Prohibited Lobbying by Campaign ConsultantsORDINANCENO. 2017-4110 ANORDINANCEOFTHEMAYORANDCITYCOMMISSIONOFTHE CITYOFMIAMIBEACH, FLORIDA, AMENDINGMIAMIBEACH CITYCODECHAPTER2, ARTICLEVII, DIVISION5ENTITLED CAMPAIGNFINANCEREFORM," BYADDINGTHERETOSECTION 2-491ENTITLED "PROHIBITEDLOBBYINGBYCAMPAIGN CONSULTANTS," PROHIBITINGCAMPAIGNCONSULTANTSAND CERTAINAFFILIATEDPERSONSORENTITIESFROMLOBBYING CITYCOMMISSIONFOR12MONTHSSUBSEQUENTTOSWEARING INOFSUBJECTELECTEDOFFICIAL(S), ESTABLISHING DEFINITIONS, ANDLIMITEDEXEMPTION; PROVIDINGFOR REPEALER, SEVERABILITY, CODIFICATION, ANDANEFFECTIVE DATE. WHEREAS, theCityofMiamiBeachhasaparamountinterestinpreventingcorruption ortheappearanceofcorruptionwhichcouldresultintheerosionofpublicconfidence; and WHEREAS, corruptionandtheappearanceofcorruptionintheformofcampaign consultantsexploitingtheirinfluencewithCityelectedofficialsonbehalfofprivateinterests mayerodepublicconfidenceinthefairnessandimpartialityofCitygovernmentaldecisions; and WHEREAS, permittingapoliticalconsultanttolobbytheCityCommissionforacertain periodof time immediatelyfollowing the swearing in ofthat consultant's former client(s)/Commission member(s) increasesthelikelihoodofcorruptionortheappearanceof corruptionintheformofquidproquosaleofofficialaction; and WHEREAS, prohibitionsoncampaignconsultantslobbyingformerclients/membersof theCityCommissionwillprotectpublicconfidenceintheelectoralandgovernmentalprocesses. ItisthusthepurposeandintentoftheMiamiBeachCityCommissioninenactingthisOrdinance toprohibitcampaignconsultantsfromexploitingorappearingtoexploittheirinfluencewithCity electedofficialsonbehalfofprivateinterests. NOW, THEREFORE, BEIT ORDAINEDBYTHEMAYORANDCITY COMMISSIONOFTHECITYOFMIAMIBEACH, FLORIDA: SECTION1. ThatMiamiBeach City CodeChapter 2, ArticleVII, Division5entitled CampaignFinanceReform," isherebyamendedbyaddingthefollowingCityCodesection2- 491 entitled"Prohibited Lobbyingby CampaignConsultants"to readas follows: Sec. 2-491. ProhibitedLobbyingbyCampaignConsultants. A. Prohibition. NocampaignconsultantshalllobbytheCityCommissionforaperiodof12months followingtheswearinginofanyelectedofficial(s) forwhomthecampaignconsultantprovided campaignconsultingserviceswithinthepastelectioncycle. B. Definitions. a) "Campaign consultant" meansanypersonorentitythatreceivesorispromised economicconsiderationinexchangeforcampaignconsultingservicestoacandidateforelected officeintheCityofMiamiBeach. 1) "Campaignconsultant" shallincludeanyindividualwhohasanownershipinterest of 10% orgreaterinthecampaignconsultant, andanyemployeeofthecampaignconsultant, exceptasotherwiseexceptedbelow. 2) " Campaignconsultant" shallnotinclude: i) anyvendorforacampaignwhoseprimaryresponsibilityistosupply goodsorservicesforacampaign. ii) anemployeeofacampaignconsultantwhosesoledutiesareprimarily clerical; or iii) anemployeeofacampaignconsultantwhodidnotpersonallyprovide campaignconsultingservices. b) "Campaign consulting services" meansprimaryresponsibilityforcampaign managementorcampaignstrategy. c) " Campaignmanagement" meansconducting, coordinatingorsupervisingacampaign toelectacandidate. d) "Campaignstrategy" meansformulationofplansfortheelectionofacandidate. e) " Candidate" shallhavethemeaningascribedtosuchterminFloridaStatutes, section 97.021(5), asamendedandsupplemented. f) "Economicconsideration" meansanypayments, fees, commissions, gifts, oranything elseofvaluereceiveddirectlyorindirectlyasconsiderationforcampaignconsultingservices. Theterm"economicconsideration" doesnotincludereimbursementsforoutofpocketexpenses. g) "Pastelectioncycle" meansthesubjectimmediatelyprecedingCityofMiamiBeach GeneralElection/SpecialElectionheldforthepurposeofelectingamemberoftheCity Commission. h) "Lobby" forpurposesofthisCodeSectionshallmeantheactofseekingtoencourage thepassage, defeatormodificationofanyordinance, resolution, actionordecisionofany memberoftheCityCommission. C. LimitedExemption. Acampaignconsultantwhohaswithinthepastelectioncycleprovidedcampaign consultingservicestoanincumbentmemberoftheCityCommission, andhasenteredintoa lobbyingcontractpriortotheeffectivedateoftheordinancecreatingthiscodesection (theterm ofwhichlobbyingcontractincludesthesubjectproscribed12monthperiodestablishedin SubsectionAaboveandthescopeofwhichlobbyingcontractinvolveslobbyingmembersofthe City Commission), isexemptfromtheproscriptionhereinwithlimitedregardtothatsubject lobbying contract. SECTION2. REPEALER. Allordinancesorpartsofordinancesinconflictherewithbeandthesamearehereby repealed. SECTION3. SEVERABILITY. Ifanysection, sentence, clauseorphraseofthisordinanceisheldtobeinvalidor unconstitutionalbyanycourtofcompetentjurisdiction, thensaidholdingshallinnowayaffect thevalidityoftheremainingportionsofthisordinance. SECTION4. CODIFICATION. ItistheintentionoftheMayorandCityCommissionoftheCityofMiamiBeach, andit isherebyordainedthattheprovisionsofthisordinanceshallbecomeandbemadeapartofthe CodeoftheCityofMiamiBeach, Florida. Thesectionsofthisordinancemayberenumberedor re-letteredtoaccomplishsuchintention, andtheword "ordinance" maybechangedto "section," article," orotherappropriateword. SECTION5. EFFECTIVEDATE.
