A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING RESOLUTIONS 2016-
29642 AND 2016-29694, SETTING THE DATES FOR THE YEAR 2017
CITY COMMISSION MEETINGS, BY RESCHEDULING THE MONDAY,
NOVEMBER 13, 2017 (ELECTION-RELATED) CITY COMMISSION
MEETING TO TUESDAY, NOVEMBER 14, 2017 AND RESCHEDULING
THE MONDAY, NOVEMBER 27, 2017 (ELECTION-RELATED) CITY
COMMISSION MEETING, IF REQUIRED DUE TO A RUN-OFF
ELECTION, TO TUESDAY, NOVEMBER 28, 2017, TO ACCOMMODATE
THE COUNTY ELECTIONS DEPARTMENT FOLLOWING THE CITY'S
GENERAL ELECTION, SPECIAL ELECTION AND, IF REQUIRED, A
RUN-OFF ELECTION.
WHEREAS, pursuant to Section 2.04 of the Miami Beach City Charter, the City
Commission shall meet at such times as may be prescribed by ordinance or resolution; and
WHEREAS, on November 9, 2016, the City Commission adopted Resolution No.
2016-29642, setting the dates for the 2017 Commission meetings; and
WHEREAS, on December 14, 2016, the City Commission amended the 2017
Commission Meeting dates via Resolution No. 2016-29694; and
WHEREAS, pursuant to City Code Sec. 38-4, "[o]n the first business day
immediately following the County Elections Supervisor's issuance of final election results,
the City Commission shall meet for the purpose of accepting the returns of such election(s)
and ascertaining the results thereof"; and
WHEREAS, the Veteran's Day Holiday will be observed on Friday, November 10,
2017, and the Thanksgiving Holiday will be observed on Thursday, November 23, 2017
and Friday, November 24, 2017; and
WHEREAS, currently, the Election-related City Commission meetings are scheduled
for Monday, November 13, 2017 and Monday, November 28, 2017; and
WHEREAS, due to the above-referenced Holidays, the County Elections
Department has requested until Monday, November 13, 2017 to issue the Final Election
Results for the City's General and Special Elections (to be held on November 7, 2017), and
until Monday, November 27, 2017 to issue the Final Election Results for the City's Run-off
Election (to be held on Tuesday, November 21, 2017), if a Run-off Election is required);
thus, the City Commission meetings currently scheduled on Monday, November 13, 2017
and Monday, November 27, 2017 should be rescheduled to Tuesday, November 14, 2017
and Tuesday, November 28, 2017 as set forth in Exhibit "A," and Resolution Nos. 2016-
29642 and 2016-29694 should be amended accordingly; and
WHEREAS, should a Run-off Election not be required, all new officers shall be
sworn in on Tuesday, November 14, 2017; if a Run-off Election is required, all new officers
shall be sworn in on Tuesday, November 28, 2017.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby amend Resolutions Nos. 2016-29642 and 2016-29694 and reschedule
the Monday, November 13, 2017 (Election-related) City Commission meeting to Tuesday,
November 14, 2017; and, if required due to a Run-off Election, the Monday, November27,
2017 (Election-related) City Commission meeting is rescheduled to Tuesday, November
28, 2017 to accommodate the County Elections Department following the City's General
Election, Special Election and, if required, a Run-off Election, as set forth in Exhibit "A."

RECOMMENDATION
Adopt the Resolution.
ANALYSIS
Pursuant to City Code Sec. 38-4, "[o]n the first business day immediately following the County
Elections Supervisor's issuance of final election results, the City Commission shall meet for the
purpose of accepting the returns of such election(s) and ascertaining the results thereof."
Since the Veteran's Day Holiday will be observed on November 10, 2017, and the Thanksgiving
Holiday will be observed on November 23 and 24, 2017, and the Elections Department needs until
Monday, November 13, 2017 to issue the Final Election Results for the City's General and Special
Elections, and until Monday, November 27, 2017 to issue the Final Election Results for the City's
Run-off Election (if one is necessary); therefore, Resolutions 2016-29642 and 2016-29694 should be
amended to reflect the new Commission Meeting dates on November 14, 2017 and November 28,
2017 as set forth in Exhibit "A." Should a Run-off Election not be necessary, all new officers shall be
sworn in on November 14, 2017; if a Run-off Election is necessary, all new officers shall be sworn In
on November28, 2017.
CONCLUSION
It is recommended that the Mayor and City Commission amend Resolutions Nos. 2016-29642 and
2016-29694, and reschedule the November 13, 2017 (Election-related) City Commission meeting to
November 14, 2017; and, if required due to a Run-off Election, reschedule the November 27, 2017
(Election-related) City Commission meeting to November 28, 2017 to accommodate the County
Elections Department following the City's General Election, Special Election and, if required, a Run-
off Election.
