HomeMy WebLinkAbout2001-24472 RESO RESOLUTION NO. 2001-24472 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROPRIATING $40,000 FROM THE UNDESIGNATED GENERAL FUND BALANCE; ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER PERTAINING TO THE RANKING OF THE PROPOSALS RECEIVED IN RESPONSE TO REQUEST FOR PROPOSALS (RFP) NO. 18-00/01, TO PROVIDE A PILOT PROJECT TO PROVIDE PROFESSIONAL GRAFFITI REMOVAL AND PAINTING SERVICES ON PRIVATE PROPERTY; AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE TOP RANKED FIRM OF FLORIDA GRAFFITI CONTROL, INC.; AND IF SUCCESSFUL IN NEGOTIATING A CONTRACT WITH FLORIDA GRAFFITI CONTROL, INC., FURTHER AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT IN AN AMOUNT NOT TO EXCEED $40,000. WHEREAS, the City recognizes the importance of protecting the City's image and the quality of life for its residents and visitors; and WHEREAS, the purpose of graffiti removal and painting services on private property project is to provide for the rapid elimination of graffiti, which is known to be the most effective deterrent to its reoccurrence; and WHEREAS, the current process requires Code Compliance to cite the private property owner for graffiti, allow time for correction, and then, if compliance does not occur, set the case for the Special Master, which often results in a property lien, rather than the elimination ofthe visual blight caused by the graffiti; and WHEREAS, on April 17,2001, Request for Proposals (RFP) No. 18-00/01 was issued, and 240 RFP notices were sent by DemandStar.com to prospective individuals/firms, which resulted in the following three proposals: . Florida Graffiti Control Inc. . Inclan Painting Corp. . Eisenman and Elliott; and WHEREAS, on April 27, 2001, an Evaluation Committee (the Committee) convened, and aU members were briefed on several aspects of the RFP requirements and the City's policies and procedure relative to the Cone of Silence Ordinance and the Government in the Sunshine Law; WHEREAS, on May 18,2001, the following firms provided oral presentations and participated in a question and answer session: 1. Florida Graffiti Control Inc. 2. Inclan Painting Corporation; and WHEREAS, after careful consideration and discussion of the firms' strengths and weaknesses, the qualifications of the project team, the creativity and approach of each firm, current and similar projects, and the references provided by other clients, the Committee recommended Florida Graffiti Control, Inc.; and WHEREAS, Florida Graffiti Control, Inc. is well experienced in the operation of zero-tolerance anti-graffiti programs; and WHEREAS, the City Manager concurs with the Committee's recommendation. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, appropriating $40,000 from the Undesignated General Fund Balance; accepting the recommendation of the City Manager pertaining to the ranking of the proposals received in response to Request for Proposals (RFP) No. 18-00/01, to provide a pilot project to provide professional graffiti removal and painting services on private property; authorizing the Administration to enter into negotiations with the top ranked firm Florida Graffiti Control, Inc.; and if successful in negotiating a contract with Florida Graffiti Control, Inc.; further authorizing the Mayor and the City Clerk to execute a Professional Services Agreement in the not to exceed amount of $40,000. ADMINISTRATION RECOMMENDATION: Adopt the Resolution. AMOUNT AND FUNDING: $40,000 - Funds are available from the Undesignated General Fund Balance. ANALYSIS: The purpose of this project is to provide for the rapid elimination of graffiti, which is known to be the most effective deterrent to its reoccurrence. The Administration recognizes the importance of protecting the City's image and the quality oflife for its residents and visitors. The current process requires Code Compliance to cite the private property owner for graffiti, allow time for correction and then if compliance does not occur, set the case for the Special Master. Eisenman and Elliott EVALUATION COMMITTEE: Letter to Commission (LTC) No. 60-2001 established an Evaluation Committee consisting of the following individuals: Amy Agnoli - Middle Beach Resident Lynn Bernstein - Service Delivery Manager, City of Miami Beach Officer David De La Espriella - Miami Beach Police Department JeffGalitz, MD - North Beach Resident Herbert Hofer - South Beach Resident COMMITTEE MEETING: On April 27, 2001, the Committee convened, and all members with the exception of Amy Agnoli were in attendance. The Committee was briefed on several aspects of the RFP requirements and the City's policies and procedure relative to the Cone of Silence Ordinance and the Government in the Sunshine Law. All Committee members completed a disclosure questionnaire and certified that their answers were true and correct to the best of their knowledge and belief. Dr. Galitz was selected as the Chair of the Committee. ORAL PRESENTATIONS AND COMMITTEE DELIBERATIONS: On May 18, 2001, the following firms provided an oral presentation and participated in a question and answer session: 1. Florida Graffiti Control Inc. 2. lnclan Painting Corp. Note: Eisenman and Elliott submitted a letter dated May 18,2001, whereby they informed the City that they would not be able to attend (see attached letter dated May 18,2001). After careful consideration and discussion of the firm's strength and weaknesses, the qualifications of the project team, the creativity and approach of each firm, current and similar projects, and the Commission Memorandum RFP 18-00/01 June 27, 2001 Page 3 references provided by other clients, the committee ranked the firms as folIows: 1. Florida Graffiti Control Inc. 2. Inclan Painting Corp. 3. Eisenman and ElIiott Florida Graffiti Control (FGe) will provide comprehensive graffiti control services to the City of Miami Beach. These services will consist of providing the necessary equipment, supplies and personnel to treat the occurrence of new graffiti and the removal of existing graffiti. FGC is well experienced in the operation of zero-tolerance anti-graffiti programs. Since 1998, FGC has been the exclusive provider of graffiti control services to the City of Coral Gables. On a number of occasions, their work for the City of Coral Gables has been reviewed by the Coral Gables City Commission. On January 26, 1999, the Coral Gables City Commission again voted to extend the City's Graffiti Abatement efforts with the assistance ofFGC. Critical to the success of the City's zero-tolerance graffiti program is the establishment of routine contact with the City. FGC will work with the Code Enforcement and Police Departments to determine the areas most affected by graffiti. Each graffiti removal request from the City is forwarded immediately to the vehicles on patrol to further speed response time. FGC wilI be available 24 hours a day / 7 days a week as folIows: (888) 333-6374 - via their dedicated toll free phone number (305) 975-5313 - locally (305) 652-7246 - fax graffiti86@aol.com - e-mail Upon commencement of the contract, requests for service can be submitted via the web. The site will provide the City's Code Compliance Department with immediate and detailed reports regarding responses to city request for paint out of graffiti. Further, the site will provide photographs that may be used by the Police and Code Enforcement Departments. FGC will work with the City to design and provide detailed reports regarding all incidents of graffiti and disposition. FGC will perform the graffiti removal services as requested in the scope of services section of RFP No. 18-00/01, utilizing the same process currently used by the City's Parks Department to do Lot Clearance. Commission Memorandum RFP 18-00/01 June 27, 2001 Page 4 Code Compliance will cite private property graffiti; the owner will be given time to correct the violation; if he/she does not do so, FGC will be contacted to remove the graffiti. FGC will bill the City based on time and materials used, and the City in turn will bill the property owner for reimbursement. Failure to pay the invoice in a timely manner will result in the placement of a lien on the subj ect property. FGC will: 1. Remove graffiti from private residential, commercial and industry structures alleys and walls. 2. Provide personnel, supervision, tools, supplies, materials, equipment, transportation and other incidentals necessary to perform the work. 3. Remove graffiti from all types of surfaces, such as, but not limited to wood, metal, stucco, brick, concrete, cinder blocks, sidewalks, etc. 4. Maintain a zero tolerance zone Citywide by removing graffiti within 48 hours of notification. . As specified in the RFP, FGC will provide removal within forty-eight (48) hours, following notification, to include weekends and holidays. . Each service vehicle is equipped with a cellular phone and computer to stay in contact with the City's Program Coordinator. 5. Remove graffiti which is vulgar (i.e., profane, obscene or racist) within 24 hours (seven days a week). 6. Respond to reports of graffiti from the City Code Department and remove graffiti from private property within 48 hours of notification by telephone, fax or e-mail. 7. Provide the City with monthly reports no later than the 15th of each month, to include property location, date reported, date treated, and before and after pictures. 8. Make periodic formal presentations to the City Commission, City boards, community groups, homeowners' associations, and schools. These presentations may include a review of such data, documentation, measures and controls to demonstrate the level of effectiveness ofFGC'S efforts to reduce and control graffiti. 9. Match the existing surface color when painting over or obscuring graffiti whenever possible. Paint shall be neatly feathered in all areas. 10. Use appropriate protective materials to protect sidewalks and, vegetation from paint spillage. 11. Train its personnel in the appropriate methods of graffiti removal. 12. Remove all debris, waste and work product from the job site. . Additionally, FGC will remove litter and trash found at the job sites throughout the City. 13. Maintain a record/log of all requests. Records will be available to the City for review upon request. The complaint log shall include the action taken to resolve the complaint. Commission Memorandum RFP 18-00/01 June 27, 2001 Page 5 . All data will be available via the Website. 14. Assist the City with special requests (i.e., removal of graffiti before parades, special events, etc.) 15. Remove graffiti found on commercial signage with the owner's / occupant's specific, written approval and with the owner's / occupant's understanding that the contractor is not responsible, under this contract, for replacing any original lettering, pictures, etc., on a commercial sign. With the owner's / occupant's approval, FGC shall proceed with diligence to remove the graffiti with as little damage to the commercial sign as is possible. 16. Remove graffiti that is only accessible by boat on a case-by-case basis. COST FGC proposed a monthly fee of $8,825 for the removal of all graffiti found within the City limits. This proposed cost will be negotiated with FGC in order to agree to a cost per response. FGC's proposed fee is based on over 700 OFFICIAL citations/instances of graffiti in the past year. The number of actual citations/instances may be significantly higher than the official 700 annual citations/instances. FGC APPROACH Once graffiti is identified by FGC and reported to the City, it will be inspected to determine which method of removal is best suited for the location and surface. FGC conducts the following methods according to the following standards: . Graffiti Removal - FGC's removal will not leave shadows or ghosts after the graffiti markings have been removed. If the area is heavily graffitied, the entire surface is to be abated. The removal method will not harm, deface, or mar the surface. Removal methods will include sand or water blasting, chemical removal. . Painting - FGC is required to reasonably match existing painted surfaces and will properly prepare all exterior surfaces in a manner that will result in proper bonding of the paint. . Sacrificial Coating System - FGC will provide a sacrificial coating system to be used on natural surfaces when requested. The sacrificial coating will provide a removal- protective barrier between the base surface and graffiti markings made by spray paints, marking pens, crayons and other common defacing materials. Pressure or environmentally safe chemicals will be used to remove markings. . Trees - Will be treated on a case-by-case basis. Commission Memorandum RFP 18-00/01 June 27, 2001 Page 6 . Asphalt Concrete - street - FGC shall not be responsible for removing graffiti from the asphalt portions of the street. However, at the direction of the City, FGC may be directed to coat the surface with the appropriate colored materials. . FGC will provide storage facilities for its use. . Project Site Safety - FGC will provide, at its expense, all safeguards, safety devices, and protective equipment, and shall take any and all actions appropriate to providing a safe project site. . Water for the Project - FGC will be responsible for acquiring all necessary water. . Worksite Protection and Cleanup - FGC will take precautions to protect surfaces adjacent to the location where graffiti is to be removed. Adequate measures, including the use of covers, shall be provided by our company to protect adjacent surfaces, equipment and vehicles from over spray and from painting or sand and water-blasting operations. FGC will sweep all work sites clean of any debris during graffiti removal work. . Under the direction of the City, FGC will cooperate with the City, volunteer groups and other organizations in developing programs to eliminate graffiti. This effort may include participation in promotional plans and educational presentations. . Employees, equipment and vehicles of FGC will be neat and clearly identified. Identification on company vehicles will consist of the company name and local telephone number (contractor's dedicated phone line). Identification of employees will consist of a uniform and picture identification card to be worn at all times. . FGC will use warning signs and sidewalk and street cones in accordance with established Florida standards to inform the public of work being conducted. For any work performed within the public right-of-way, FGC shall obey any and all directives received from County and City traffic engineers. . FGC may request a police escort or presence to remove graffiti of a sensitive nature (i.e. gang related, etc.). The City will be asked to provide this presence when requested. Commission Memorandum RFP 18-00/01 June 27, 2001 Page 7 Other Prol!:rams "We have a anti-graffiti control program. Service is free for the first removal, but we have the option to bill afier that. We will also provide color-matched paint, brushes, rollers and graffiti remover free to our citizens. We can issue tickets for building owners who don't remove graffiti from their buildings however the city commission didn't attach afine. (We are working on changing that). Before we can paint out graffiti we must obtain a property enter release form (designed by the attorneys) the agreement releases the city from any damage that we might do. Our program costs the taxpayers about $2,000,000 per year." -Scott Shaw Assistant Superintendent Bureau of Street Environmental Services Department of Public Works San Francisco, California "In Santa Clara County, we have a pilot graffiti abatement program. The Board of Supervisors will vote next week if they wish to continue the program and pay for it out of the General Fund ($118,000 annually). We do not charge owners for removal at this time. However, if the proposed ordinance passes in August, we would require property owners to abate graffiti from their property. If they do not remove within five days the County abatement crews will remove it and may bill the owners - but we will do all that we can to assist them in cleaning it up in the first place. We will only charge in cases where a property owner is really uncooperative. The amount has yet to be determined. " -Lisa Rose Santa Clara Co. Graffiti Abatement "Here in Chicago we do have an Anti-Graffiti program. "The majority of walls andfences in Clark County, (Las Vegas) are on private property. Our Graffiti Abatement program assists property owners with the initial removal of graffiti vandalism from private residential properties. Permissionfrom the property owner is required. Commission Memorandum RFP 18-00/01 June 27, 2001 Page 8 Business or commercial property owners are responsible for graffiti removal from commercial properties including apartments, townhouses, gated communities, power easements, utility boxes and mailboxes. In certain cases, he's been able to find the predator and via the State Attorney's Office been able to obtain restitution for the City of Coral Gables.
