RESOLUTION NO. 2001-24347
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROPRIATING $175,000 FROM
THE GENERAL OBLIGATION (GO) BOND SERIES 2000 FUND NO. 373
FOR THE REPLACEMENT OF THE BEACHFRONT RESTROOM
FACILITY AT 29TH STREET.
WHEREAS, the issuance of a $92,000,000 General Obligation (GO) Bond was approved
by Miami Beach voters on November 2, 1999; and
WHEREAS, the proceeds produced by the sale of the bonds are to be used to fund
infrastructure revitalization, neighborhood improvements, park renovations and other capital
improvement projects Citywide; and
WHEREAS, $4,300,000 of the GO Bond Program funds were budgeted for street end
landscape and pedestrian improvements between 25th and 43rd Streets; and
WHEREAS, the use of these funds to develop secure, accessible restroom facilities in the
area was specifically identified in the list of planned capital improvements included in the GO Bond
Program Project List, which was approved by the voters; and
WHEREAS, the Administration previously identified five beachfront restroom/concession
facilities which are in critical need of replacement; and
WHEREAS, the subject facilities are located in the beachfront parks east of Collins Avenue
at 64th Street; 53rd Street; 46th Street; 29th Street and 21st Street respectively; and
WHEREAS, the existing restroom and concession facilities at those locations are in an
extremely deteriorated condition; are not in compliance with the Americans with Disabilities Act;
cannot be effectively secured; and are magnets for illicit activities; and
WHEREAS, the design and structural condition of the facilities is sufficiently poor such that
the cost to renovate the facilities and bring them up to code is prohibitive; and
WHEREAS, through the adoption of Resolution No. 2000-24182 on November 29,2000,
the Mayor and City Commission appropriated $750,000 of the proceeds from the Miami-Dade
County Safe Neighborhood Parks Bond Program (SNPB) for the replacement of the five forestated
facilities; and
WHEREAS, the design of the new restroom facilities that will be user friendly, low
maintenance, resistant to vandalism and securable, is underway; and
WHEREAS, it is the Administration's goal to complete the construction of all five facilities
by the end of the year; and
WHEREAS, the Administration has determined that the existing beachfront restroom within
Band Shell Park at 72nd Street is also in an extremely deteriorated condition and should be
expeditiously replaced; and
WHEREAS, in order to allow the replacement of this facility to proceed with the
construction of the other five facilities, the Administration recommends that the SNPB funds
allocated for the replacement of the 29th Street facility be reallocated to the 72nd Street facility and
further, that the $175,000 needed for the replacement of the 29th Street facility be appropriated from
the GO Bond Program; and
WHEREAS, $555,000 from the sale of the first $30,000,000 in GO bonds is currently
available for the street end landscape and pedestrian improvements between 25th and 43rd Street.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the appropriation of
$175,000 from the General Obligation Bond Series 2000 Fund 373 for the replacement of the 29th
Street beachfront restroom facility, is approved.

ANALYSIS
On November 2, 1999, Miami Beach voters approved the issuance of a $92,000,000 General
Obligation (GO) Bond. The proceeds produced by the sale of the bonds are to be used to fund
infrastructure revitalization, neighborhood improvements, park renovations and other capital
improvement projects Citywide.
A total of $4,300,000 of the GO Bond Program funds was budgeted for streetend landscape and
pedestrian improvements between 25th and 43rd Street. The use of these funds to develop secure,
accessible restroom facilities in the area was specifically identified in the list of planned capital
improvements included in the GO Bond Program Project List, which was approved by the voters.
The Administration previously identified five beachfront restroom/concession facilities, which are in
critical need of replacement. The subject facilities are located in the beachfront parks east of Collins
Avenue at 64th Street; 53'd Street; 46th Street; 29th Street and 2151 Street. The existing restroom and
concession facilities at those locations are in an extremely deteriorated condition; are not compliant
with the Americans with Disabilities Act; cannot be effectively secured; and are magnets for illicit

activities. The design and structural condition of the facilities is sufficiently poor that the cost to
renovate the facilities and bring them up to code is prohibitive.

nod Street is also in an extremely deteriorated condition and should expeditiously replaced. In order
to allow the replacement of this facility to proceed with the construction of the other five facilities, the
Administration recommends that the SNPB funds allocated for the replacement of the 29th Street
facility, be reallocated to the nod Street facility and that the $175,000 needed for the replacement of
the 29th Street facility be appropriated from the GO Bond Program.
On April 2, 2001, the GO Bond Oversight Committee voted unanimously to recommend the Mayor
and City Commission appropriate the $175,000 from the GO Bond Program for the replacement of
the facility.
A total $555,000 from the sale of the first $30,000,000 in GO bonds is currently available for the
Street End Landscape and Pedestrian Improvements Between 25th and 43'd Street.
Although the City is not obliged to expend the GO Bonds funds by January 2002, the reconstruction
of this facility has been included in the contract for the reconstruction of the five other beachfront
restroom facilities, which are being replaced on an emergency basis. By including the 29th Street
facility in the contract with the other five, the City was able to negotiate a lower overall architectural
and engineering fee and expedite the replacement of the additional facility. The expedited
replacement if the facility will help alleviate existing health and safety issues and reduce the potential
for negative effects on tourism.
On April 10, 2001, the City's Historic Preservation Board declined to grant the City's request for a
Certificate of Appropriateness for Demolition for the 2151 and 29th Street facilities. The reasons for
their refusal included the desire to receive a citywide study of public restroom usage, an analysis of
optimal locations for future facilities, a history report on the architecture of the existing facilities and
a survey depicting the location of any historically significant landscaping adjacent to the existing
facilities. It is the Administration's position that, beach tourism is vital to the economic well being of
our community, and the immediate availability of safe, clean and accessible restrooms and
concessions facilities is vital to beach tourism. The recent condemnation of the 2151 Street restroom
facility has had negative effect on public health conditions and the extremely deteriorated condition
of the 29th Street facility poses a significant threat to public safety. Both facilities are heavily used by
residents and visitors and both are located in areas which are more than a mile from the nearest
alternative public restroom. Furthermore, the staff of the City's Historic Preservation Division has
opined that both facilities are non-contributing utility buildings and void of any architectural
significance. Additionally, the SNP proceeds allocated for this project must be completely expended
by January 2002 or the funding will be revoked. Adhering to the standard competitive selection will
not allow for the completion of the new facilities prior to the deadline. The Administration considers
the health and safety issues, the potential negative effects on tourism and the impending financial
deadline sufficient cause to want the emergency replacement of these facilities.
Because of the urgent nature of this project, the issue regarding the appropriateness of the demolition
of these two facilities located within City rights-of-way will be presented to you, for your review and
consideration, at the meeting scheduled for May 16, 2001. No funds will be authorized for
expenditure prior to this date.
Therefore, the Administration recommends that $175,000 of the available proceeds from the General
Obligation Bond Series 2000 Fund No. 373, be appropriated for the replacement of the 29th Street
beachfront restroom facility.
