COMMISSION OF TIlE CITY OF MIAMI BEACH, FLORIDA,
RATIFYING THE REDEVELOPMENT BOARD'S
APPROPRIATION OF $44,267 FROM FY 2001 SOUTH
POINTE TAX INCREMENT FUNDS FOR ADDITIONAL
SERVICES TO BE PROVIDED PURSUANT TO THE
PROGRAM MANAGEMENT SERVICES AGREEMENT
BETWEEN THE CITY OF MIAMI BEACH AND HAZEN
AND SAWYER, P.C., APPROVED PURSUANT TO
RESOLUTION NO. 200I-24247/RDA RESOLUTION NO.
379-2001, AND AWARDED PURSUANT TO REQUEST FOR
QUALIFICATIONS (RFQ) NO. 102-99/00; APPROVING A
FIRST AMENDMENT TO THE AGREEMENT TO
PROVIDE PROFESSIONAL PROGRAM MANAGEMENT
SERVICES FOR THE OBLIGATIONS SET FORTH IN THE
PORTOFINO SETTLEMENT AGREEMENT; FURTHER
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE THE NECESSARY AMENDMENTS TO THE
AGREEMENT, IN A FORM TO BE APPROVED BY THE
ADMINISTRATION AND THE CITY ATTORNEY.
WHEREAS, on January 31, 2000, the Mayor and City Commission, also acting
as the Chairman and Members of the Miami Beach Redevelopment Agency, adopted
Resolutions No, 2001-24247 and 379-2001, respectively, authorizing execution of an
Agreement between the City and Hazen and Sawyer P,C. to provide Professional
Program Management Services for Assigned Capital Projects; and
WHEREAS, as noted on January 31, 2001, as the various right of way
infrastructure projects progress from planning to design, construction and operation, the
requirement for oversight of design and construction activities becomes essential to
Program success; and
WHEREAS, this need becomes more prevalent when considering the magnitude
of the number of projects being undertaken, the likelihood that individual project phases
will overlap with other improvements, and the potential impact on the day-to-day life of
the residents of the City; and
WHEREAS, the Administration determined to supplement existing staff through
obtaining outside assistance in managing these projects by retaining a firm with extensive
experience in Program Management; that is, the administration of the planning, design,
construction and implementation process ofthe capital improvements being planned; and
WHEREAS, proposed program and construction management services include a
variety of administrative tasks; and
WHEREAS, services to be provided include the administration and construction
supervision of approximately 6S infrastructure improvement projects including the South
Pointe Streetscape Project; and
WHEREAS, the terms and conditions of service of the proposed Agreement
between the City and H&S outlines that the H&S program management team will
provide the necessary administration of planning, design and construction tasks as a
number of the projects will proceed concurrently over the course of the next six years;
and
WHEREAS, included in the list of projects proposed to be assigned to H&S is
the South Pointe Streetscape Improvement Project, with its five phases; and
WHEREAS, Hazen and Sawyer shall serve as the City's program manager with
respect to the City's obligations as they relate to the Settlement Agreement Construction
bids obtained by The Related Group, and will be reviewed by Hazen and Sawyer; and
WHEREAS, progress payment requisitions prepared by the Contractor will be
reviewed by Hazen and Sawyer and recommended for payments to the City/RDA; and
WHEREAS, the scope of services shall consist of the following:
1. Assist the City in reviewing construction documents prepared by others,
2. Assist the City in reviewing cost estimateslbid proposals prepared by other,
3. Limited construction observation as it relates to utility relocation,
seawall construction/rehabilitation, Alton Road driveway opening and
pedestrian accessway.
4. Attend up to twelve meetings to resolve outstanding issues and/or
discuss project progress with the developer and/or City staff; and
WHEREAS, H&S services for the Portofino/Murano Project will include
construction administration, scheduling,
consultants/contractors contract administration,
implementation, constructability review and
recommendation; and
monitoring, budget evaluation,
design revisions evaluation and
associated cost evaluation and
WHEREAS, fee estimates were based upon proposed manpower allocations and
hourly billing rates for the Agreement contract term (refer to attached June 4, 2001
correspondence); and
WHEREAS, the South Pointe Advisory Board reviewed this item and the
accompanying Portofino appropriations on June 21, 2001.
NOW THEREFORE, BE IT DULY RESOLVED BY THE A RESOLUTION
OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, that Chairman and Secretary herein ratify the Redevelopment Board's
appropriation of $44,267 from FY 2001 South Pointe Tax Increment Funds for additional
services to be provided pursuant to the Program Management Services Agreement
between The City of Miami Beach and Hazen and Sawyer, P,C" approved pursuant to
Resolution No, 2001-24247/RDA Resolution No, 379-2001, and awarded pursuant to
Request For Qualifications (RFQ) No. 102-99/00; approving a First Amendment to the
Agreement to provide professional program management services for the obligations set
forth in the Porto fino Settlement Agreement; further authorizing the Mayor and City
Clerk to execute the necessary amendments to the agreement, in a form to be approved by
the Administration and the City Attorney.

Dear Ms. Cuervo:
We are pleased to submit this proposal for the City's consideration, The City of Miami Beach
and Portofino Properties have entered into a Developer's Agreement for various improvements
associated with the construction of the Murano and Murano Grande developments. Proposed
improvements include utility relocation, seawall construction / rehabilitation, miscellaneous
upgrades to Alton Road south of Fifth Street and the construction of a new pedestrian
accessway from the existing Miami Beach Marina to the Washington Avenue Extension. The
City has requested Hazen and Sawyer (Consultant) to provide program and construction
management services for the subject improvements,
Please note that Consultant does not contemplate in its services any effort associated with
coordinating the work of the private developer, its consultants and contractors. It is anticipated
that Hazen and Sawyer will perform the following:
1. Assist the City in review of construction documents prepared by others,
2, Assist the City in review of cost estimates / bid proposals prepared by others.
3, Limited construction observation as it relates to utility relocation, seawall

ANALYSIS:
On January 31, 2000, the Mayor and City Commission and RDA Board adopted Resolution Nos.
2001-24247 and 379-2001, respectively, authorizing execution of an agreement between the City
of Miami Beach and Hazen and Sawyer P ,c, to provide professional program Qlanagement services
for assigned capital projects.

supervision of approximately 65 infrastructure improvement projects including the South Pointe
Streetscape Project
The terms and conditions of service of the Agreement between the City and H&S outlines that the
H&S program management team will provide the necessary administration of planning, design and
construction tasks for capital projects, Included in the list of projects assigned to H&S is the five
phase South Pointe Streetscape Improvement Project Related to the South Pointe Streetscape
Improvements Project are several Portofmo Settlement Agreement improvement obligations of the
City/RDA,
Hazen and Sawyer shall serve as the City's program manager with respect to the City's obligations
as they relate to the Porto fino Settlement Agreement Construction bids obtained by The Related
Group (TRG) will be reviewed by Hazen and Sawyer. Progress payment requisitions prepared by
TRG's Contractor will be reviewed by Hazen and Sawyer and recommended for payment to the
City/RDA. The scope of services shall consist of the following:
1. Assist the City in reviewing construction documents prepared by others.
2, Assist the City in reviewing cost estimateslbid proposals prepared by others,
3, Limited construction observation as it relates to utility relocation, seawall construction/rehabilitation,
Alton Road driveway opening and pedestrian accessway, parking lot construction, and
environmental remediation activities.
4. Attend up to twelve meetings to resolve outstanding issues and/or discuss project progress with the
developer and/or City staff.
H&S services for the Portofino/Murano Project will include construction administration, scheduling,
monitoring, budget evaluation, consultantsJcontractors contract administration, design revisions
evaluation and implementation, constructability review and associated cost evaluation and
recommendation.
Fee estimates were based upon proposed manpower allocations and hourly billing rates for the
Agreement contract term, Specifically, Hazen and Sawyer has proposed a fee, not to exceed
$44,267, to perform said services (refer to attached June 4, 2001 correspondence).
On June 21, 2001, the South Pointe Advisory Board reviewed this item and the accompanying item
appropriating funding for the Porto fino related.

Therefore, the Administration recommends that the Mayor and Commission appropriate $44,267
from FY 2001 South Pointe Tax Increment Funds for additional services to be provided pursuant to
the Agreement between the City of Miami Beach and Hazen and Sawyer, p,c. approved pursuant
to Resolutions No. 2001-24247 and 379-2001 awarded pursuant to Request For Qualifications
(RFQ) No, 102-99/00, to provide professional program management services for the obligations set
forth in the Porto fino Settlement Agreement; further authorizing the execution of any and all
necessary amendments to the agreement, in a form to be approved by the Administration and the
City Attorney.
