A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, ACCEPTING A DONATION OF FIVE (5) COCONUT
PALMS AND THREE (3) KEY THATCH PALMS FROM 100 OCEAN
INVESTMENTS, L.L.C.; WITH SAID PALMS TO BE RELOCATED FROM THE
APPLE HOTEL PROPERTY, LOCATED AT 100 OCEAN DRIVE, TO A
LOCATION ON CITY PROPERTY TO BE DETERMINED BY THE CITY
MANAGER; WITH ALL COSTS TO REMOVE, RELOCATE, TRANSPLANT AND
MAINTAIN THE PALMS (UNTIL ESTABLISHED) TO BE THE RESPONSIBILITY
OF 100 OCEAN INVESTMENTS, L.L.C.
WHEREAS, the Administration received the attached correspondence from Mr. Nelson Fox,
representing 100 Ocean Investments, L.L.C., proffering a donation of five (5) Coconut Palms and
three (3) Thatch Palms, to be removed from the Apple Hotel site, located at 100 Ocean Drive, and
planted at a location to be determined by the City Manager; and
WHEREAS, it is understood that, as part of the donation, 100 Ocean Investments also
agrees to be responsible for all costs for the removal, relocation, transplanting and maintenance of
the palms to establishment, as stipulated in the attached letter from 100 Ocean Investments, dated
August 8, 2008; and
WHEREAS, the palms would benefit the community by enhancing its beauty and contributing
to our urban forest.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accepts a
donation of five (5) Coconut Palms and three (3) Thatch Palms from 100 Ocean Investments, L.L.C.;
said palms to be relocated from the Apple Hotel property, located at 100 Ocean Drive, to a location
on City property to be determined by the City Manager; with all costs to remove, relocate, transplant
and maintain the palms (until established) to be the responsibility of 100 Ocean Investments, L.L.C..
PASSED and ADOPTED this 10th day of September, 2008.

Item Summary/Recommendation:

to be determined by the City. It is understood that Ocean Investments would be responsible for all
cost for the removal, relocation, transplanting and maintenance of the palms to establishment.
At this time it is anticipated the palms would be relocated to either Marjory Stoneman Douglas Park or
Lummus Park.
The Administration recommends the adoption of the resolution accepting this generous donation
which would benefit the community by enhancing the beauty of our park and contribute to our urban
forest.

Dear Mr. Gonzalez,
~e are in the limcrss of .finalizing the design for our new hotel {Apple Hose#}
at 10U C)ccan I?r. and have some existing trees that we would like to donate to the city.
VJe want to transplant. 5 Coconut Palms that range in height from tl3'-25' tall and 3 Key
Thatch Palms that range in height from 6"-8' tall to a single location in the City to be
selected by the City. It is understood that we will be responsible to maintain the
transplants in ahealthy growing fa<shian until thry are established tsut will nett have to
replace any palms that die unlESS it is proved that there- i~~as Ccxitt~actor negligence.
It is our understanding after talking to Chris Lott with Parks and Kecreation Department
to comply to with the city's ethics rules. This r~uest will have tc~ lie presented to the
