in the Program. Incentives to be offered to qualified and registered vehicle owners include: a. Monthly parking permit holders for all facilities will be afforded a fib *~•~°~ percent 50% {~~ discount on the monthly rate. b. Residential permit holders in all designated zones shall receive a fib *~~~°~ percent 50% '''~ savings on either their annual orsemi-annual residential permit. c. Two hundred and fifty (250) Citywide ea- e~eet parking decals, honored at ^^~ °*~~ metered spaces only, shall be available only to State registered Hybrid/ILEV vehicles on a first-come, first served basis. The cost of the Hybrid Citywide Decal. is 100.00 $~99 per year. d. One percent (1 %) of the parking spaces at the 42"d Street Municipal Parking Garage may be designated as "Hybrid/ILEV Vehicle Parking Only" for use by recognized Hybrid/ILEV vehicles. Notwithstanding the preceding sentence, the City Manager or his designee, who shall be the City's Parking Director, reserves the right, in his reasonable businessjudgement and discretion, to temporarily suspend the aforestated "Hybrid/ILEV Vehicle Parking Only" during special events in order to ensure maximum utilization of all parking spaces. 2 (Ord. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made part of the Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section", "article", or other appropriate word. SECTION 3. REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 5. EFFECTIVE DATE. On December 12, 2007, following recommendations and initiatives proposed by Commissioner Steinberg, the Mayor and City Commission adopted Ordinance No. 2007-3586, creating Section 106-55(n) of the City Code, which established ahybrid/ILEV (Inherently Low Emissions Vehicles) vehicles incentive program. This program, effective January 1, 2008, allows the City to offer certain incentives to qualified and registered hybrid/ILEV vehicle owners including: • a 25% discount for monthly parking permit holders in City facilities, and a 25% discount for residential permit holders on annual orsemi-annual residential permits; and • making available 500 City-wide on-street City parking decals, on a first-come first-served basis, honored at on-street metered spaces in the City, for a cost of $365.00 per year. In furtherance of the aforesaid incentive program, Commissioner Steinberg is proposing an amendment to Chapter 106-55(n). Gonzalez, City Manager DATE: May 14, 2008 SUB.IECT: Fiscal Impact of Proposed Hybrid/ILEV Vehicles Incentives The proposed amendments to the Hybrid/ILEV incentives will likely have a nominal fiscal impact through the pilot period, which will sunset in December 2008. The fiscal impact is calculated as follows: o At the proposed 50% discount for residential parking permits, the value of the discounts will have a value ranging from $25 to $125 annually per permit. o At the proposed 50% discount the monthly municipal parking permit discount will have a value ranging from $35 to $50 per permit. o The reduction in the citywide parking decal fee from $365 to $100 equates to a $265 reduction annually per permit and the expansion of the decal use to both on-street and off- street meters increases the locations they are honored at by 126%. There are 1 13 Hybrid/ILEV vehicles registered with Miami Beach addresses. Of those 1 13, only ten (10) have participated thus far in the incentive program. However, if the incentive program is extended beyond the current sunset provision and contingent upon the length of said extension, there may be increased revenue losses associated with the program as the utilization of Hybrid/ILEV vehicles increases over time.
