A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER
PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO. 32-07/08 FOR AN
INSURANCE BROKER OF RECORD FOR PROPERTY AND LIABILITY INSURANCE,
AS NEEDED, FOR THE CITY OF MIAMI BEACH, FLORIDA; AUTHORIZING THE
ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE TOP-RANKED FIRM
OF ARTHUR J. GALLAGHER RISK MANAGEMENT SERVICES, INC., AND SHOULD
THE ADMINISTRATION NOT BE ABLE TO NEGOTIATE AN AGREEMENT WITH THE
TOP-RANKED FIRM, AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH
THE SECOND-RANKED FIRM OF WILLIS OF FLORIDA; AND FURTHER
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT UPON
THE COMPLETION OF SUCCESSFUL NEGOTIATIONS BY THE ADMINISTRATION.
WHEREAS, the City currently purchases insurance utilizing the services of an insurance
broker; and
WHEREAS, the current agreement for an insurance broker of record will expire on January
25, 2009, with no remaining options to renew; and
WHEREAS, at its June 25, 2008 meeting, the Mayor and City Commission authorized the
Administration to issue an RFP For An Insurance Broker of Record for Property and Liability
Insurance, As Needed, for the City of Miami Beach, Florida; and
WHEREAS, on July 22, 2008, RFP No. 32-07/08 was issued and the Procurement Division
e-mailed, as well as uploaded the RFP, to RFPDepot.com and BidNet.com, sending notifications to
50 firms; and
WHEREAS, on the specified RFP due date, the Procurement Division received responses
from Arthur J. Gallagher Risk Management Services, Inc.; Wachovia Insurance Services, Inc.; and
Willis of Florida; and
WHEREAS, on October 10, 2008, the City Manager via Letter to Commission No. 260-
2008, appointed an Evaluation Committee (the "Committee"), consisting of the following individuals:
Julio Magrisso, CMB Assistant Director -Parks and Recreation;
James Sutter, CMB internal Auditor;
Oren Lieber, Resident, Attorney and Member of the City Safety Committee;
Josephine Pampanas -Leadership Academy Graduate;
Kristin Tigner, CMB Assistant Director -Human Resources; and
WHEREAS, the Committee convened on November 4, 2008, and was provided with an
overview of the RFP, information relative to the City's Cone of Silence Ordinance and the
Government in the Sunshine Law, and discussed the evaluation criteria to be utilized as outlined in
the RFP; and
WHEREAS, the Committee unanimously recommended Arthur J. Gallagher Risk
Management Services, Inc. as the top-ranked firm, and Willis of Florida as the second-ranked firm;
and
WHEREAS, the City Manager concurs with the Committee's recommendation.
NOW, THEREFORE, BE IT DULY RESOLVED BYTHE MAYORAND CITYCOMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the
recommendation of the City Manager pursuant to Request for Proposals (RFP) No. 32-07/08 For An
Insurance Broker of Record For Property Insurance, As Needed, for the City of Miami Beach, Florida;
and authorize the Administration to enter into negotiations with the top-ranked firm of Arthur J.
Gallagher Risk Management Services, Inc.; and should the Administration not be able to negotiate
with the top-ranked firm, authorize the Administration to negotiate with the second-ranked firm, Willis
of Florida; further authorizing the Mayor and City Clerk to execute an agreement upon conclusion of
successful negotiations by the Administration. .

On June 25, 2008, the City Commission authorized the Administration to issue an RFP an insurance
broker of record for property and liability insurance, as needed, for the City of Miami Beach. RFP No. 32-
07/08 was issued and sent to 50 firms, with proposals were received from: Arthur J. Gallagher Risk
Management Services, Inc.; Wachovia Insurance Services, Inc.; and Willis of Florida.
An Evaluation Committee appointed by the City Manager reviewed, scored and ranked the proposals.
Based on the published evaluation criteria, the Committee Members unanimously ranked Arthur J.
Gallagher as the top-ranked firm, and Willis of Florida as the second-ranked firm.
The Administration recommends that the Mayor and Commission adopt the Resolution.

On November 25, 2003, the Mayor and City Commission approved a new professional
services agreement for Broker Services, with Arthur J. Gallagher and Company for a period
of three (3) years with two (2), one-year options to renew, in the amount of $25,000 per year.
In addition to the annual service fee, commissions are received on all flood policies. This
agreement will expire on January 25, 2009, with no remaining options to renew.
The Mayor and City Commission at its June 25, 2008 meeting, authorized the Administration
to issue an RFP for an insurance broker of record for property and liability insurance, as
needed, for the City of Miami Beach. The new contract will be for a period, of three (3) years
with two (2), one-year options to renew, commencing at the expiration of the existing
agreement, on January 26, 2009.
The City requires that the selected Broker/Agent provide at a minimum, the following
services:
• Provide assistance to the City's Risk Manager in determining the City's commercial
insurance needs.
• Prepare reports informing the City's Risk Manager regarding insurance market
conditions that may affect the City's policies and risk exposures prior to policy
renewal.
• Prepare bid specifications and underwriting data (subject to the approval of the
City's Risk Manager) to submit to acceptable insurance markets for the purpose of
obtaining quotations for insurance coverage.
• Upon direction from the City, approach all acceptable insurance companies on
behalf of the City, and obtain written, competitive quotes for insurance coverage. A
complete list of the companies contacted, along with their response, must be
submitted.
• Present to the City all insurance coverage proposals obtained. This report must
contain a comprehensive analysis by the broker of the proposals obtained with
recommendations for the selection of one proposal for the particular risk to be
covered.
• Negotiate, on behalf of, and with direction from the City, with all insurance carriers to
obtain the best prices, terms and conditions available.
• Review all insurance policies and invoices received for policies purchased by the
City to assure their accuracy and appropriateness.
• Review and evaluate existing City policies to provide recommendations for
possible improvement of price, terms, and conditions.
• Service existing policies as necessary. This includes but is not limited to, issuing

certificates of insurance to provide evidence of coverage, promptly making policy
changes, and obtaining endorsements.
• Report any claims to the insurance carrier and monitor the handling and
disposition of the claim to assure the City's policy rights are protected.
Provide an annual report summarizing all insurance coverage in place,
anticipated market conditions, recommendations and strategies.
RFP PROCESS
RFP No. 32-07/08 was issued on July 22, 2008, and the Procurement Division e-mailed, as
well as uploaded the RFP to RFPDepot.com and BidNet.com, sending notifications to 50
firms. This outreach resulted in the receipt of three (3) proposals from the following firms:

The Committee unanimously ranked Arthur J. Gallagher as the top-ranked firm. Gallagher
is the incumbent provider of the insurance services, and has worked with the City of Miami
Beach for the past 13 years. They have extensive experience with serving public entities in
Florida, including several in South Florida, with offices in Miami, Boca Raton, Orlando and
Clearwater. Gallagher is the number one public entity and scholastic broker in Florida and
has been very responsive to the Citys requirements over the years.
Gallagher submitted a fee proposal that is consistent with their current agreement with the
City. The current agreement provides for an annual fee of $25,000, while their proposal
submission pursuant to this RFP is for an annual fee of $25,000, with a four percent (4%)
annual increase for up to five (5) years.
Willis of Florida, while a large firm nationally, has limited public clients in Florida, and
referenced one in South Florida. The Committee unanimously ranked Willis as the second-
ranked firm.
The proposal from Wachovia Insurance Services addressed maintaining an office in Miami,
however noted that the Miami Beach account, if awarded, would be serviced out of Tampa.
Wachovia did not reference any public clients in South Florida. Some members of the
Committee voiced that the proposal submission appeared geared more toward a general
corporate response than one tailored specifically for the City of Miami Beach.
CONCLUSION
The Administration recommends that the Mayor and City Commission approve the attached
resolution, which recommends the acceptance of the ranking of firms and authorizes the
Administration to enter into negotiations with the top-ranked firm of Arthur J. Gallagher Risk
Management Services, Inc., and if the Administration is unable to negotiate an agreement
with the top-ranked firm, authorize the Administration to negotiate with the second-ranked
firm of Willis of Florida; and further authorize the Mayor and City Clerk to execute an
agreement upon the completion of successful negotiations by the Administration.

f) METHODOLOGY AND APPROACH -The Proposer must specifically describe
its Proposal methodology and approach for completing the services required in
the Scope of Work.
Arthur J. Gallagher Risk Management Services, Inc. will be able to meet and exceed the
services required in your "Scope of Services". For the past 13 years, our service team
has proven itself to the City in its ability to deliver cost effective program solutions in the
three most difficult markets in the history of the industry, namely the post Hurricane
Andrew market, the Post 9-11 market and most recently the Post 2004 and 2005
Hurricane Seasons. Gallagher, has an outstanding service team already in place for
the City of Miami Beach. We have consistently provided the services outlined in your
Scope of Services and will be able to continue to exceed those minimum services
standards.
We recognize that servicing our clients' needs are very important to the entire risk
management process. Our risk management products and services are superior and
continue to meet the City's changing needs while continuing to strive for the highest

Risk Identification and Evaluation
The Gallagher Service Team will analyze the City's exposures as respects your
Property .and Casualty program. This process is done jointly with the City of Miami
Beach. We propose meetings with City representatives and review of all scopes of
services, contracts and other documents that may be related to program.
Based on these meetings, we initiate action plans, goals and objectives. We will identify
all of the risks to be evaluated for risk transferor retention under this program.
This analysis will serve as a basis for understanding which risk exposures the City has
previously addressed, which exposures may not yet be addressed, and the status of
measures that may be implemented to eliminate or reduce such risk exposures.
Together, we will discuss budgetary constraints, risk retention appetites, criteria for
insurers and specific program objectives.

Program Design
Upon identifying the City's goals and objectives, we will begin the process of designing
a program, taking into consideration the various insurance coverages, various risk
financing options, as well as the insurance carriers appetite in this market. First and
foremost, we will listen. What are the unique needs of the City as respects this project?
What does the City require as a program foundation?
Market Submission Preparation and Review
The development of a first class underwriting submission begins with an aggressive,
realistic marketing strategy based on a thorough understanding of the City's risk,
knowledge of the marketplace and, most importantly, identification of your needs and
expectations.
Our submission format is structured to emphasize the positive aspects of your risk, and
address any challenging issues directly:
• A brief cover letter specifying the time line of the marketing effort.
• A narrative describing submission, mission of the City as respects this
Program, review and disclosure of contractual procedures and liabilities,
probable maximum loss analysis and stated objectives of the marketing effort
including target pricing and service expectations.
• Outlining underwriting exposures, thoroughly described desired limits,
coverage, terms, and conditions requested.
• Requesting optional quotations and coverage enhancements
• Summary of possible losses and safeguards taken to avoid/reduce such
losses
• A brief conclusion emphasizing attractiveness of your account.
Marketing/Insurance Procurement
Clearly the cost of insuring the City's properties is a significant budget item. Market
knowledge, access and evaluation are critical to the City's risk management program.
Gallagher knows the markets to access and has strong relationships with these
markets. This is crucial to the placement of a successful and cost-effective insurance
program for the City. Our long-term experience with public entity institutions qualifies us
to analyze and negotiate with markets to obtain the broadest terms and conditions with
the most competitive pricing structure for our clients.
In the marketing stage, we consider service capabilities of the property and casualty
insurance carriers, as well as the carriers' ability to respond to all aspects of the
program design and underwriting specifications. We negotiate the broadest possible
terms at the lowest cost. We provide decision support, including analysis of proposed

terms and conditions. We have also drafted manuscript policy wording where
necessary to address the City's exposures as well as any additional contingent
exposures they may encounter during the life of the program. We negotiate critical
terms, and fine-tune the overall program based on the City's input. We are prepared to
assist the City in internal presentations to senior management and/or the Commission.
Program Administration and Execution
We take our responsibilities and obligations very seriously. As part of our day to day
service committment to the City of Miami Beach our services will include all of the
services specified in your RFP's "Scope of Services". In addition to that, we also
provide the following to the City:
/ Perform CAT modeling analysis to assist the City in determining appropriate
deductible/self insurance levels and insurance limits;
/ Assist City in maintaining and updating schedules of values and schedules of
insurance;
/ Review any related insurance company audits for accuracy;
/ Act as liason between City of Miami Beach and the carriers to resolve claims;
/ Advise the City, when requested, on coverage application to specific claims;
/ Maintain accurate claim data on an accident date basis and provide the City with
status reports, in the form and frequency agreed upon with the City;
/ Promptly file all claims with the applicable insurers;
/ Coordinate claims meetings with the City and the carriers;
/ Act as liaison between any loss control professionals and the City relating to this
Program;
/ Attend loss control meetings as requested by the City;
/ Review all loss control reports and consult with the City to ensure that significant
recommendations are addressed;
/ Maintain copies of all inspection reports issued for the job site(s);
/ Request Flood Zone determinations;
/ Assist in completion of Flood Zone applications with pertinent information
including photographs of location to be covered; if needed
/ Provide NFIP quotation to Risk Management Department;
/ Send application for NFIP coverage for issuance of policy;
/ Submit payment to NFIP carrier. Payments are made to Broker rather than
NFIP;
/ Review of all NFIP policies for accuracy;
/ Keep accurate schedule of locations and limits of NFIP policies;
/ Furnish continuing advice and counsel to the City;
/ Provide other related services as requested by Risk Management Department

Our Loss Control Consultant will continue to provide services to the City of Miami
