A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AMONTH-TO-MONTH EXTENSION
OF THE AGREEMENT WITH WASTE MANAGEMENT, INC. OF FLORIDA,
DATED DECEMBER 8, 2004, FOR COLLECTION AND DISPOSAL OF
RESIDENTIAL SOLID WASTE, YARD TRASH, BULK WASTE AND
OPERATION OF THE CITY'S GREEN FACILITY, PENDING A
DETERMINATION BY THE CITY COMMISSION ON WHETHER OR NOT TO
EXERCISE THE RENEWAL TERM UNDER SAID AGREEMENT; SAID
MONTH-TO-MONTH EXTENSION COMMENCING ON JANUARY 1, 2009,
AND TERMINATING NO LATER THAN MARCH 31, 2009; FURTHER
REFERRING THE ISSUE OF WHETHER OR NOT TO EXERCISE THE
RENEWAL TERM UNDER THE AGREEMENT TO THE FINANCE AND
CITYWIDE PROJECTS COMMITTEE, FOR ITS RECOMMENDATION.
WHEREAS, on December 8, 2004, the Mayor and City Commission authorized the
Mayor and City Clerk to execute a Service Agreement with Waste Management Inc. of Florida,
pursuant to Request for Proposals No. 48-03/04, for the collection and disposal of residential
solid waste, yard trash, bulk waste, and operation of the City's Green Waste Facility; said
Agreement commencing on January 1, 2005, and expiring on December 31, 2007; and
WHEREAS, the Agreement allows for up to two (2) consecutive one (1) year renewals,
at the discretion of the City; and
WHEREAS, the first renewal option was approved by the City Commission on October
17, 2007, by Resolution No. 2007-26682; and
WHEREAS, the first renewal term will expire on December 31, 2008; and
WHEREAS, the Administration would recommend that the Mayor and City Commission
approve amonth-to-month extension of the Agreement, commencing on January 1, 2009, and
ending no later than March 31, 2009, pending the City's discussion on whether to exercise the .
second renewal term.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize amonth-to-month extension of the Agreement with
Waste Management, Inc. of Florida, dated December 8, 2004, for collection and disposal of
residential solid waste, yard trash, bulk waste and operation of the City's Green Facility, pending
a determination by the City Commission on whether or not to exercise the renewal term under
said Agreement; said month-to-month extension commencing on January 1, 2009, and
terminating no later than March 31, 2009; further referring the issue of whether or not to
exercise the renewal term under the Agreement to the Finance and Citywide Projects
Committee, for its recommendation.

waste and operation of the City's Green Waste Facility since January 1, 2005. The terms of the
Agreement allows for up to two (2) consecutive one (1) year renewals at the discretion of the City. The

WM has continued to provide outstanding collection and disposal of residential solid waste to the
residents of Miami Beach. However, because this would be the last renewal option year and the fifth year
of the contract, the Administration recommends that this item be referred to the Finance and Citywide
Projects Committee for discussion and recommendation to the City Commission of whether or not to
exercise the renewal term.

ADMINISTRATION RECOMMENDATION

ANALYSIS
Waste Management Inc. of Florida (WM) has provided the collection and disposal of residential
solid waste and operation of the City's Green Waste Facility since January 1, 2005. The terms of
the Agreement allows for up to two (2) consecutive one (1) year renewals at the discretion of the
City. The first year renewal was approved by the City Commission on October 17, 2007, by
Resolution No. 2007-26682.
WM has continued to provide outstanding collection and disposal of residential solid waste to the
residents of Miami Beach. However, because this would be the last renewal option year and the
fifth year of the contract, the Administration recommends that this item be referred to the Finance
and Citywide Projects Committee for discussion and recommendation to the City Commission.
CONCLUSION
The Administration recommends approving the month-to-month extension of the agreement and
that this item be referred to the Finance and Citywide Projects Committee for discussion and
recommendation to the City Commission of whether or not to exercise the renewal term.
