SUBJECT: INDIAN CREEK GREENWAY PROJECT - PROGRESS REPORT ON
ACTIONS BEING UNDERTAKEN FOR THE GIFfING OF OUT-LOTS TO
THE CITY.
The following letter is an update to the progress report last presented to the City Commission on
April 18, 2001.
1. The illustrated National Park Service "Indian Creek Greenway" community project brochure, and
its accompanying package of supportive visual/ descriptive materials have been finalized and
6000 copies of the brochure are currently being printed. We anticipate delivery of the printed
material by July 15,2001.
2. The legal procedural documents, which are being prepared to promote and market the
Greenway project and solicit one hundred percent gifting of the "out-lots" by respective
upland owners along the east side of Indian Creek, are currently being drafted by the City's
Legal Department staff in consultation with Leonard Wien Jr.
This phase of the proposed project work involves the voluntary commitment of substantial
personal time and "hands-on" community leadership by Leonard Wien Jr., President of the
Indian Creek Association, and Stuart Reed, leader of the Friends of Indian Creek, in cooperation
with the City's Legal Department and City Staff. Materials generally include the following:
a) A Quit Claim Deed approved in form by the City Attorney.
b) The National Park Service community developed "Indian Creek Greenway Concept Plan
(Map) and Project Mission I Description" and supportive NPS booklet, as well as other
appropriate illustrative visual exhibits.
c) A bullet point presentation of "Incentives and Benefits of Gifting Out-Lots to the
Greenway", including but not limited to the following:
. front yard amenity to upland property owners, including professional landscaping and
waterside promenade.
. enhancement of property values
. pride of ownership in a visionary Greenway AGENDA ITEM

. tax benefits
. reduction of liability
. maintenance by the City
. marine habitat restoration along Indian Creek (supporting increased varieties and
numbers of native fish, Manatees, seabirds, etc.)
. construction of safe and attractive pedestrian crosswalks accessing the Greenway
promenade from the east sidewalks of Indian Creek Drive and Collins A venue as
well as safe access to public transit stops
d) The Administration will work closely with the City Attorney's's Office in developing an
instrument toward laying out the sequence and schedule of actions to be undertaken in
the out-lots "gifting" process.
3. During the month of May 2001, a continuing investigation of pertinent Greenway viability
issues was underway by City staff, community leaders, and the National Park Service, including
a field visit to Jupiter, Florida where we experienced the 2.5 mile long Jupiter River Walk Project
and were able to acquire a great deal of insight into the planning involved in this masterful
undertaking.
4. From the Jupiter trip and our discussions with Brenda Arnold, the Project Coordinator, we
learned that individual presentations to the property owners or condominium associations would
be most effective if held in the setting of the Creek, quite possibly as a series of boat tours
starting in fall 200 1. Both Leonard Wien Jr. and Stuart Reed should play an essential role in
promoting the proposed Greenway Project and soliciting and securing the gifting of the out-lots
through the process defined in item 2.c above; the Administration has also identified staff to
assist in facilitating this gifting process.
5. The City of Miarni Beach Planning Department, through its Design, Preservation and
Neighborhood Planning Division, will continue to manage the Indian Creek Greenway Project
and look forward to a presentation of the finalized materials prior to your August recess at the
July 18, 2001 Commission Meeting.

Why has the above referenced project stalled? The Commission was very emphatic about
moving forward to the next step. The Legal Department and or the Administration was
supposed to draft a letter to upland property owners encouraging the owners to consider
donating their land for the future of this neighborhood improvement. A progress report
was due AprillS'h. What is the status?

Please provide me with a brief update on the progress of the City's efforts to
assemble the properties for the Indian Creek Greenway project.
When the greenway plan was presented to the City Commission on March 14,
2001, the Commission emphatically directed the administration to commence working to
assemble the properties.
In the course of subsequent meetings, it was agreed that a letter of intent would
be prepared to initiate obtaining consents to transfer properties or rights to the City.
When we met in your office awhile ago with other city officials it seemed that the task of
preparing the letter would be given to the City Attorney.
Has a letter of intent or some other document been prepared?
Considering the great amount of work invested in the Indian Creek Greenway
plans, by a great number of city and federal officials, planning professionals and good
citizens, I think that brief monthly updates, to ensure that our efforts are given due
consideration, would be appropriate. Nearly three months have passed since the City
Commission meeting and I am not aware of any material progress.
