SUBJECT:
A RESOLUTION A ORIZING THE APPROPRIATION OF $45,250
FROM REALLOCA T D BOND FUND 351 INTO EXISTING WORK ORDER
NUMBER 2066 TO PROVIDE FUNDING FOR THE REQUIRED
ENVIRONMENTAL SERVICES RELATED TO THE TRANSITION OF
COURSE OPERATORS AT THE CITY'S BA YSHORE AND NORMANDY
SHORES GOLF COURSES.
ADMINISTRATION RECOMMENDATION
Approve the resolution.
BACKGROUND
The City's golf course management agreement with the American Golf Corporation expires
September 30, 199q, and the Chuck Hart Management Group is scheduled to take over as
the City's interim course operator on October 1, 1996.
Because the Bayshore golf course maintenance facility is extensively contaminated with
hazardous wastes, the City must fully disclose the information regarding the condition of the
site to the Chuck Hart Management Group. The City will also be required to indemnify the
Chuck Hart Management Group against the pre-existing condition of the facility. Because
of the condition of the facility, the City must also take steps to minimize potential future
liabilities related to employee exposure to hazardous wastes or any additional contamination
that the Chuck Hart Management Group may cause.
However, the City lacks sufficient information to properly prepare an indemnification
agreement or limit future liabilities. Therefore, the City needs to immediately implement the
additional environmental testing and risk evaluations needed to provide the required
information.
Because the likelihood exists that the Normandy Shores Golf Course maintenance facility
is also contaminated with hazardous wastes, that facility must also be subjected to
environmental testing and risk evaluations.
