A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA AUTHORIZING THE
EMPLOYMENT OF BETTY CAPOTE, ESQUIRE
AS SPECIAL COUNSEL FOR THE CITY I S
PERSONNEL BOARD.
WHEREAS, the City Commission of the City of Miami Beach,
Florida, has heretofore found and determined that it is in the best
interest of the City to employ special counsel to confer with and
advise the City's Personnel Board and to attend the meetings of
said Personnel Board as well as all hearings on appeals from
disciplinary action in order that the Personnel Board may at all
times have available the advice of said special counsel; and
WHEREAS, Jose Garcia Pedrosa, Esquire who has served as
Special Counsel to the Personnel Board since 1994 has resigned due
to his appointment as Miami Beach City Manager; and
WHEREAS, there is a public necessity for uninterrupted legal
counsel to the City's Personnel Board.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that Betty Capote,
Esquire is hereby retained as Special Counsel for the Personnel
Board of the City, with the duties hereinbefore set forth, at a
compensation of $12,000 per year. Said employment to commence
immediately and to be subject to termination at the will of either
party.

RE: PERSONNEL BOARD ATTORNEY
Jose Garcia-Pedroza was counsel for the Personnel Board of the City of Miami
Beach. As the attached letter of April 26,1995 indicates, he has formally resigned his
position. Since there is a Personnel Board meeting on May 19,1995, it is recommended
that Harold Rosen, Esq. serve as Personnel Board attorney for that one meeting.
The appointment for this position is by City Commission based on the
recommendation of the City Attorney. The City Attorney is not prepared to make a
recommendation at this time, but will do so at the Commission Meeting on Wednesday,
June 7, 1995.
