E) SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND WOLFBERG ALVAREZ 8 PARTNERS, DATED SEPTEMBER 25, 2002 IN AN AMOUNT NOT-TO-EXCEED $20,469, FOR THE PROVISION OF ADDITIONAL PROFESSIONAL SERVICES, FOR THE RIGHT-0F-WAY INFRASTRUCTURE IMPROVEMENTS PROGRAM NEIGHBORHOOD NO. 12C -SOUTH POINTE RDA PHASE II PROJECT. rD This Amendment No. 6 to the Agreement made and entered this ~ day of ®~ ~e ~~!2008. by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida (hereinafter referred to as City), having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139, and WOLFBERG ALVAREZ & PARTNERS, a Florida Corporation, having its offices at 1500 San Remo Avenue, Suite 300, Coral Gables, Florida 33146 (hereinafter referred to as the Consultant). RECITALS int to Request for Qualifications (RFQ) No. 57-00101, the Mayor and Resolution No. 2002-24993, on September 25, 2002, approving and Project (the Agreement); and II Neighborhood Streetscape WHEREAS, the Agreement provides for the detailed planning, design, permitting, bidding / award and construction administrative services for various streetscape! utility improvements within the South Pointe RDA Phase II Neighborhood(the Project); and WHEREAS, the Agreementwas executed fora not-to-exceed amount of $469,634.00; and W HEREAS, on February 16, 2005, the City approved Amendment No. 1 to the Agreement, in the amount of S19,750, for the implementation of additional underground utility field verification efforts to further refine contract documents by selectively investigating "utility' locations where proposed underground infrastructure will intersect with existing improvements; and WHEREAS, on March 11, 2005, the City approved Amendment No. 2 to the Agreement, in the amount of S 10,750, for additional services for updating /revising the survey for areas within the Project boundary that recently implemented right-of-way improvements adjacent to the new private developments, and within along the Alton Road right-of-way from Fourth to Fifth Streets; and WHEREAS, on October 19, 2005, the Mayorand City Commission adopted Resolution No. 2005-26037. aoorovino Amendment No. 3 to the Agreement, in the amount of $272,673, for WHEREAS, on January 10, 2006, the City approved Amendment No. a to me Hgreemem, in the amount of S 12,626, for additional efforts associated with Geotechnical Evaluation services associated with the expanded scope of the Project; and WHEREAS, on May 11, 2007, the City approved Amendment No. 5 to the amount of S24,999, for additional efforts associated with subsurface verification for the Projecl; WHEREAS, the following Amendment No. 6 to the Agreement, is for additioi design of the alleyways not included in the original scope of work; coordination and p survey and legal description forthe Miami-Dade County School Board Right-0f-Way [ Easement for the construction of the Project, including Deeding of a portion of land to for coordination of additional staging alternates; and WHEREAS, the following Amendment No. 6 increases the total Agreement by a total fee of $830,901. NOW, THEREFORE, the parties hereto, and in consideration of the mutual covenants, agreements, terms, and conditions herein contained, and other good ai consideration, the respect and adequacy are hereby acknowledged, do agree as f< 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this No. 6. 2. MODIFICATIONS The Agreement is amended to include and incorporate the additional work, < Schedule "A-6", attached hereto. 3. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION. The City and Consultant ratify the terms of the Agreement, as amended by this Amendment No. 6. The existing concrete sidewalk on the south side of 4"' Street, between Alto n Road and Michigan Avenue, is located within the South Pointe Elementary School (SPES) property. To allow for reconstruction of the sidewalk within the scope of the Right-of-Way I mprovement Project, the CONSULTANT shall prepare all the necessary documentation requi red to obtain the dedication of that portion of the SPES property from the Miami-Dade County S chool Board (MDCSB). This amendment includes, but is not limited to attending and par ticipating in coordination meetings between CIP and representatives from MDCSB and SPES, as necessary. In addition, this effort shall include additional survey work required b y the County for recording of the deed, and approval of a license agreement with the City, for the construction easements necessary to repave the entrances and driveways to the SPES. The City negotiated an additional service fee of $7,354, which includes $2,000 for su rvey, for this additional work. Task 5.11 - Staging Area As a result of extensive discussion and review of available ROW, it became app arentthat the City would be unable to offer a suitable parcel of public property to serve as the Contractor s staging area on this Project. The Consultant shall explore potential sites at the South Pointe Elementary School (SPES) property, including a small parcel of land located at the far south parking lot of the SPES. Consultant shall also coordinate with the School Board officials the feasibility of utilization of this area for construction staging.
