Morales, City Manager DATE: March 30, 2017 SUBJECT: Planning Board Resolution ā€” Recom endation Pertaining to Ocean Drive. Attached, please find a copy of a resolution adopted by the Planning Board at their March 28, 2017 meeting. The Board is urging the Mayor and City Commission to take the following actions with regard to Ocean Drive: (1) Implement the following changes to Ocean Drive sidewalk cafes: a. Increase the width of the minimum required pedestrian path from five (5) feet to seven (7) feet. b. Prohibit the placement of menu boards on the right-of-way. c. Implement the following recommendations of the ODTF regarding sidewalk cafes: i. Construct up to a five-foot extension of the west sidewalk (such extension should be limited, if possible, to permit the existing two lanes of traffic and two lanes of parking to remain). The goal of the sidewalk extension is to improve public safety, accommodate the substantial growth in pedestrian traffic which has already occurred, and create a more unified, upgraded visual presentation of iconic Ocean Drive. (ODTF Recommendation No. 4). ii. Explore a limited expansion of the east sidewalk. (ODTF Recommendation No. 5). iii. Install concrete sidewalks or pavers of different colors or patterns to delineate dedicated pedestrian pathways from areas available for dining, in order to facilitate enforcement. (ODTF Recommendation No. 6). iv. Install uniform lighting on the entire extended sidewalk on Ocean Drive from 5th to 15th Streets. (ODTF Recommendation No. 7). v. Install new lighting on Ocean Drive and in Lummus Park reflecting the seasonality of environmental issues (e.g., sea turtles) as well as resident and tourist safety needs (e.g., lights should have the ability to change given the specific seasonal requirements). (ODTF Recommendation No. 9.A). vii, Restrict the canopy color of sidewalk cafe umbrellas to a palette of pastel colors, to be recommended by City Planning Department staff and the Historic Preservation Board. (ODTF Recommendation No. 9.B). viii. Limit umbrella canopies to one solid color per sidewalk cafe and allow the sidewalk cafe to print its name, in a contrasting color and in a font no larger than 12 inches, on the umbrella canopies or valences, (ODTF Recommendation No. 9.C). ix, Restrict umbrella canopies to a square or rectangular shape only. (ODTF Recommendation No. 9.D), x. Increase the minimum clearance under umbrella canopies to seven (7) feet and the maximum height of the umbrella canopies to nine (9) feet. (ODTF Recommendation No. 9.E). xi. Allow minimal tilting of umbrella canopies, to an extent determined by City Planning Department staff. (ODTF Recommendation No. 9.F). xii. Allow umbrellas and umbrella canopies to remain closed and an the sidewalk during hours when a business is closed. (ODTF Recommendation No. 9.G); and (2) Consider measures to mitigate the negative effects of noise on Ocean Drive. The Administration recommends that the Commission consider the recommendation of the Planning Board and provide appropriate policy direction. WHEREAS, Ocean Drive is a unique, historic and highly significant promenade lined with hotels, restaurants, and retail establishments, all of which serve tourists and residents alike; and WHEREAS, over the past few years, the City has dedicated significant attention and resources toward improving the Ocean Drive experience; and WHEREAS, on May 12, 2015, the Mayor convened the Ocean Drive Task Force ("ODTF") to study and make recommendations as to how to improve the experience for residents and visitors on Ocean Drive from 5th Street to 15th Street; and WHEREAS, on March 9, 2016, the Mayor and City Commission made certain amendments and adopted the final report of the Ocean Drive Task Force, which included several proposals regarding sidewalk cafes on Ocean Drive; and WHEREAS, on September 27, 2016, the Mayor and City Commission adopted Resolution No: 2046-29590,--adopting-the-Ten-Point Plan-forOcean Drive; and WHEREAS, on October 14, 2016, the Mayor and City Commission adopted Resolution No. 2016-29606, adopting the City of Miami Beach Ocean Drive Sidewalk Cafe Guidelines; and WHEREAS, in the interest of further improving the conditions on Ocean Drive for residents and visitors, the Planning Board hereby desires to make the following additional recommendations to the Mayor and City Commission.
