2001-24503 RESO RESOLUTION NO. 2001-24503 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING BY 517THS VOTE, A WAIVER OF COMPETITIVE BIDDING, FINDING SUCH WAIVER TO BE IN THE BEST INTEREST OF THE CITY, AND HEREIN APPROPRIATING FUNDS, AND AUTHORIZING THE CITY MANAGER TO TAKE ALL EMERGENCY, NECESSARY AND APPROPRIATE ACTIONS TO PROVIDE THE NECESSARY SERVICES AND MATERIALS FOR THE REHABILITATION OF THE NEWLY CONSTRUCTED 20" WATER MAIN IN COLLINS AVENUE, FROM LINCOLN ROAD TO 23RD STREET, INCLUDING THE EXECUTION OF EMERGENCY PURCHASE ORDERS AND ASSOCIATED AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH MILLER PIPELINE CORPORATION FOR THE INTERNAL SEALING OF THE JOINTS, IN AN AMOUNT NOT TO EXCEED $200,000; AND WITH CENTRAL FLORIDA EQUIPMENT RENTALS FOR PROVIDING THE NECESSARY ACCESS POINTS AND FOR PROVIDING THE REMAINING WATER SERVICE EXTENSIONS, IN AN AMOUNT NOT TO EXCEED $1,550,000; FOR A TOTAL AMOUNT NOT TO EXCEED $1,750,000, SUCH FUNDING TO BE OBTAINED FROM THE SERIES 2000 WATER AND SEWER BOND FUND 424. WHEREAS, on October 18, 2000, the City rejected the bids received pursuant to Bid No, 114-99/00 for the construction of a 20-Inch water main on Collins Avenue, from Lincoln Road to 23" Street; and WHEREAS, a decision was made by the Administration to construct the water main with City Staff; and WHEREAS, delays arose during the construction of the water main, including numerous utility conflicts, weather delays, poor soil conditions, high water table, and extensive limitations imposed on construction activity due to the maintenance of traffic requirements ofthe hotels; and WHEREAS, the water main has been constructed, with the exception of the service connections from the existing 6-inch water main, which must still be transferred to the new 20-inch water main; and WHEREAS, the required pressurization of the main has not been accomplished because of leaks in the system; and WHEREAS, a repair method has been identified that seals each joint of the pipe and guarantees pressurization at the joints; and WHEREAS, a proposal has been received from Miller Pipeline Corporation for the rehabilitation of the water main which provides for a base cost for the seals and mobilization/demobilization of $98,500,00, and associated labor costs and appropriate contingencies to be paid based on an established rate schedule, in a total amount not to exceed $200,000; and WHEREAS, a proposal has been received from Central Florida Equipment Rental to provide the necessary access points for the water line rehabilitation process, and to provide the remaining water service extensions at a cost of $550,000, with a $1,000,000 bonus to be paid, provided Central Florida Equipment Rentals completes Phase 1 of the Florida Department of Transportation Collins Avenue Reconstruction Project by December 14, 2001, resulting in a potential contract amount of$I,550,000; and WHEREAS, if Central Florida Equipment Rental does not complete Phase 1 of the FDOT Collins Avenue project by December 14,2001, but completes both Phase 1 and Phase 2 of the project by October 17,2002, then the City's $1,000,000 bonus will be reduced to $650,000; and WHEREAS, under the its present contract with FDOT, Central Florida has designated work hours of 9 AM to 9 PM; and WHEREAS, Central Florida has stated that it may need to expand these hours to mid- night (three additional hours per day) if the 20" water main cannot be put into service by August 31, 2001 and staff recommends the authorization of these additional hours under these conditions; and WHEREAS, it is required that the competitive bidding process be waived due to the time restraints imposed by the ongoing Collins Avenue Reconstruction Project and because the improvements being constructed conflict with the existing 6-inch water main, which serves the hotels in the corridor and is in a highly deteriorated condition, NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission waive the competitive bidding process and authorize the City Manager to execute purchase orders and associated agreements, in a form approved by the City Attorney, to Miller Pipeline Corporation for the internal sealing ofthe joints in an amount not to exceed $200,000 and to Central Florida Equipment Rental for providing the necessary access points and for providing the remaining water service extensions in an amount not to exceed $1,550,000; and approve the appropriation of$I,750,000 from the Series 2000 Water and Sewer Revenue Bond Fund 424 to provide rehabilitation of the new 20-inch water main in Collins Avenue from Lincoln Road to 23'" Street. ADMINISTRATION RECOMMENDATION: Adopt the Resolution, ANALYSIS: On October 18, 2000 the City of Miami Beach rejected the bids received for the construction of a 20-1nch water main in Collins Avenue from Lincoln Road to 23'" Street. Three bids were received, with the low bid amount at $ 997,820.00 and the highest bid at $1,440,490,00, The bid amounts did not include the cost of the pipe and fittings, The pipe and fittings were to be supplied by the City, The additional cost for materials was estimated at $900,000, ---- AGENDA ITEM R 7 J 6-'17-0/ DATE 0'0 Commission Memorandum June 27, 2001 Rehabilitation of New 20-inch Water Main in Collins Avenue Page 2 There were particular concerns with the low bidder, who had not performed work of similar scope or magnitude in the past Out of the three bidders, the one deemed most qualified had entered a bid which was considered non-responsive (one bid item amount was missing), Additionally, there were major concerns with the complexity of the project and the constraints imposed by the traffic congestion and service to the hotels in the area, Numerous conflicts exist within the work area, including FPL duct banks, gas mains, sewer laterals, stormwater utilities, telecommunication and CATV facilities, and traffic signalization lines, The water main had to be configured to go around each of these conflicts, adding time and difficulty to the job. For these reasons, the Administration had serious concerns about the hiring of a contractor to perform construction work on Collins A venue, within the tight time limits defined by FDOT, Also, the City would not have direct and immediate control over the project should problems arise. A decision was made by the Administration to construct the water main with City Staff in order to try and meet the proposed Florida Department of Transportation's schedule for the reconstruction of Collins Avenue from Lincoln Road to 26th Street and to minimize the time needed by a contractor to learn the area, Delays arose during the construction of the water main including numerous utility conflicts, weather delays, poor soil conditions, high water table and extensive limitations imposed on construction activity due to the maintenance of traffic requirements of the hotels, The project was stopped several times for hours or days as requested by adjacent property owners (hotels with special events, ongoing private construction activity at property, etc, , ,) The water main has been constructed. To date, the City has spent the following amounts on the construction of the water main: Labor: Equipment: Materials: $ 559,648 $ 247,541 $ 946.000 $1,753,189 However, the required pressurization of the main has not been accomplished because of apparent leaks in the system, Additionally, the service connections from the existing 6-inch water main must still be transferred to the new 20-inch water main, City staff has worked closely with Miami-Dade County staff to conduct the necessary pressure tests and to isolate the locations of apparent water leaks, Some leaks were isolated and repaired, but the pressure testing of the water main has not yet passed, Additionally, City staff has utilized the most sophisticated equipment available on the market for leak detection and has not yet isolated all of the apparent leaks, At this point of time, it is necessary and appropriate to shift some of the remaining work to two different contractors in order to meet the identified December 14, 2001 completion date, The first Contractor, Miller Pipeline Corporation, specializes in sealing water mains from the inside of the main, The second contractor is Central Florida Equipment Rentals (CFER) who is the present FDOT contractor on Collins Avenue, Commission Memorandum June 27, 2001 Rehabilitation of New 20-inch Water Main in Collins Avenue Page 3 Contractually, CFER has exclusive control of Collins Avenue and any other construction work above or below ground must be approved by CFER. There are no provisions in the FDOT contract to require CFER to allow or facilitate work to be performed by the City or other contractors, It is proposed that Central Florida complete the remaining service extensions along the new 20-inch main in order to prevent potential conflicts in the work area between City forces and Central Florida. The rehabilitation method utilized by the Miller Pipeline Corporation, which guarantees a pressure tight internal seal at each and every joint provides the most promise for the repair of this water main, It has successfully been utilized both in South Florida and throughout the country, This will address the remaining apparent leaks, Based on Miller Pipeline Corporation's proposal for the rehabilitation of the water main, the actual cost of the seals required and mobilization/demobilization costs have been identified at $98,500.00, Associated labor costs and appropriate contingency brings the potential cost of the project to $200,000, An issue that affects the labor costs are the required access points that (with the required OSHA approved trench safety systems) must be provided, The excavation of the access points required (and associated trench safety system placement) will be coordinated jointly between Miller Pipeline Corporation personnel, Central Florida, and City staff. The proposal includes a detailed scope of services to be provided at an established hourly rate schedule for Miller Pipeline Corporation personnel as well as detailed descriptions of the City of Miami Beach and Central Florida responsibilities, Central Florida Equipment Corporation will extend the remaining water services and will provide the required access point for Miller Pipeline Corporation to complete the rehabilitation of the 20-inch water main at a cost of $550,000, This price reflects the cost of accelerated construction necessary, as this was not within the original scope ofthe work ofthe contract. As an incentive to complete the work in a timely manner, and to help minimize the risk assumed by the contractor in adding the city's water line work to their scope of services, the City will provide to Central Florida Equipment Rentals an incentive bonus of $1 ,000,000 provided Central Florida completes Phase I of the FDOT Collins Avenue Reconstruction Project by December 14,2001. Should Central Florida fail to meet the December 14th deadline, but is able to complete Phase 1 and Phase 2 of the FDOT project by October 17, 2002, then the City's bonus to Central Florida will be reduced to $650,000, This results in a potential contract amount of $1 ,550,000 and reinforces the City's commitment to the business community to complete construction activities in this area on time, As part of the agreement, if the City pays out a bonus, then Central Florida will hold the City harmless and waive any costs and claims incurred from the date of execution of the agreement. Under the its present contract with FDOT, Central Florida has designated work hours of 9 AM to 9 PM. Central Florida has stated that it may need to expand these hours to mid-night (three additional hours per day) if the 20" water main cannot be put into service by August 31, 2001.
