AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
CHAPTER 110 OF THE MIAMI BEACH CITY CODE ENTITLED
"UTILITIES", AMENDING SUBSECTION 110-166, ENTITLED
"SCHEDULE OF WATER RATES AND TAPPING CHARGES" BY
ADDING TO SUBSECTION 110-166(C) THEREOF THE OPTION
OF "BUDGET BILLING" OF OWNERS OR CONSUMERS OF
WATER AND SEWER AT SINGLE-FAMILY RESIDENCES;
PROVIDING FOR REPEALER, SEVERABILITY,
CODIFICATION, AND AN EFFECTIVE DATE.
WHEREAS, the customers or consumers of water and sewer service of single family homes in
the City of Miami Beach have requested to pay the same each month for their water and sewer
bills; and the option of "Budget Billing" is available in the Utility Billing System.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: That Subsection 110-166 entitled "Schedule of water rates and tapping charges"
of the Miami Beach City Code Chapter 110 entitled "Rates, Fees and Charges;" is hereby
amended as follows:

(c) On all water supply service, each month shall be a complete period in itself, and no
excess consumption of water during one month shall be charged against the minimum service
charge or be added to the consumption of any other month.
(1.) Exception. The provisions contained in this subsection (c) shall not app1v to an
owner or consumer of a sing1e-fami1v home that participates in the "Budget Billing" process of
the Uti1itv Billing Svstem. The "Budget Billing" process allows owners or consumers to pav
the same month1v amount for water and sewer consumption based on the average of the previous
annual consumption history. If the variance in actual consumPtion becomes more than 50% of
the annual consumption average. the budgeted amount would be recalculated or the budget
billing would cease and regular billing would commence. To be eligible to use this "Budget
Billing" feature. the owner and or consumer would have to submit an application to the Finance
Department for Budget Billing. After the approval of the Finance Department. the Budget
Billing would commence and would on1v cease upon written request bv the owner or consumer
or the failure to pav the Budget Amount when the payment is due.
SECTION 2. REPEALER
All ordinance or parts of ordinance in conflict herewith be and the same are hereby
repealed.
SECTION 3. SEVERABILITY
If any section, subsection, clause or provision of this Ordinance is held invalid, the
remainder shall not be affected by such invalidity.
SECTION 4. CODIFICATION
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it
is hereby ordained the provisions of this Ordinance shall become and be made part of the Code
of the City of Miami Beach, Florida. The sections of the Ordinance may be renumbered or
relettered to accomplish such intentions, and the word "ordinance" may be changed to "section",
"article", or other appropriate word.
SECTION 5. EFFECTIVE DATE
This Ordinance shall take effect on the 16th day of June, 2001.

ADMINISTRATIVE RECOMMENDATION:
Adopt the Ordinance.
ANALYSIS:
In response to our residential customers, who have concerns about the possibility of significant
fluctuations in their water and sewer billings from month to month we are recommending a change to
the City Code to permit the implementation of a "budget billing" program for these charges. This
program will allow water and sewer customers to pay the same amount each month for a 12 month
period. The "monthly amount" will be based on the average of the billings for water and sewer services
for the previous twelve months. In the 13th month a new "monthly amount" would be computed which
would include an adjustment to reflect the actual consumption during the previous year. We will monitor
fluctuations in monthly usage so that we can continue to notify "budget billing" customers about possible
plumbing problems on a timely basis. If the variance from the budgeted "monthly amount" should
become greater than 50% of the average, a customer on budget billing would be notified that the
"monthly amount" would be recalculated or regular billing will commence.

We are proposing a pilot program for "Budget Billing". The pilot program would be initiated on July
1,2001, for single family residence customers that qualify for the additional homestead exemption,
recently approved for persons over 65 years of age with household income of $20,000 or less. All single
family residence customers would be eligible to apply for "budget billing" following the successful
completion of the six month pilot program.
There will be no charge to enroll in the "Budget Billing" Program. To sign up for the program the
customer would need to contact the Finance Department and complete an application. If the consumer
or customer is not satisfied with "Budget Billing" and would like to return to billings for actual amounts
of usage, they would need to contact the Finance Department.
The Administration, after discussions with Commissioner Matti Herrera Bower and at the suggestion
of Commissioner Luis R. Garcia, Jr., researched this program and presented it as an option during the
April18, 2001 City Commission meeting and also discussed additional improvements in utility billing.
Meter reading routes will be rescheduled to allow for weekly cycles. Two additional meter reader
positions will be filled increasing the current staff from 3 to 5. Utility bills will be taken to the General
Mail Facility, which accepts all bills at one time rather than our local post office, which has a three-tray
limit for mailings. All hardware/software in the utility billing section will be upgraded.
CONCLUSION
City Commission should adopt the ordinance after the second reading public hearing.
