A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING
THE CITY OF MIAMI BEACH ADMINISTRATIVE COSTS
AMOUNT FOR STATE FISCAL YEARS 2001/2002, 2002/2003,
AND 2003/2004 FOR THE FLORIDA STATE HOUSING
INITIATIVES PARTNERSHIP (SHIP) PROGRAM AT TEN
PERCENT OF THE ALLOCATION; AND APPROVING THE
USE OF FIVE PERCENT OF PROGRAM INCOME
GENERATED BY THE SHIP PROGRAM FOR
ADMINISTRATIVE COSTS.
WHEREAS, the State of Florida enacted the William E. Sadowski Affordable Housing Act (the
Act) on July 7, 1992, allocating a portion of new and existing documentary stamp taxes on deeds to
local governments for development and maintenance of housing through the State Housing Initiatives
Partnership (SHIP) Program; and
WHEREAS, the Act limits the administrative costs to five percent unless resolved by the Mayor
and City Cornmission to increase the percentage to an amount not to exceed ten percent; and
WHEREAS, that pursuant to Chapter 420.9075(6), Florida Statutes, it was found that five percent
ofthe local housing distribution plus five percent of program income is insufficient to adequately pay
the necessary cost of administering the local housing assistance plan. The cost of administering the
program may not exceed ten percent of the local housing distribution plus five percent of program
incorne deposited into the trust fund ; and
WHEREAS, that the cost to be incurred in the administration, management, reporting and
monitoring functions associated with the SHIP Program shall be in excess of five percent and therefore
the Commission finds that the total administrative fee associated with the SHIP Program shall not
exceed ten percent of the local housing distribution plus five percent of program income deposited into
the trust fund provided for in Rule 67-37.007(4), FAC.; and
WHEREAS, the Act does not allow administrative costs from program income unless resolved by
the Mayor and City Commission; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, the Mayor and City Commission hereby approve
the administrative costs amount for the Florida State Housing Initiatives Partnership (SHIP) Program
at ten percent of the allocation; and approve the use of five percent of program income generated by the
SHIP Program for administrative costs for State Fiscal Years 200112002, 2002/2003, and 2003/2004.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
The State Housing Initiatives Partnership (SHIP) Program, administered through the Florida Housing
Finance Corporation (FHFC), was established by the 1992 William E. Sadowski Affordable Housing
Act (Act) to stimulate the production of housing statewide. SHIP Program funds are derived from
documentary stamp levies on real estate transactions. Annually, the FHFC allocates SHIP Program
funds among participating jurisdictions on a formula basis.
As required by the SHIP Program, on May 3, 1995, the City approved Resolution NO 95-21566
adopting a three-year Housing Assistance Plan covering State fiscal years 1995/96, 1996/97 and
1997/98. On April 1, 1998, the City approved Resolution NO 98-22696 adopting a Local Housing
Assistance Plan for State fiscal years 1998/99, 1999/00, and 2000/01. The current Local Housing
Assistance Plan expires on June 30, 2001.

On March 14, 2001, the City approved Resolution N" 2001-24285 adopting the Local Housing
Assistance Plan (Plan) for State fiscal years 2001/02, 2002/03, and 2003/04 and authorizing
submission of the Plan for review and approval by the Florida Housing Finance Corporation.
Subsequently, the City submitted the Plan to FHFC as required by the SHIP Rule. On April 25, 2001,
the Florida Housing Finance Corporation reviewed and approved the Plan. The Plan is to be
implemented on July I, 2001, and the SHIP Program funding allocation for the City is currently
estimated to be $493,676 for State fiscal year 200l/02.
The Local Housing Assistance Plan for State fiscal years 2001/02, 2002/03, and 2003/04 provides
for SHIP Program funds to be used for rehabilitation, down payment assistance, closing cost
assistance and home ownership training in relation to a Home Buyer Assistance Program to assist
income-eligible participants with an income of up to 120 percent of area median income (currently
$37,440 for a family of one). The Plan will allow for up to fifty percent of the SHIP Program funds
allocated to the City be targeted to assist eligible City staff or eligible teachers from the Miami-Dade
County Public School System who agree to teach in Miami Beach.
In accordance with the SHIP Program Rule, cities are limited to administrative costs of five percent.
However, the SHIP Rule provides that cities that determine that five percent of their allocation is not
sufficient to operate their program may increase their administration costs to ten percent of their
allocation and additionally utilize five percent of program income for administrative costs. State
Statute requires that an increase in administrative cost to ten percent of the allocation plus five
percent of program income be made by a resolution of the City Commission.
The Administration recommends approval of a Resolution of the Mayor and City Commission of
the City of Miami Beach, Florida, approving the City of Miami Beach administrative costs amount
for the Florida State Housing Initiatives Partnership (SHIP) Program at ten percent of the allocation;
and approving the use of five percent of program income generated by the SHIP Program for
administrative costs for the State Fiscal Years 2001/2002, 2002/2003, and 2003/2004.
