96-22035 RESO RESOLUTION NO. 96-22035 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO NEGOTIATE A CONTRACT FOR THE PURCHASE OF SAND FOR THE PURPOSE OF BEACH RENOURISHMENT, AND THE POSTING OF A REFUNDABLE DEPOSIT, SUBJECT TO FINAL CITY COMMISSION APPROVAL AND REIMBURSEMENT OF ALL COSTS AND DEPOSITS TO THE CITY BY DADE COUNTY AND/OR THE ARMY CORPS OF ENGINEERS OR OTHER APPROPRIATE AGENCY. WHEREAS, due to a federal court injunction which halted a project by the Army Corps of Engineers to provide sand to the City of Miami Beach ("City"), the City has a critical need for beach renourishment; and WHEREAS, the lack of beach renourishment in the City of Miami Beach has resulted in adverse impacts upon the public health, safety, welfare, and economy of the City; and WHEREAS, sand may be available for purchase from alternate sources which could enable the City of Miami Beach to obtain needed sand on an immediate basis in order to renourish and protect its beaches in the current hurricane season. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the City Manager, or his designee, is hereby authorized to negotiate a contract for the purchase of sand from any available source, subject to a.) reimbursement by Dade County and/or the Army Corps of Engineers or other appropriate agency for all deposits paid and all costs incurred related to the acquisition of the sand and its placement on the beaches of Miami Beach and b.) final City Commission approval as to the terms of such contract. Be it further duly resolved that the posting of a refundable deposit is hereby authorized in conjunction with the negotiations for said contract.
