A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY APPROVING
AND AUTHORIZING THE PLACEMENT OF TWENTY-FIVE (25)
BANNERS FOR THE MIAMI GAY AND LESBIAN FILM FESTIVAL, IN
MIAMI BEACH FROM APRIL 26, 2001 TO MAY 5, 2001, AS
REQUESTED BY THE APPLICANT AT THE FOLLOWING
LOCATIONS: MCARTHUR CAUSEWAY, FROM THE MIAMI BEACH
CITY LIMITS TO ALTON ROAD; ALTON ROAD, FROM 5TH TO 17TH
STREET; SAID BANNERS TO BE AFFIXED TO LIGHT POLES IN THE
PUBLIC RIGHT-OF-WAY; MEASURING 3 FEET X 7 FEET AND
HAVING A COPY AND DESIGN AS SHOWN ON THE ATTACHED
DRAWING; SHALL BE INSTALLED AND REMOVED IN
ACCORDANCE WITH ALL OTHER APPLICABLE CITY
REQUIREMENTS; THE ADMINISTRATION FURTHER
RECOMMENDS THAT THESE BANNERS BE INSTALLED NO
EARLIER THAN APRIL 24, 2001, AND REMOVED BY MAY 7, 2001.
WHEREAS, the Miami Gay and Lesbian Film Festival (Applicant) was held on
April 26, 2001 through May 5, 2001, in the City of Miami Beach; and
WHEREAS, in order to publicize the event and draw attention of the media and
the public at large, the Applicant requested light pole banners, measuring 3 feet by 7 feet;
and
WHEREAS, the Applicant went through the normal design review permit
process in order to obtain approval for temporary pole banners; and
WHEREAS, said banners were installed no earlier than April 24, 2001, and
removed by May 7, 2001; and
WHEREAS, the Applicant requested approval and authorization for the
placement of a total of twenty-five (25) banners; and
WHEREAS, the Applicant posted a performance bond to ensure the removal of
the banners by May 7, 2001, and will continue to ensure that any damage to light poles
will be repaired at its expense, and will meet all other applicable City requirements; and
WHEREAS, City Code Section 82-411 (d) requires that the Mayor and City
Commission approve the installation of temporary banners, which in this case did not
occur prior to the event, therefore retroactive approval is required.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Commission herein retroactively approve and authorize the placement of twenty-five
(25) banners for the Gay and Lesbian Film Festival, held in the City of Miami Beach,
April 26, 2001, through May 5, 2001, as requested by the Applicant at the following
locations: McArthur Causeway, from the Miami Beach City Limit to Alton Road; Alton
Road, from 5th to 17th Street; said banners affixed to light poles in the public right-of-
way; measuring 3 'xT and having a copy and design as shown on the attached drawing; to
be installed and removed in accordance with all other applicable City requirements; the
Administration further recommends that these banners were to be installed no earlier than
April 24, 2001, and removed by May 7, 2001.

banners on the MacArthur Causeway and down Alton Road to 17m Street during April 25 through
May 7,2001.
This issue did not come up sooner because only recently they attained their funding for the purchase
of the banners.
I have attached a copy of the request for your review.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
The City Code Section 82-411 (d) requires that the City Commission approve the installation of
temporary banners which reads, in part:
(1) The right to install, as well as the number, location and method of installation of
banners shall be subject to the design review process and approved by the City
Commission and the Public Works Department.
(2) Banners shall not exceed three feet in width by seven feet in length. Banners may
be double-sided. The color, design and material of all banners shall be approved
under the design review process.

(3) Banners announcing special events either to be held in city or to be associated in
some manner with the city, as determined by the City Commission, may be erected
up to 30 days prior to the event being announced and must be removed within seven
days after such event. Special event banners shall require approval by the City
Commission.
(4) A performance bond shall be required to ensure the removal of the banners in case
of advanced deterioration of the banners, or if a dangerous condition presents itself,
the city may at its sole discretion direct banners to be removed at any time.
The purpose of the banners is to promote and welcome participants of the Miami Gay and Lesbian
Film Festival, the largest gay and lesbian cultural event in South Florida bringing in the best of the
international selections of films made by, for and about gay, lesbian, bisexual and transgender
community.
Tbe funding to purchase banners for the Miami Gay and Lesbian Film Festival was not acquired in
time to process the application in a timely manner therefore, the item could not be placed on the
April 18, 2001 City Commission agenda.
In a last minute effort, to assist this annual event, the City Manager administratively approved the
light post banners for the Miami Gay and Lesbian Film Festival and asked that they be placed on the
next Commission agenda for retroactive approval, which has been done on a very limited basis in
the past.
Tbe City Commission should retroactively approve the installation of the subject light pole banners
for the Miami Gay and Lesbian Film Festival, previously held in the City of Miami Beach, from
April 26, 2001 to May 5,2001.
