Pursuant to the advice of the City Commission at the attorney-client session on October
19, 2016, the City Attorney's Office successfully reached a settlement in Normandy
Living, LLC v. City of Miami Beach (Case No. 16-23618-CA01). I am pleased to inform
you that, pursuant to our settlement agreement, Normandy Living dismissed its case
against the City on Friday, January 13th.
As you know, on November 15, 2016, the Planning Board affirmed the Planning
Director's determination that Normandy Living's application did not meet the definition of
an adult congregate living facility (ACLF) under the City Code. The 30 -day window for
Normandy Living to appeal the Planning Board's determination has expired. Therefore,
the Planning Director's original determination stands.
