96-22108 RESO RESOLUTION NO. 96-22108 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA APPROVING FIFTY (50) TEMPORARY BANNERS ON OCEAN DRIVE BETWEEN FIFTH STREET AND FIFTEEN STREET AND FORTY (40) TEMPORARY BANNERS ON FORTY-FIRST STREET PROMOTING THE "HBO-MIAMI BEACH WEEKEND" OF SEPTEMBER 20, 21 AND 22, 1996. WHEREAS, the HBO cable television network ("HBO") is hosting a series oflive television events from Miami and Miami Beach on the weekend of Friday, September 20 through Sunday, September 22, 1996; and WHEREAS, HBO is hosting a free party Saturday night, September 21, 1996 in Lummus Park with a giant screen television in order for party-goers to view the Gloria Estefan concert happening simultaneously at the Miami Arena; and WHEREAS, HBO has requested fifty (50) temporary banners on Ocean Drive between Fifth Street and forty (40) temporary banners on Forty-First Street to be affixed to light poles located in the public right-of-way and measuring two feet by six feet with copy reading "HBO-Miami Beach Weekend" to promote the events for the weekend; and WHEREAS, HBO will post a performance bond to ensure the removal of the banners within seven days after the special event and to ensure that any damage to said light poles will be repaired; and WHEREAS, pursuant to Section 9-3.C.4 of the Zoning Ordinance, the right to install, as well as the number, location, and method of installation of banners in the public right-of-way is subject to approval by the City Commission; and WHEREAS, the City of Miami Beach will receive positive publicity, nationally and internationally, as a result of the upcoming "HBO-Miami Beach Weekend". NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the application for temporary banners requested by the HBO cable television network as set forth herein is approved. The banners will be affixed to light poles located in the public right-of-way and measure 2 feet by 6 feet with copy reading, "HBO - Miami Beach Weekend". A Performance Bond shall be posted to insure their removal with seven (7) days after the special event and that any damage to said light poles is repaired. BACKGROUND The HBO cable television network is hosting a live series of events from Miami and Miami Beach on the weekend of Friday September 20, Saturday September 21, and Sunday September 22, 1996. Comedian Robert Klein will be hosting a free party Saturday night September 21, in Lummus Park, with a Jumbotron - giant screen television, in order for party goers to view the Gloria Estefan concert happening simultaneously at the Miami Arena. The purpose of the banners is to promote the entire series of events for that weekend, with many internationally televised shots throughout Miami Beach including the areas where the banners are proposed to be located. 1 AGENDA ITEM c.1Y DATE~ ANALYSIS The Administration is requesting that the City Commission approve the installation of temporary banners pursuant to Section 9-3.C.4. of the Zoning Ordinance which reads, in part: Light Poles Banners: Banners affixed to light poles or other similar structures on the public right-of-way shall be subject to the following regulations: a. The right to install, as well as the number, location and method of installation of banners shall be subject to the Design Review process and approved by the City Commission and the Public Works Department. * * * e. Banners announcing special events either to be held in Miami Beach or to be associated in some matter with Miami Beach, as determined by the City Commission, may be erected up to thirty days prior to the event being announced and must be removed within seven days after said event. f. A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the City may at its sole discretion direct the banners to be removed at any time. If approval is granted, the proposed temporary banners will be installed as soon as possible and removed within seven days after the end of the "Miami Beach Weekend" which will occur September 20 through 22, 1996. Both the Ocean Drive Association and the Mid-Beach Partnership (representing 41st Street) are aware of the project and have verbally given their support. The national television exposure which will be given to each area is significant and, therefore, is viewed as positive for their economic vitality . CONCLUSION The Administration has concluded that the City of Miami Beach will receive very positive publicity, not only nationally, but worldwide with the upcoming "HBO - Miami Beach Weekend" and, therefore, the City should support this event and approve the "HBO - Miami Beach Weekend" temporary banners pursuant to Section 9-3CA. of the Zoning Ordinance. & JGPfHMlDJG enc: Banner Design AGV\F:\PLANlSALLICC_MEMOSIHBOBANER.96 2
